Prosecutors reopened their case Monday in the trail of two former Fullerton police officers charged with beating to death a mentally ill homeless man in 2011. Orange County District Atty. Tony Rackauckas called to the witness stand a cardiologist who refuted a central assertion of the defense case -- that Kelly Thomas died from a heart attack brought on by years of drug abuse.

I've been really angered over this case. It was way under charged. It should have been 1st degree murder imo.
That poor man was beat pretty much to death right there in the parking lot. After he is begging his "Dad, Daddy" to help him they decide to hog tie him? Oh and yes, one officer stated he ride along in the ambulance just in case he starts causing trouble in there. Really? You freaking beat his brains out. He wasn't going to do anything ever again cuz you 🤬🤬🤬🤬 cops killed him.
The huge puddle of blood that was left on the ground from the beating is clearly 1st degree murder.
I feel awful that his Dad had to listen to his son begging for his help when he had no clue the 🤬🤬🤬🤬 cops were beating him to death.
Oh, I don't want those cops to go scot-free.

District Attorney Tony Rackauckas called Dr. Matthew J. Budoff, a world-renowned cardiologist and professor at Harbor UCLA Medical Center in Torrance, as a rebuttal witness to reassure the jury what numerous other independent, medical experts concluded in the trial: Thomas, who was severely beaten by a group of officers, died as a result of a lack of oxygen suffered during the gruesome attack.

In an attempt to rebut that rebuttal, the solemn defense team huddled, debated and then called Karch back to the witness stand. Having listened to Budoff, he appeared red-faced, flustered and, during Rackauckas' cross examination, highly defensive.

For example, when the DA asked if he disagreed with Budoff's conclusions about the size of Thomas' heart, Karch chose to be Bill Clinton coy.

He responded, "Could you define 'size' please?"

I truly wish these medical experts could be on the up and up. It really trashes the justice system when anyone with a degree will accept $$ for saying anything they are asked to say.

But, it does make me smile when they are put on the hot seat and asked to back up their false opinions after someone exposes them as liars. jmo

I listened to the DA's closing. He did ok, imo, but was not very forceful. Kind of rambling and had to refer to his notes more than I thought he should. Hopefully, the jury goes on "just the facts, ma'am".
I started to listen to the defense closing, but I was getting too angry and had to shut it off. So, I have no opinion on that. I saw that they are not done so will continue on Wednesday.

I totally agree ohiogirl. Another problem that tips the scales of justice toward the defense is not allowing past behaviors of defendants. The defense can trash the victim from here to eternity even if there lies cuz they don't have to prove anything. But by golly you can't bring up past behavior of defendants to show a pattern of regular abuses (in this case) by them.

It does look like the prosecutor did do a pretty good job with his closing. I sure hope the jury focuses on the tape and what their hearing. If they do they will find them guilty.

I cannot imagine anyone seeing and hearing that tape and not realizing that murder was comitted. Period.

However, I also could not imagine anyone finding Casey Anthony, the cops that beat beat the daylights out of Rodney King or OJ not guilty either, so I am not expecting much. Especially here behind the Orange Curtain.
