A jury of one's peers. They gather for a moment in time, judge the law and return to their fields. It's the greatest constitutional right of all times – the foundation of the freedom of the individual against the arbitrary authority of the despot.

This process is so powerful. One of my favourite movies of all time is "12 Angry Men". I loved the original and loved the remake almost as much (but not quite). If you haven't ever seen the movie I HIGHLY recommend it. It's one of the best "character" movies ever.

So sad about Rod O'brien taking the stand. That poor family. I hope their oldest son can recover from this.

When did that happen?

When did that happen?

He took the stand to argue against the aerial photo being released. Don't know exactly when but jury wasn't present.

I'm hanging in here tonight until word Jurors are done for the night or have a verdict. I hope I am here with you all when the verdict comes in. I have an in and out day tomorrow. I find it helps to be here when it comes down. Especially in such a horrific case. A kinship.

I hope to be here when verdict comes in, too.

The article where Nathan's father requested the aerial photos not be released was heartbreaking, as so much of this has been.

http://www.thetelegram.com/news/reg...sn-t-heard-by-jury-in-triple-murder-case.html

O'Brien said Nathan's death has been hardest on the child's 14-year-old brother Luke.

"He doesn't talk about it. He's living his life without Nathan and at times I see him depressed," O'Brien told the judge.

He said the deaths have also had a strong impact on his brother-in-law, Jeff Liknes, who lost both his parents.

"I would say Jeff is trying to get back into a full life, but I do see a change," O'Brien testified. "He's more introverted and staying away. He's just trying like the rest of us, but he has no one to talk to."

O'Brien worried what further damage would be done by the release of the photo, which he was shown by police.

"It's going to harm my boys and us. It puts us at risk of developing as a family, and (risks) the development of our children," he said.

"They don't want to see their brother lying in a field," he continued. "Luke is going to be re-accessing that photograph — the grief, the depression, which opens the door to suicide."

The father said his other son, four-year-old Max, would grow up to be old enough to see the photo again and again if it were on the Internet.

I'm sat in bed, in the middle(ish) of the UK, it's 1.45 a.m.

When I first heard the name Nathan O'brien, my son was 5 too, my son loved Superheroes and cuddles and going to play on the swings.

Now my son is 8. He's sleeping next to me as I tap at my phone screen. I'm not convinced that the 3 sneezes earlier tonight do mean he's ill and 'has' to sleep in my bed in case he needs me ... but I let him.

I'll take every snuggle, every kiss, every hand hold, every everything and i'll treasure it just that little bit more because somewhere across the other side of the world, Jen O'brien would give anything to be able to hold her boy and she can't.

This trial has been a long time coming. Canada, I don't know if you're patient or just slow! I've been impressed with your Judge, he comes accross as a very genuine man and I feel like he's steered this ship well ...

I dont know if I'll be able to keep my dry eyes open til 9pm/4am but, if not I hope to wake up to news that Douglas Garland has been found guilty on all 3 counts of 1st degree murder.

This is lovely. Thanks for sharing it from across the pond.

No family should have to go through this awful loss. Their lives have been permanently scarred. Jury cannot not find him guilty of murder 1 x 3 !!!!!!

Reading the testimony about the boys and how it will affect them forever has me teared up. This will forever be with the families. We all know this but sometimes it takes me aback.

So DG's lawyers did argue the search of the farm. I wonder if that will come up again in an appeal? How would this case have been different if they couldn't use the materials found at the farm? They'd have the Liknes home with no DNA from DG, the videos showing what appears to be his truck in the area going back and forth with no white tarp and then with white tarp and they'd have the aerial photo. Would that have been enough? Although the green truck was not at the farm at the time so perhaps that would also be included? :waitasec:

Good points

I didnt realize they challenged that.

The prosecution would also have the blood under the bed of the truck as they took it apart. So it may have been enough anyway but it sure would have made the case much harder.

I suppose they won the argument to allow the evidence because they were looking for any hints as to where they were and were looking for things to help them find them. Although thats a stretch since they did have specific instructions about the search. Its interesting.

If they are sequestered, they're probably going to enjoy a night on the Crown, sleep on their thoughts, and take a vote in the morning.

With the clock running out before Garland either had to be charged or released — and after emotional pleas from his own elderly mother Doreen and from Jennifer O’Brien, Nathan’s mother and the Likneses’ daughter, had left him unmoved — Allen pressed a map of the farm on him and begged him to just point to “where the boy is.”

The police were convinced — and the evidence of a violent struggle, including a bloody handprint that may have been Nathan’s, supported their belief — that the three were still alive when they were taken from the house.

As are police the planet over most driven by the plight of children, they were desperate to find them, particularly Nathan, before they succumbed to the injuries that clearly had been inflicted upon them.

With the map in his hands, Postmedia has learned, Garland leaned back in his chair and studied it intently for a couple of long minutes.

Then he said, in effect, “I think I’m getting tired” and asked, as though he knew very well the clock was ticking, “What time is it?”

The black and white original is awesome and we had to watch that as part of a high school class.

At first I thought I would get a nice sleep during class and once it got going I found it to be so compelling.

It was so realistic of how a jury sometimes handles these tough murder trials. Each single juror of the 12 had their own values and morals that they bring with them into the jury room.

It was fascinating.

Ill have to check out the newer version as I had not seen that one.

Why would everything have to be thrown out, rather than just the two pieces (shoes and kill-bag kit)? Once they obtained a legal search warrant and found blood on light switch, the boots, meat hooks, fire pit, burn barrel, etc. they would still have plenty of evidence. I don't understand why that other evidence would not be considered legal.

Ugh ... I guess because the legal search came as a result of an "illegal search". However, that "Illegal search" was conducted on the exigent circumstance that they were looking for live bodies.

Oh it's coming.....

Bags of women's clothing, synthetic breasts and baby soothers were all found on the propery. Oh my...

The guy is pretty messed up. Women's clothing, women's shoes, diapers and soothers. Mommy dearest at work. He's not getting off. He will spend the rest of his life behind bars and I hope it's mentally and physically a very painful stay. RIH disgusting evil monster. I hope he eventually brags about all the others he has murdered and give those other families so sort of closure also. Yes I do believe he has murdered in the past. This BS just doesn't start at 50+ years of age. The guy is deranged and has been for many, many years.

I predict within an hour after lunch tomorrow we will have a verdict...GUILTY of three counts of first degree.

My thoughts and prayers are with Alivn, Kathy and Nathan's love ones during this yet another difficult time in their lives. RIP Alvin, Kathy and Nathan.
ALL MOO.

Fruit of the Poisonous Tree.

I have no doubt there will be an appeal. We know he will.

Thanks JadeSLeuth :) I've been here since thread 1, hoping for the best outcome at first and then of course, sharing in the sadness, disbelief, anger. Not imagining that it would take almost 3 years to find out that this wasn't some 'petty' argument boiled over and covered up but, a long seethed revenge, meticulously planned and almost expertly executed.

You Canadians can be very, VERY proud of your law enforcement, from every scientist, to wet nose and wagging tail and all those hard working officers in between.
Whatever the outcome, they've done Nathan, Alvin and Kathy proud.

Yes, I can see DG taking law courses in jail. It has always been about him.

I'd just like to take a moment to give you a huge personal thank you. Not only for the tweets (you're thanked a lot for that) but because of your pleasant nature and the way that you make us all feel welcome. We're all human, we're going to disagree and have different interpretations but you have this aura to you that is very graceful and so even in those disagreeing moments your true self shines through. You're respectful and tactful, a great example for us all. I can tell you're a great person and I want you to know it goes noticed. Thank you.
