No plea entered? I guess not.
The Defense had no disclosure documents. Unreasonable to expect a plea at this time. A one month, 3 day extension to find more evidence too then. Hope they find the bodies during this time, then case closed probably, unless the argument is an Insanity plea.

Wonder if there was a request for a psychiatric assessment? And, is DG still on suicide watch?

So, this means that now the disclosure has been delayed by the Crown? What's the reasoning for that? They've had 30 days to provide disclosure. That 30 days is today.

LE that has not disclosed evidence to the Crown yet, therefore the Crown has nothing to give to the Defense. Hmmm, why haven't LE sent anything yet? It's a reasonable expectation that the Crown, therefore the Defense, should have had something by now. The most damning piece of evidence to date would be what I'ld be sending first...and they say they have that...so...what's going on? Is there a reasonable explanation for this?

Triple-murder suspect Douglas Garland to make court appearance

http://globalnews.ca/news/1507329/triple-murder-suspect-douglas-garland-to-make-court-appearance/
August 14 2014

This is not an official transcript, and is not connected to any of the participants.
It is a rough draft, and all errors are my own.

News Anchor = Scott Fee = SF News Anchor = Amber Schinkel = AS Reporter = Jenna Bridges = JB

SF: The man accused in connection with the murders of 5 year old Nathan O'Brien and his grandparents, Alvin and Kathryn Liknes, is expected to be back in court today.

AS: And Douglas Garland has been under suicide watch since he was arrested last month. Jenna Bridges joins us this morning from the Calgary Court Centre with more. Jenna.

JB: Good morning, Amber. Well, since his last court appearance, we've learned that Calgary Police Service detectives have been visiting Douglas Garland at the Calgary Remand Centre. It's a technique that isn't very common, but not completely unheard of. The reason that the case was put over to today was to give more time for the defence to be disclosed evidence.

54 year old Douglas Garland is facing two counts of first degree murder and one of second degree murder in the deaths of Alvin and Kathryn Liknes and their grandchild, 5 year old Nathan O'Brien. The three have not been seen since June 29th, since the trio disappeared from the Liknes home in the Parkhill neighbourhood.

And so far their bodies have not been found, but police say they have enough evidence to charge Garland with first and second degree murder. The Crown also says that, even without bodies, it also has enough evidence to build a strong case,

The Calgary Police Service has expanded its investigation to Mexico. Prior to their disappearance, Alvin and Kathryn Liknes had been planning to move there. The Calgary Police Service would not elaborate on where in Mexico officers are or why.

As for what happens today at court, that will depend again upon what evidence to the defence, But, again, 54 year old Douglas Garland is scheduled to make his second court appearance some time this morning. Scott, Amber.

AS: All right. Thank you, Jenna.

JB: You're welcome.

AS: Jenna Bridges reporting live from the Calgary Court Centre this morning..

Just back from court. As we suspected disclosure has not been made to defence and the case has been held over to 9am on September 17 when DG will again appear via CCTV. Sat next to AL and another couple who chatted to Nancy Hixt while I eavesdropped. She will have something to share by 6 tonight relative to a trust. I heard her confirm that the family want this info to be shared. DG is diminutive - my guess maybe 5' 7". He is looking fuzzy again with his hair grown fuller and longer and a 5 o'clock shadow of note. JO and RO were there but not in courtroom 305. I saw them enter through security but not thereafter. Perhaps there is a special room where they can watch proceedings via CCTV? So all in all a non-event. All the usual suspects from MSM were there and Kevin Martin sat to my left. Shane Parker said something about an entire hard drive of evidence but I couldn't discern precisely what he said... Whatever it is will be ready by Tuesday. Sorry There's nothing definitive to share.

Nice to have a first hand account Cherchri.

Douglas Garland matter set over to Sept. 17th on murder charges. A harddrive full of evidence will be provided to defence next week.

If it's DG's hard drive, it could comprise the whole premeditation aspect of the 1st degree charges.

The reasonable explanation is the Crown provides disclosure within a timeframe established and permitted by law, not simply whenever the defence team would like to have it.

Could there be another meaning to " a hard drive full of evidence" ? I'm only asking because I don't always understand/speak tech-talk. Thanks.

There could indeed. He mumbled, it was hard to hear exactly what he was saying but I interpreted it to mean there was so much evidence it fills a hard drive. Ambiguous though.

Their timeline was 30 days. They were to provide disclosure by yesterday I believe, and even got that held over until today. That was what was established by law.
They are now delayed.

It says "a harddrive full of evidence will be provided to defense next week". I would assume its an LE harddrive with all the evidence on it and not DG's harddrive, or they would've said that IMO.

Without a doubt, bigger minds than ours have got this !

Would they have gone paperless?

IMO, DG is smarter than that. However, it could be that he thought he wiped his hard drive clean...which doesn't really help him at all.

"Many crimes are now committed using computers, the Internet and computer technology – much of which creates its own set of logs and transcripts that are hidden away for only the most expert to find. Those who commit computer crime such as online banking fraud etc often find it difficult to dispose of their cyber trail even though for the most part they think that they have.

Specialist computer experts – forensic computer technicians – can reconstitute wiped hard drives and reassemble erased files in order to build up a detailed picture of the suspect’s online activities. This is also useful if the suspect is considered to be involved in the production or distribution of child

Can you explain the " relative to a trust" portion please. Is this information the family was given early on but had to keep quiet until a specified time that they are now able to share?

I_think_ the hard drive is the brain and memory of a given computer. Doubtful that LE/Prosecution would present it's OWN hard drive as evidence.
Sorry for sounding clueless, but I didn't grow up with this :)

I totally agree, they certainly do :)
Odd though...Matthew De'Grood's disclosure documentation (perhaps incomplete), started making its' way to the Defense within the 30 day period. I suppose that's because that case was obvious. Bodies, suspect placed not far from the scene of the crime, witnesses...much different scenario. Could a tougher case be had? No bodies, no smoking gun, no witnesses...it's no doubt going to be tough for all.

No, I wouldn't think they'd give up their own but rather have all evidence copied onto a hard drive.
