GUILTY Canada - Amber Kirwan, 19, New Glasgow, NS, 9 Oct 2011 - #2

I guess I will never know the answer but why drug Amber. Unless you intend to keep a Victim for a period of time. Hate to think it but......

BBM - Agreed, but lack of motive is often seen as a point in favor of the defense. :(

I think the Jurors as well as us can guess the motive. Just connecting the dots. Not any one piece of evidence but the sum of it all. Drugs in her system, found nude. Speaks volumes.

Hate to think this too but that is where my thoughts are going. I went back through the older threads earlier just to review the postings to see what the thinking was after Amber was found. A local had posted that 'rumor' was that Amber was probably not dead any longer than 36 hours prior to being found. A rumor but still local rumors often times have a shred of truth to them even though they may not be completely factual.

Ugh....rip Amber....let justice be served.

Here is one media report from today. (I have two more that I'm also going to link.)

CTV News | VIDEO at link | Fingerprint expert testifies at Amber Kirwan trial

Fingerprints found on a vehicle seized by police match those of Christopher Alexander Falconer, a fingerprint expert testified in Nova Scotia Supreme Court in Pictou on Tuesday.

http://atlantic.ctvnews.ca/fingerprint-expert-testifies-at-amber-kirwan-trial-1.1638941

Short transcript from the video at link. The defense attorney's point is weak below, though; because I believe they said they found gloves of some sort in the vehicle known to be driven by Falconer.

At about 1:14 minutes in of video:

Crown Attorney: Also, in the contents of that bag is a pill bottle--and we will hear from the toxicologist today and tomorrow. And there is a tank top--and we are going to be leading DNA evidence on Thursday that is going to take the accused and make the connection between the accused and Amber.

Defense Lawyer: That is something you would expect to see, I would say. If a person who is accused of an offense was in a particular area, you might expect to see their fingerprints there, where something significant happened.

It really is astounding when you read all the detail of what goes into a thorough investigation. Kudos to LE on this case.

This is a long write up with smallish print, but an excellent read. Ms. Harvie's details are more complete than the tweets.

This was one notable part:

Quote: Crown Bill Gorman said the evidence from Mader was extremely important because, “the bag with the fingerprints on it, is also the same bag that also had the black tank top…”

When (the court) hears the DNA expert give his evidence, the link with Kirwan and Falconer will become clear, according to Gorman.

“It’s all going to come out in the next couple of days… our theory is that he probably used gloves, there are no prints of his in the trailer but there is evidence connecting the two in his vehicle…” explained Crown Patrick Young who also noted that they can prove Falconer was at the camper trailer the next day.

I appreciated her clarification on this point:

Quote: The mattress was examined carefully and not seized.

Interesting here, because of the date of the purchase of the scissors--about 6 days after Amber went missing:

Quote: Oct. 15 Shoppers Drug mart Tweezer Man Scissors,

This is the most concise reporting of Amber's level of codeine and morphine that I have seen--and explanation of it:

Quote: Kirwan had a level of 3,610 nanograms per ml of codeine in her system and 103 nano grams of morphine.

“Codeien is an opioid, opiate related analgesic, meaning it relieves pain,” explained Campbell. “Thirty to 300 nano grams of codeine is a normal range found in the human body.”

The Pictou Advocate | Forensic evidence presented at murder trialPosted on January 14, 2014 Debbi Harvie

The sixth day of testimony in the murder trial of Christopher Alexander Falconer centred on forensic evidence and fingerprints.

Falconer is charged with the first degree murder of Amber Kirwan in 2011. His trial has been unfolding in Supreme Court in Pictou, now into its second week.

I do feel confident the Crown will prove their case. IMO. The rest will fall upon the Jury.

Well, I haven't been too successful in guessing his motive.

We have this from the Crown:

Quote: In terms of motive, Gorman noted that, “what goes on in the mind of Christopher Falconer, ultimately, we don’t know.”

I guess I could make that work, though.

At this point or any IMO it would be untoward for the Crown to suggest motive. I believe it was a sexual based motive. Maybe there are no forensics to prove it by the time Amber was found. Perhaps he used a condom. When a female is murdered, bound and found nude it speaks. Loudly.

I'm happy this case is not being tried in Pinellas County :floorlaugh:

They have admitted they don't have motive, though.

Just sayin. :banghead:

Depending on how the defense spins this; and how the jury looks at evidence, of course, things could get interesting.

He had a former girlfriend--in fact, I'm starting to think he was quite the ladies man.

In the article linked below, one of his female friends paints quite a glowing picture of him.

Quote: “He’s like a teddy bear,” she said. “Always kissing and hugging.”

Robson met Falconer and began dating him when he was out on parole.

“I wouldn’t have expected this,” she said.

http://thechronicleherald.ca/novascotia/96984-rcmp-charge-falconer-in-death-of-amber-kirwan

The first person he murdered was a male, and he strangled that person. I don't think the jury can consider it; but I also don't believe that Falconer has any record of being a violent sex offender.

Violent, absolutely; but, sex, no.

The Crown has dropped the abduction charge; they have admitted they cannot connect him to the burial site.

While I do believe we are going to see him connected to having contact with Amber at the camper; I'm afraid that is a long way from proving first degree murder; and it leaves so many questions unanswered.

What I want to see come out of this trial is Justice for Amber!

Partial justice, and having Falconer off the streets, are good things, too.

I'll settle, I guess.

I hear ya. Praying too the jurors will convict and Justice served.

Interesting that he is still talking to investigators; although I suppose it could even be about another case.

Lori Campbell says she is not sure where syringes came from.

I guess this clarifies the above a bit.

When crown questioned Campbell about syringes, they were referring to the Hardwood Hill exhibit. That's the trailer search.
