In this particular article about Substitution of Trustee.....

"A Substitution of Trustee form is often filed when a loan on real property is paid off or refinanced. It does not necessarily reflect the name of the current property owner."

So,apparently, there are several ways a Substitution of Trustee is used.

IMOO.

. For example, many grantors and their respective spouses act as the initial trustees of a revocable living trust. In this situation, they remain in control until they are incapacitated or die Then pre-selected successor trustees are appointed in under the terms of the declaration of trust. Usually a spouse, family member or trusted friend are selected as successor trustees. A second successor is a person nominated to take over responsibilites of the first successor in the case of death or disability of the first successor.

I would LOVE to know who was selected successor!

I think she had been missing for some time and only reported as missing because maybe her son or her sister were starting to get suspicious.

I would think LE would ask the grocery store when they saw her last most times if you shop there a lot (I know I go to the store almost every day for something) They would say yes she was here yesterday or might say hey ya know we have not seen her here in a while and she used to come in often.

We need someone to step up and say they saw her.....

We NEED to know the last VERIFIED sighting of, and communication with, Susan... Aside from Husband's report...

Thank you Moderator, some things have been said in this (and related) string which are not respectful at all. Fortunately some of the most egregious posts have been deleted.

Victim Friendly

Websleuths is a victim friendly forum. Attacking or bashing a victim is not allowed. Discussing victim behavior, good or bad is fine, but do so in a civl and constructive way and ONLY IF IT IS RELEVANT TO THE CASE. Additionally, sleuthing family members that are not suspect is not allowed. Don't make random accusations or post personal information (even if it is public) like parking tickets, address, or first and last names of all their relatives and their neighbors. Also, never "bash" or attack them, or accuse them of involvement. However that does not mean that family members cannot come into discussion as the facts and issues of the case are discussed.

I went back to the first thread and found that Susan's son told us the mortgage had been satisfied, not refinanced. SO, if there was no lien the property could be sold. But, I don't know how if it's a community property state.

From what I have read California is a community property state.

Hmmm - wish I was on board from the first post here... I have flipped my side of the fence and am really bugged for sure.

I wonder if this is considered an active case by Roseville LE and if not, I wonder if they could use some nudging to tell the community something or investigate further..

Substitution of Trustee and Reconveyance was recorded on my property when I paid the mortgage off. I'm in California.

In California, if someone is missing, they have to be missing for 5 years before they can be declared dead. The family has to do due diligence to prove that no one has heard from them and that they've made efforts to locate the missing person to no avail.

That means a FB page, filing out a MP report, hiring a PI to look for them, and to get the word out. If after 5 years, no one has seen or heard from the MP, the family goes to count to declare them deceased.

Now that I am wondering is if a community property is sold and the funds go into a joint account under both names and either has access to the funds, if the one who is still around can use the funds to buy another house in their own name and thereby effectively bypassing the community property laws. Yeh, we need a lawyer.

Gitana1 is a verified attorney who is also from the state of California. Don't know if Gitana's specialty is real estate or what but they should have a working knowledge of such laws in any case.

I have lived in three states and after a death, there was a probate period. The estate of the deceased had to be announced in the paper and all creditors had a chance to claim debt relief. You can only spend what the state decides is your portion until it's all cleared. I don't know about CA though. My husband died in MI and I moved back to SC during the probate period and had to hire an attorney and it went on for 14 months. I couldn't sell anything that was titled to him alone. If it was titled to both, I could sell it and claim half. (vehicles for example) Very complicated and stressful.
