Smiley Martin, Suspect In Deadly Sacramento Shooting, Previously Paid Thousands In County Settlement
Weeks before Smiley Martin was accused of being one of five gunmen in Sacramento’s worst mass shooting, the county agreed to pay him a $7,500 settlement.

Martin claimed in 2018 that a jail guard was responsible for rival gang members attacking him. He claims the guard allowed rival gang members to interact with one another which resulted in Martin being surrounded by inmates who attacked him.

DA: 3 of 6 dead in Sacramento shootout were in gang dispute

Newly filed court documents in the downtown Sacramento shooting that killed six people and wounded a dozen others reveal that three of the dead had been involved in the gang dispute that led to the massive shootout, with at least one of them firing a weapon.

Documents filed Friday by Sacramento County District Attorney Anne Marie Schubert’s office show that the three deceased men affiliated with gangs were Joshua Hoye-Lucchesi, 32, Devazia Turner, 29, and Sergio Harris, 38, The Sacramento Bee reported Saturday.

*Hearing (@ 1:35pm PT) - CA - Johntaya Alexander (21), Melinda Davis (57), Sergio Harris (38/gang member), Joshua Hoye-Lucchesi (32/gang member), Yamile Martinez-Andrade (21) & De’vazia Turner (29/gang member) (shot dead; shootings took place in the vicinity of the 1000 block of K Street; 6 dead, and 12 injured, April 3, 2022, Sacramento). (4 of those wounded suffered critical injuries, the Sacramento Fire Dept. has said. At least 7 of the victims had been released from hospitals by Monday, 4/4/22) - for *Dandrae Martin (26) arrested (4/4/22) & charged with assault with a deadly weapon or firearm on person & convicted person carrying a loaded firearm. No bond.
In the video, a group of people surrounds two brawling men. One of the men chokes the other as people grab at them to try to pull them apart. The owner of El Santo said his security guards stepped in to try to break up the fight. A volley of gunfire breaks through the screaming and yelling. Then more rapid shots are heard off-screen and people begin to run.
4/4/22 Update: Sacramento Police Department SWAT members and detectives also served search warrants at three residences in the area. At least one handgun was recovered, police said. Investigators said they identified 26-year-old Dandre Martin as a “related suspect.” Martin faces felony charges on suspicion of assault with a deadly weapon and illegal firearm possession. Hearing on 4/5/22.
4/5/22 Update: Dandrae: Investigators believe the brothers possessed stolen guns and are working to review financial documents, call records and social media messages to determine how and when they procured weapons, the official said. A stolen handgun found at the crime scene had been converted to a weapon capable of automatic gunfire. District Attorney Anne Marie Schubert noted Monday that Dandrae Martin was not arrested on suspicion of homicide but said more arrests were expected. Dandrae Martin, who was held without bail, was freed from an Arizona prison in 2020 after serving just over 1 1/2 years for violating probation in separate cases involving a felony conviction for aggravated assault in 2016 and a conviction on a marijuana charge in 2018. Court records show he pleaded guilty to punching, kicking and choking a woman in a hotel room when she refused to work for him as a prostitute. Next hearing on 4/26/22 @ 1:35pm.

Smiley Allen Martin, the second man arrested in the wake of Sunday’s mass shooting in Sacramento that killed six, has a criminal record stretching to 2013 and last year was the subject of a plea by Sacramento County District Attorney Anne Marie Schubert’s office that he not win early release from prison, where he was serving a 10-year sentence for domestic violence and assault with great bodily injury. Despite a two-page letter to the Board of Parole Hearings urging that Martin remain in custody, he won his release and was in Sacramento on Saturday night recording himself on a Facebook Live video brandishing a handgun hours before the shooting.

4/5/22 Update: Police announced Tuesday the arrest of a "person of interest" they are identifying as 27-year-old Smiley Martin, who also suffered serious injuries from the shooting & is in a Sacramento hospital. He remains under the supervision of an officer at the hospital. (Smiley is reportedly brother of Dandrae). Martin, who was taken into custody Tuesday on charges that include possession of a firearm by a prohibited person & possession of a machine gun.
4/22/22 Update: Made first appearance in court. The judge read the charges that Martin faces: possession of a firearm by a felon & possession of a machine gun. He will next be back in court on 4/26/22.

*Mtula Payton (27) wanted on multiple felony warrants. Person of interest in the shooting. Current whereabouts unknown.
4/11/22 Update: Officers last week said there were at least five gunmen involved in the shooting. The police dept. said it believes 27-year-old Mtula Payton was one of those gunmen. He is wanted on multiple felony warrants that include domestic violence & gun charges. Currently, police don't know where Payton is, saying they've exhausted their leads. They're calling on the public to try & track him down.

Sacramento County District Attorney Anne Marie Schuper said that Dandrae Martin, Smiley Martin and Mtula Payton now face murder charges in the deaths of Johntaya Alexander, Melinda Davis and Yamile Martinez.
