Thinking about the TIMING here & USE of loan $.
Sept. 2024.** Kathleen P filed BREACH OF CONTRACT suit against SP claiming:
- March 2022, KP lent SP, her then-dau in law "$ 50,000 to help pay for her criminal defense attorney." (<---*Quoting MSM** not petition)
- Loan was made before KP learned kidnapping story was false.
- Oct. 2022, last payment made.
- Damages of $ 50,473. (Amt of loan, less paymts, plus accrued interest & late fees. See MSM** for actual numbers)
Q 1. IF ~ first week of March 2022, SP engaged law firm, say a few days before or after her arrest, would $ 50,000 be a TYPICAL RETAINER or unusually high for rep'ing her on the 34 counts of mail fraud*** & one count of making false stmts to FBI agents in original charges?***
Q 2. Did SP actually use the full $50,000 loan to pay retainer?
Q 3. Wondering how much of retainer would have been BILLED by -
Ap. 18, 2022..... Plea agreement, KP pleaded guilty to 2 crim counts.
Seems like a relatively quick plea agreement. Did it nail down both sentence & restitution amt?
Q 4. And how much MORE would have been billed by -
Sept. 19, 2022... when SP was sentenced.
18 mo. prison, then 36 mo. of supervised release, & $309,902 in restitution.***
Q 4. Any FURTHER legal services that would be provided after sentencing?
Q 5. After the last legal services were provided, was any of the retainer still remaining to return to SP?
W Sept 2022 sentencing & w Kathleen P's petition stating last loan payment was made in Oct. 2022, seems possible that law firm returned some $ from retainer about that time, which SP used as a loan payment. Or SP may have used for something else. IDK.
Q 6. Or at some point had law firm required ADDITIONAL $?
