Still Missing CA - William Cierzan, 58, Santa Clarita Valley, 26 Jan 2017 #3

Most of what I will update is public information. This might add more questions that time will play out. Prior to the revisit to the Cierzan house on Feb. 13, 2020, Daniel was arrested on Feb. 5, 2020 at 6 am but not booked until 1744 hours. LA County arrest #5866609. On Feb. 8, 2020, Daniel was released 249 hours for PC 849 (B) (1):
(b) A peace officer may release from custody, instead of taking the person before a magistrate, a person arrested without a warrant in the following circumstances:

(1) The officer is satisfied that there are insufficient grounds for making a criminal complaint against the person arrested.

In addition to the posted information by GIG TU, the arrest was made at 0357 hours, and booking record is #5982215 at 0410 hours on Friday July 31, 2020 by LASD Surveillance / Appreh. team. Tuesday Aug. 4, 2020 San Fernando Superior Court Dept. "S" Case #PA095020 was his arraignment which I didn't attend as it was not yet in the system. Plea is scheduled again in Dept. "S" Friday Sept. 25, 2020 which I will attend.

Theory...

These remains UPDATE: Human remains discovered in Tick Fire area were found last year, easily accessible and close by to both the crime scene, and the suspect's home at the time of the murder. It took until February or so of this year to get evidence from the remains that could link the suspect to the crime, which is what triggered his arrest for basically nothing right about that time (February) - hence, while in custody they were able to obtain his DNA; which his attorney likely blocked previously as he was only a 'person of interest' and not a suspect. Once matched, along with whatever info the S.D. has that we don't know about = arrested and charged.
 
661 Rider....Because the court has limited the total amount of seats for people wishing to enter, being the first one into the court (that would be me) becomes very important. Linda Cierzan, Andrea Peck & husband sat in front of me. I didn't recognize on the other side of the gallery (until we all left) was Chuck Cierzan & step sister of Daniel was Tabitha Smith. The original "Paid Lawyer" is no longer being paid for, now is a public defender. The D.A. is from downtown Los Angeles Major Crimes division. She just turned over all of the discovery for the case, so the PD had not seen any of the documents. They pushed this out to November 20th for the next hearing
 
Daniel hasn't missed a meal comparing to other photos seen. There were words suggesting this will be a "jury trial". Those are NOT being heard yet since March, the courts are already setting the calendar to end this year on or about November 27th.

Next appearance is this Friday, you heading down TMS? If... big if... I go, what time would you advise I get there? Is it a first come first serve type of deal, or restricted to only interested/involved parties?
 
661 Rider, I will be there for sure. Court states the front doors open at 8:00 am, but it happens at 8:15 am. Dept. "S" never opens at 8:30 as advertised, BUT, I don't want to miss a seat.....SO, I'm cheap and park north of Maclay on 3rd and I believe the east side has Friday street sweeping so I get there around 7:45 am. Mask is necessary, belts removed before scanner, all coins, keys out of pockets in a dish. Hallway benches are marked where to sit along with seats inside. I will try to sit in the middle or left side to see detained suspects in the cage on the right. I'm usually the first 5 in the court. Hope to see you...expect very little to happen as the Public Defender just got the discovery materials on 9-25-2020.

12 Noon, back at home from Court. Myself, 2 other females from Santa Clarita were there, Linda, Andrea/husband, Chuck & Tabitha/step sister of Daniel were there. Because our gallery took up more than half of all allowable seats, we were all asked to stay in the hallway until the other cases were heard. Once we were called in, Daniel was brought into the suspect cage & needed to make his plea "NOT guilty". Pre-trial was announced to be Jan. 21, 2021, Dept "G" on the 3rd floor which should be Judge Walgren and D.A. asked this Judge to issue a demand for Chuck Cierzan to be at this hearing as he might be called to testify, he was in this court and said he would be. 661 Rider and any other citizen thinking they might want to attend, this should show enough of the PEOPLE'S CASE to forge forward to the actual trial.
 
In 2 days Jan. 21, 2021, this case is expected to have the Pre-trial hearing where the D.A. puts forward most of their case to show there is enough evidence to go forward....I plan to be there for this....BUT, today I went for a different case in a different courtroom. I was the only person in the gallery and the bailiff reminded me that since Nov. 30th, no family, no one but the attorney / suspect are allowed in court...I was politely asked to leave....Since I know that 5 Cierzan Family members have been at court, 2 other SCV members have been to court, I plan to be there but know that I might be asked to leave...
 
Thursday Jan. 21, 2021, "The Pre-trial", I was 4th in line to enter the courthouse, Chuck Cierzan was approx. 14th in line along with Tabitha Smith (Daniel's step-sister). Linda, Andrea Peck & husband were not in line as these new rules do not allow family of a case to enter the individual courtroom. Tabitha Smith was asked to leave and not enter the courthouse and so were 2 SCV people from the community asked to leave. Yes, I entered the courthouse but knew I would not be allowed into the courtroom, so I sat in the hallway to observe. Chuck had what I believe was a private attorney & not a public defender that told him NOT TO TALK TO ANYONE IN THE HALLWAY. When Chuck was told to enter the courtroom for his testimony, he was in for only 3-4 minutes. A short time later, the Major Crimes D.A. left the courtroom and I was NOT able to find out any details from the hearing....sorry, more of our Constitutional Freedoms REMOVED.

TMS or others, do you know of any updates on this since 1/21? I checked lacourt.org but it only shows case is pending. I have not seen any news coverage and I am curious if the nephew was released? Is a new trial date set?
