California preschool closes amid reports of sexual activity among 5-yr-old children

CARSON, Calif. (KABC) -- Richard McCarthy became the first parent to publicly allege oral sex between preschoolers at First Lutheran Church of Carson School.

On Tuesday, he also became the first of six different families to file a lawsuit against the school over allegations that their children participated in oral sex on the campus. All the families are filing individual lawsuits with the same attorney, Greg Owen.

"We have a system of things occurring, sexual acts occurring, and the school covering it up," Owen said.

In the suit, Owen alleges that a 5-year-old female student drew all over McCarthy's son's body with a marker during naptime in September.

"When I took his pants off to put him in the shower, he's got magic marker all over his privates and all over his butt," McCarthy said.

State regulators cited the school for that incident and for sexual contact between students."

So, after finding his son all covered in 'marker' including on his privates and his butt and it was handled by the State, McCarthy returned his son to the school.
Its looking to me like it is very possible that the poor maligned, damaged for life son, who kept having to go back to the unbearable school situation, possibly played a continuing part in the activities.

I have a couple of concerns with this article.

1. The lawyer states: "We have a system of things occurring, sexual acts occurring, and the school covering it up,"

The school states:
School officials said they reported every incident to authorities and parents

a warrant for the records with the authorities would quickly clear up the fact of the school covering it up or not.

2. I have a real problem with the parents involved in this.
Why would anyone keep their child enrolled in this school after the 1st incident? IF it truly did happen, this parent is being neglectful IMO. If someone is doing anything (drawing, oral sex etc) to my childs private parts, it is ME who would be protecting him by NOT returning him to the place that it happened.

The lawsuit claims that incident involving the woman's son was in September and never reported to authorities.
I realize that this lawsuit is blaming the school....but also....Did the parents of this child do nothing? Why were these parents also neglecting this child after this incident. When an incident is reported to CPS, they would contact the parent/child involved. If no one calls, would you, as the parent, not call them???? IMO this makes the parent neglectful as well.

Thanks, Cherie. It's been years now, but there was a time when we had some posters who slyly worked their way up to arguing for the NAMBLA agenda and expressing a really disturbing interest in the details of things like Jon-Benet's molestation.

For those who haven't been posting with me for 15 years, I just wanted to make it clear I am not one of those. Although we could have a debate on where the age of consent should begin, I am entirely in favor of laws preventing adults from having sex with children.

I just draw the line at "criminalizing" (either formally or informally) young children for experimenting together.

sheese, lol, many kooks have followed Jon Benets murder for less than true innocent reasons.

Adults.....always busy bring trauma to kids because of their own sexual issues....which, of course.....are valid.

It might be interesting to find out how many of the incidents his son was involved in vs. how many the other kids were involved in. The father seems to be blaming the girl, but without being there who is to say who instigated it the girl or the boy? Was the girl suggesting it, agreeing to it or was she being bullied?

I would have to say the school seems to not be supervising the kids very well though. That is way too many incidents. After the first one they should have been watching for it.

I do agree that the parents should have been more responsible and should have taken the kids out if they saw the problem. But I have also seen schools/daycares kind of play down incidents and offer assurances that the incident was over and there would be no more problems, when maybe things weren't over.

I wonder if the school has checked out the school employees who are there. Maybe they weren't learning it at home but at the school and it just got out of hand. When parents started seeing signs, then blaming a kid could make the kid the "fall guy."

In a letter obtained by Eyewitness News, the California Department of Social Services said it "determined that there was an immediate risk to the children in care" at the preschool. The letter said the school received a temporary suspension order Wednesday.

The department's licensing division visited the school Tuesday and said that during nap time, it observed a child putting their face near the buttocks of another child and began to bite at it. According to an evaluation report, there were five staff persons in the room, none of which saw the incident. One staff person was seated near the children and another was standing near them.

According to school officials, the school was set to close Friday because the director is leaving for personal reasons and no teacher wants the job. They insisted student sex has nothing to do with the closure. But that director is quoted by the state as saying, "We are closing down because our staff is not following through with proper procedure."
