It's interesting, but I don't think it's very complicated.
* Sometime around 2012 Barry Sherman (then age 70) stepped back from his demanding role as CEO of Apotex, took on the role of Executive Chairman. This role doesn't manage or make regular decisions, but has power to hire the CEO and recommend major new directions for the company..
* To take his place as CEO running Apotex, he hired Jeremy Desai.

* Jeremy Desai and Apotex is now accused of accepting and using confidential information from the biggest rival company, that was given to Desai by his girlfriend who worked for the rival.
I'm not sure how much the corporate world worries about this kind of corporate espionage. The woman's lost her job, obviously. Is it considered a scandal that Apotex (small fry, as the article you linked noted) used the info to make some money? I'm not sure. We're not talking about state secrets here.
Maybe at worst Desai might resign and a different CEO be hired (very doubtful). But I can't see how it would implicate Barry Sherman:
he hired Desai, but wasn't directly involved in anything shady himself.
