Isn't the whole point of having a public trial so that the public can make sure that justice is being done? So how is it allowed that a PB can be issued to protect the rights of the accused? I can see if they are trying to protect a victim, or a witness, but not the accused?

The public doesn't have to make sure that justice is being done, the lawyers and the judge do. I think that all information is available after the trial, so the public can probably have a look at things after? I'm not sure.

Does anyone know who can request or instigate a publicity/media ban on trials? Can the victim's families, LE, the defence, the Crown or all of the above request this?

ETA - I thought the Liknes family might request a publication ban as ALJr has posted two articles about publication bans on his FB. Wondering if this possible, they might not want the family's private business made public at trial.

All of the above, BUT when a ban is requested by the defence, it MUST be granted; all other requests are at the discretion of the judge (or when required by law, i.e. to protect the identity of a minor):

Publication bans come in two flavours—statutory bans and non-statutory bans.

Statutory bans can be initiated at the discretion of a judge, or upon the request of a prosecutor, a defence attorney or by an accused. While a judge can refuse a prosecutor’s request to impose a ban, a request from a defence attorney or an accused cannot be refused. Statutory bans are used to protect the identity of juveniles, witnesses and victims of crime, especially sex crimes.

On rare occasions, a statutory publication ban will be imposed automatically. For example, journalists are prevented from publishing any confession or admission by a suspect made at a pre-trial hearing. Not only is this ban is automatic, it is also not likely to be formally mentioned in court, which means all journalists need to be cognizant of this fact before entering the courtroom.

A second instance in which a statutory ban is automatic is at the trial stage. Section 648 of the Criminal Code states no information regarding any portion of the trial at which the jury is not present “shall be published “before the jury retires to consider its verdict.” A jury will be removed from the courtroom during what is called a voir dire, in which a judge determines the admissibility of evidence, such as a weapon seized using a search warrant or incriminating statements made to police.

Non-statutory bans are a category of restrictions known as judge-made bans, which means the decision on whether to restrict and to what extent the media can publish information is determined on a case-by-case basis. While judges have discretion in this area, they are not without guidelines. The case that has had the most influence in creating the test all courts now apply when considering whether to impose a judge-made publication ban is Dagenais v. CBC. It is a case all reporters need to understand.

I'm having a really hard time with this whole case lately. I am deeply disturbed that NO suffered, and based on a number of factors I really think DG is a sick and twisted man, and didn't do this quickly and efficiently. I keep coming back to the thought of DG using NO as leverage to get KL and AL to leave the house, KL trying in desperate attempt to save her grandson, and then DG killing her and again using NO to get AL out of the house to another location. I keep coming back to the comment from LE in regards to the Amber Alert- "NO may be in the company of his grandfather" or something similar to that.

I'm not religious, but I PRAY, so hard, that NO didn't suffer one bit of fear or pain. Bless his precious heart. I've never so hoped there is a heaven and all 3 victims have been welcomed with open arms.

Sorry for the morbidity. I'm having a really difficult time this past week. I should probably take a break from WS but I feel that justice, no matter how it is achieved, is the only glimmer of hope for these families.

I'm sincerely hoping that this is not what happened. I just don't imagine that there is a human being out there that would do this to a child. I could see perhaps NO being the one used as leverage to get AL and KL out of the house for sure, but I'm not sure NO would've been left to the end to watch all of it. I think if anyone was left to the end, it might have been AL...what better torture from an angry ex-business colleague than to have him watch the death of his loved ones. No matter what did happen though, the fact is the end result is the same.

I'm sure I speak for a lot of us that join you in prayer that the suffering of all was minimal. You weren't morbid. Sending love, light and blessings to you to feel better about all of this. Know that God works in mysterious ways and that justice will be served in its rightful place and this family is now at peace. Wishing you peace while being involved in this forum and strength to handle the hard to hear and unimaginable things. You are a kind soul, try to detach from the emotional part of this situation and be an observer...if you get too involved emotionally, it'll cause you a really tough time...that won't help anyone. Me too Whatcha, I get super sad and then PO'd about the fact of NO being involved at all. I keep asking my self why? Why not spare him, why did someone have to do this to a kid? Why that night of all the nights? I think this as a mother, I think that's why it's so under my skin.

I don't have an organized or set religious belief per se, I guess I'm spiritual but I'm with ya - I now hope there is a heaven or safe and peaceful place for NO and all the other kids, otherwise, it's too hard to fathom why this happens. I said in an old post of mine that I take a *tiny* spot of comfort knowing the parents are very religious and they feel that God is now looking after Nathan and AL/KL.

I hope justice is served too.

It is amazing how many fingerprints, drips, splatters, and scratches on a wall you can see with a flashlight. I wonder if that technique was used to clean up the crime scene before it was investigated by LE.

Wouldn't they want to leave the fingerprints from the estate sale to cause DNA confusion? If they had an alarm system (whether used/turned on or not) I wonder if there was finger prints on it? It might be unlikely garage sale enthusiasts would be interested in touching the alarm.

I've decided to act like a reporter from the 1940's and go digging, not just take word for it and not look deeper;

anyhoo, I didn't notice the connection at first and then came to the conclusion that "Petty" is a huge understatement, IF this is the system that DG modified.;

Definetly they would leave those marks but depending on the entry, exit of the perp(s) they may retrace their steps to make sure they didn't leave anything behind.
