Public Defender Thomas Clinkenbeard opened his argument by saying Wilson had a consensual relationship with Brooks and someone else killed her. That someone else? The defense pointed to a man named Norbert Holston who is no longer alive. At the time of Brooks' death, Holston was the boyfriend of her sister Maria at the time.

Holston was described as volatile and allegedly threatened to kill Robin and Maria, according to the defense from testimony. The defense is also pointing to Wilson’s blood found on the walls to be from a workplace injury and not consistent with the prosecution's argument that the blood was from Wilson cutting himself in the process of killing Brooks.

Clinkenbeard paused during this argument to say, "It is a tragic tragic case. Let's not loose sight of that. It doesn’t mean you should convict an innocent man because it’s a tragic case."

The jury has started to review the case and a verdict is expected soon.

Defense motioned for mistrial but judge decided against and is ordering for more instructions for the jury. Given “the magnitude of the evidence in this case and jury has been working very hard,” judge has granted further instruction for jury to deliberate more. @ABC10

Sacramento jury says it’s deadlocked on DNA murder case; deliberations to continue

"On Tuesday, the jury told Judge James E. McFetridge that nine of the 12 jurors were in favor of a not-guilty verdict. McFetridge instructed the jury to return Wednesday to continue deliberations.

The jury foreman told the judge he didn’t know if, after two ballots, more deliberations would help them reach a verdict: “I think we’re getting close, we’re still discussing.”

I'm confused as to how 9 jurors are in favor of a not-guilty verdict. The defendant initially denied having sex with her and said he was never in her apartment, yet there is forensic evidence in the form of DNA (blood and semen) and fingerprints linking him to the crime. He also raped another woman weeks before.

Regarding the deadlock, the Sacramento Bee stated yesterday that it was 6 not guilty/5 guilty/1 undecided, so it was actually different than what was previously reported. The same article confirms that sentencing is set for April 22.

Don't worry about it, as you were correct! It was previously reported in this case (Robin Brooks) that it was 9 non guiltys and I posted the article on here. I was really disappointed by that, but apparently that was a false report.
