I am surprised they will be allowed to challenge evidence in this phase of trial. This is supposed to be about mitigation; evidence in question would be irrelevant at this stage and should be challenged on appeal.

For one he is the one who linked the Safeway attacks to AGT...

It was the lead sheriff’s detective in the case, Sgt. Herman Leon, who linked the 2009 unsolved attempted kidnappings of the three women from Safeway stores in Morgan Hill to the abduction of Sierra.

Iirc, he gave an inaccurate statistic when testifying in the other case which had nothing to do with this case or the Safeway attempted kidnappings.

I read about it on this thread but I have no clue now which post though.

IMO, it's possible it was not a lie but an honest mistake. I can see why the cases in question were overturned based on the inaccurate testimony in those cases but that by no means indicates this witness gives false testimony in all cases.

Defense will have to prove inaccuracies by witnesses in this case for it to make a difference in this case.

But if this detective didn't "lie" or perjured himself in THIS trial - what does it matter???

I wonder why the prosecutor called Leon to testify if he has such marked credibility issues. Was it a careless move or was it because the issues in question are being exaggerated?

Perjury should be taken seriously; anyone committing perjury should face charges, especially law enforcement personnel. If you think that sounds discriminatory, it is, but only because LE are supposed to be about enforcing and upholding laws.

I wonder if Leon will be called as a witness in the new trial, if there is one.

If anyone here followed the Shayna Hubers trial...she is getting a new trial based on a juror lying on a questionnaire. It was a mistake, not perjury, but they used it to request a new trial and the judge had no choice. Hubers' jury recommended a sentence of 40 years so that's what the judge gave her; my hope is that her new jury is not so lenient.
