Accused killer Jarrod Wyatt’s defense attorney will take the unusual step of trying to present enough evidence at a pre-trial hearing next week to cap or throw out the murder charge prosecutors are seeking for the brutal slaying.

Wyatt is facing first-degree murder charges for killing his friend Taylor Powell, 21, at a home outside of Klamath on March 21.

Upon searching the residence, officers found Powell's body lying on the couch with the skin removed from its face and a large incision in its chest.
Wednesday, Kushner testified that when he performed an autopsy on Powell's remains on March 22, 2010, he found his heart had been removed, which he said could have been done with a pair of small scissors found at the scene. Kushner determined removal of the heart to be the likely cause of Powell's death.
The doctor also said the hyoid bone in Powell's throat had been fractured, indicating he'd been choked, and that he suffered blunt force trauma to his face and brain and his eyeballs and tongue had been removed.
Kushner said there was evidence of vital tissue reactions indicating that Powell's heart and tongue were removed while he was still alive, which he testified would cause a considerable amount of excruciating pain.
”There was a significant amount of hemorrhaging around soft tissue consistent with him being alive at the time,” Kushner said.

He said it was important to him that Wyatt admitted killing Powell, and that it was a premeditated murder that wasn't the result of drinking psychedelic mushroom tea. ”I wanted him to admit this wasn't the product of drug delusion,” Alexander said.

I wonder what the reason for the murder was if it wasn't for being high on drugs.

I really don't think that he deliberately killed his friend, but I do think that the killing and heart ripping thing was a fantasy he had imagined at some point(think mortal combat). I think the drugs took away his self control and sense of reality.

I'm really surprised that they got a plea on first degree murder. I think that that would have been really hard to prove. I'm glad they got a plea, he was clearly guilty of killing his friend, and a trial would have been very hard and would have given him too much room for future appeals, etc. I don't know why, but there had been no change of venue request, and there's no way could have gotten a fair and impartial jury up here. All the gory details are pretty well known due to this being a fairly small community and how much that has been published in the papers.
