GUILTY CA - Sam Herr, 26, & Julie Kibuishi, 23, murdered, Los Alamitos, 21 May 2010

Just watched the dateline episode. Hadn't heard of this case before. Initial thoughts were distrust about Rachel. Also, dang, Sam was super handsome!

Now to read the thread. What an awful story and particularly senseless murders.

I watched Dateline last night too. I had heard of this case, but hadn't known the details. I noticed that when the host was interviewing Rachel, she would look off to the left of the screen (to her right). That's supposed to indicate lying (I don't know if there's any validity to that theory). She also seemed to need some time to construct her answers.

Yeah, she was super hinky, IMO. Her non reaction in the interrogation room, and they didn't mention on the show, but upthread someone said that post to the victim's Facebook was her first post in a month! I wish they would have asked her about that. I thought her and Dan had "dead eyes." And yeah, my super amateur lie-detecting skills, primarily gleaned from binging "Lie to Me" on Netflix lol, say she is shifty as heck, although I admit she did have me pretty convinced on the jailhouse phone call, and she did tell about the evidence, but I'm guessing that was self-serving.

I'm interested to see what happens with this case, particularly in regards to Rachel.

Also, Sam's dad was so endearing. I felt so bad for him and Juli's poor families.

I had nightmares about poor Juli.

Could she have had an attorney present during the interview? Sometimes they are present to assure nothing incriminating is said during interview,she would look in their direction for an ok and hesitate with answers until his approval.Just a thought.

Good thought! I don't think so, but I'm not 100% sure. I'd have to go back and re-watch, but I think some of her glances were both to the side and upwards.

I thought that jailhouse phone call was odd as I watched it -- I wondered why she was telling him that she was going to turn evidence into the police. If if was in that situation and had no involvement, I would have just gone straight to the police. Later in the show when her possible involvement had been brought up, looking back on that conversation, it was like she was explaining why she had go off plan.
 
Sentencing postponed in Daniel Wozniak double murder case

Sentencing was postponed on Friday to May 20 for convicted double-murderer Daniel Wozniak.

The 31-year-old Costa Mesa community theater actor was convicted in December of killing his neighbor, Samuel Herr, 26, and Herr’s friend Juri “Julie” Kibuishi, 23, in a plot to steal Herr’s savings.

The sentencing was scheduled for Friday, but Superior Court Judge John Conley agreed to continue the hearing at the request of Wozniak’s defense attorneys, Scott Sanders and Tracy LeSage, who said they plan to file a motion requesting that the death penalty to taken off of the table.

Convicted murderer's attorney seeks access to Orange County sheriff's records on jailhouse informants
The defense attorney representing convicted murderer Daniel Wozniak argued in court last week that he needs access to any secret records kept by Orange County Sheriff's Department deputies who worked with jailhouse informants.

Public defender Scott Sanders said the documents could be crucial to a motion he's crafting asking an Orange County judge to grant Wozniak a new trial or throw out the death sentence recommended by jurors.

Rachel Buffett's case is still pending. Looking over Orange County court records, there's a pre-trial hearing scheduled for November 10th.
 
Dan Wozniak's brother has been arrested and charged with felony domestic violence for punching, grabbing, and biting a woman he was in a relationship with.

Of interest to this case here, he pleaded guilty on December 15th to accessory to murder after the fact and was sentenced to probation through 2019.

Rachel Buffett will soon be headed to trial for her part in the crime, lying to investigators to cover it up.

excerpt: (Wozniak's) former fiancee, Rachel Mae Buffett, is accused of lying to Costa Mesa police officers investigating the murders by allegedly "propagating the false story that Wozniak told police about Herr having problems with his family, with the intent to assist Wozniak avoid and escape from arrest, trial, conviction and punishment for the felony," according to the OCDA. She has a pre-trial heading scheduled Jan. 27 and faces up to three years and eight months in prison if convicted.

Another pre-trial hearing for Rachel Buffett is set for March 17, 2017.

In California courts, cases can taken what seems like forever to resolve. I'll check in from time to time with an update.
 
Buffett's trial has been put off until September. Who knows when it will eventually be held. There will probably be more delays.

I applaud the DA for continuing to prosecute this case, but the California courts are a heck of a burden on the taxpayers.
 
Does anyone know if the court records/ police reports have been made public yet? If so does anyone know where to get access to them?
