I have read the last Will, DOKUMENT 2:Yes the Will is a public document - that is why I was able to obtain a copy. Any additional docs regarding probate procedure will be available to the public as well.
One thing to keep in mind if looking - was probate complete? If not, would that make the docs filed somewhere different to a probated Will where probate was complete/finished?
Definitions and Interpretation
2.1 a) 'discretion' means sole and absolute discretion
d) 'trust for young beneficiaries' means gifts given in the
Will ..................
3.2 If LV dies, or refuses or is unable to act or to continue to act,
.............., then I appoint RWV .................................
4.3 I may leave a memorandum regarding the disposition of certain
personal items. I recognize it is not binding on my Trustee at
law, but it is my wish that my Trustee follow my memorandum
and be guided by it as if it forms a part of my Will.
4.6 I direct my Trustee to hold a gift of residue to any child of
mine under the age of 18 years and keep the gift .........
4.7 I direct my Trustee to hold a gift of residue for any
beneficiary other than a child of mine and keep the gift
invested ........................... when the beneficiary reaches the
age of majority.
MOO follows:
If there is a memorandum LV has to be discret. I think there is one but we never would hear of.
The Will holds a memorandum if it excists and the Trustee has to follow.
What I don't understand: A woman has to know if there are own children and in which age. Why this point with beneficent to own children and at what time in the future and so on?
Somebody of you knows?
