Oct. 18, 2023

A Mountie with British Columbia’s integrated homicide team testified she was the officer who served a warrant to obtain DNA from the man accused of killing a young teen girl in a Metro Vancouver park six years ago.
70c8fc80

Sgt-Maj. Heather Lew told a B.C. Supreme Court murder trial that she collected a few drops of blood from Ibrahim Ali’s finger on Sept. 9, 2018, two days after his arrest and almost 14 months after the girl’s body was found.
[.....]
Lew also told the court under direct examination Wednesday that she was a corporal on the Integrated Homicide Investigation Team when the girl was found dead and she attended the crime scene in the park the day the body was found.

Despite an extensive search, police investigators never found any videos of Ibrahim Ali, or the 13-year-old girl he is accused of killing, entering the Burnaby park where her body was found six years ago, according to testimony at Ali's murder trial this week.

Nor I.

From the court schedule, it looks like it was a short day yesterday, only beginning at 2pm. How inconvenient for the jurors. But maybe because the trial was extended beyond what was scheduled, they have to work around when courtrooms are free.

Interesting decision...

Nov. 7, 2023
The judge in the first-degree murder trial of Ibrahim Ali, who is accused of killing a Burnaby, B.C., teenager six years ago, has told the jury to completely disregard the testimony of a witness who died before the end of her cross-examination.
[.....]
Justice Lance Bernard has instructed the jury to disregard Pickett's testimony and to resist all speculation or research into her death.

He says Pickett's unexpected death significantly curtailed cross-examination by defence lawyers and his instructions to the jury recognize the importance of cross-examination as a cornerstone of the adversarial justice system.
[.....]
Bernard told the jury that Pickett's death and its circumstances are not relevant to their deliberations and the trial will continue in B.C. Supreme Court as though she had never testified.

Wish they would tell us how much longer this trial is going to go...

Cornelia Naylor about 16 hours ago rbbm.
''The evidence of a sexual assault expert who died before finishing her testimony at a Burnaby murder trial has been thrown out because the defence wasn't able to fully challenge her "reliability, credibility and impartiality" under cross-examination.

Dr. Tracy Pickett, a former director of the BC Women's Hospital sexual assault service, testified at the trial of Ibrahim Ali in September before going missing from her Vancouver home on Sept. 26.

On Sept. 28, Vancouver police announced her body had been found in the Southlands neighbourhood and no foul play was suspected.''
''The trial, which was expected to last three months, is now in its eighth month.
The Crown has called 40 witnesses, including Pickett, and intends to call two more.''

Ah! Two more witnesses - finally!! Defense probably doesn't have too many hopefully! Thanks for that info!

This makes me sad, both for the family of the victim and for the Dr. herself. I'm not sure if her death was connected at all to her having to testify and being cross-examined, but it really feels like a shame to toss out all of her testimony. I understand the judge's point about cross-examination but couldn't the jury at least consider the part of her testimony that she had been cross-examined on already? So that the hours she spent on the stand wouldn't be for nothing?

*sigh* Hopefully it won't impact the verdict.

Boy -another article in my alerts! And I see they have the # of the trial date! Now I can update my notes on that! :)

Nov. 9, 2023
A first-degree murder trial that began in April is coming close to its conclusion after a series of delays and significant developments that have altered the Crown's case.
[.....]
On Wednesday, the 91st day of the trial, Sgt. Michael Lim of the RCMP meticulously walked the jury through the collection, retention and testing of all the various exhibits, including DNA samples.

Working with the Integrated Homicide Investigation Team, Lim served as the crime scene manager on the case.

He told the jury how DNA from a discarded cigarette butt was used to build the case against Ali and allowed investigators to obtain a warrant for a sample of the suspect’s blood.
[.....]
The Crown is expected to wrap its case early next week, and then lawyers for Ali can call their own witnesses or choose to move the trial directly to closing arguments before leaving their client’s fate in the hands of the jury.
