I think it is a error in judgement for the prosecution to label the motive a "petty" grudge.
Prosecutors speak for the people, are to remain neutral, and are to present the facts. The use of the term "petty" implies a judgement and opinion of the grudge, which I think is entirely unprofessional.
We know that Garland and Liknes were working on a patent, and that Garland contributed to that patent. We know that Garland had completed his work on the patent because the patent was filed. We know that Liknes fired Garland from his work on the patent because Liknes had a vehicle breakdown, and Garland didn't answer the phone during that vehicle problem.
It is not legitimate to fire Garland on those grounds. Liknes then went on to file the patent, omitting Garland's name. That is completely unreasonable, and gives me the impression that Liknes took advantage of Garland in that situation. I think that Garland's grudge against Liknes was legitimate and the prosecution should not suggest that unethical work practices are "petty".
Garland's actions are unreasonable, but the grudge is not petty.
One of the reporters tweeting yesterday reported more of what was being said in the courtroom when Allen was testifying. It seems the L family has also made light of the pump and the patent issue, saying that DG had only worked on the first version, and making it sound as if DG's contribution was minimal and unimportant.
It sounds like there may have been subsequent versions which may, or may not, have resulted in more success? Who knows if whatever role DG played in the 'first version' continued to play a role in all or some of the subsequent versions, and whether that role should have rightfully been acknowledged, and whether or not any of those subsequent versions brought revenues?
I have no idea how pumps and patents work, is it kind of like..... if a restaurant hires a chef, do the chef's recipes that he creates as an 'employee' of the restaurant, belong to him, or to the restaurant? If the chef is an independent contractor, does that get treated the same way? If the recipe won an award, would the credit go to both the restaurant and the chef or only to the restaurant/owner? What was the 'agreement' between the 2 men?
I believe I read in one place that DG 'worked for Alvin', but in another, I believe I read that he was hired as a contractor. Does that make a difference in how the patent should have been treated, if DG was operating as an independent business of his own while he worked with Alvin on the pump for his business? If a book has one author, but with a contribution by another author, should both names be acknowledged? What if author#2 was employed by author#1 to DO that writing? Legal matters... too bad he didn't resolve by taking the matter to civil court? (Although, if because they were introduced through family and may have operated together on a more casual basis, they hadn't bothered to make an agreement in writing as to the specifics, DG would have been out of luck, moo)
In any case, it certainly doesn't justify what DG did. It possibly CAN however, speak to the potential festering of a grudge that DG may have held in wanting to get revenge against AL for perceived injustices as he commenced his retirement between his summer and winter homes. The method, and the madness, and the taking of additional, innocent, victims are what sets this crime apart. (moo)
Just as an aside, if DG was working as an independent contractor (his own business), working on a pump... it does seem strange for AL to 'fire' him for not dropping everything to deal with his vehicle breakdown issues?
