Unbelievable!

Jessica had agreed to joint custody and was scheduled to appear in court the following morning to go forward with joint custody, and for that reason Kevin murdered Jessica; the mother of his two year old son. Did he actually think that murdering her would guarantee that he had full custody of their two year old son? Clearly if he couldn't gain full custody legally, he doesn't deserve custody. Is he an only child who has to have it his way or no way?

Do we know where the children have been living since their mother was murdered?

That's right. He was detained on Friday for questioning. He was arrested some time after he was questioned, and he will be arraigned on Monday.
Police could detain him for 48 hours and then either release or arrest him.

He'll stand trial after a preliminary hearing.

Canadian Law regarding sentencing for 2nd and 1st degree murder have changed in the last few years. The maximum sentence for 2nd degree used to be 10 years. Has that changed?

He was arrested. Plain and simple. On Friday.

So Kevin was the primary caregiver for their two year old son, and Jessica agreed to joint custody. Was she thinking joint custody where day-to-day care of their child was with her? If they had a conversation about that on the night that he picked her up from work, and she was murdered, then I can imagine that they argued. Divorce and custody are the most dangerous times for a woman in terms of spousal homicide. If Jessica and Kevin disagreed about where their son would live, and Kevin feared that Jessica would have leverage because of her two other children, well, it's not uncommon for spouses in a custody/divorce scenario to kill each other because they can't have their way. That's 2nd degree murder.

Rubletz was apparently detained, but one of the reporters thought he was arrested. This is today's news about detained for questioning, and arrest ...

"After a “complex investigation” involving numerous interviews with family, friends and individuals who knew Jessica, along with forensic evidence obtained from a vehicle that Rubletz drove on a regular basis, police arrested Rubletz from a southwest home without incident and charged him with second-degree murder."

The newspaper quote is not confusing, is it?

The bottom line is that Jessica Rae Newman was going to request Joint Custody the morning that she was murdered, even though the son that she had with Kevin had been living with him for some times. Was she going to use the fact that she had two older sons to try to force that she was the primary, and day-to-day, caregiver for the two year old child?

Did I miss the trial? Do you have knowledge of evidence not provided in MSM that leads you to believe that he is guilty?

Exactly. JRN has not had custody of any of her children for some time. According to family, one of the children was removed from her care right after birth due to alcohol issues.

KR needed Jessica to step up, he had job oppotunities, KR was the one pushing for Jessica to have 50/50, but the courts needed to decide that, there were certain things that Jessica needed to do to be given 50/50 by a court,

Could Jessica have told KR that she really didn't want 50/50 that she was happy the way things were, or maybe she didn't do what the courts had asked in order to have more access to her child.

The man is in custody for questioning. At this time, he has not been charged. He does not have the right to have counsel present during questioning.

Why do you say that he does not have the right to have counsel present during questioning? Is that not everyone's right in Canada?

No. The right to counsel during questioning is US law. I don't know of any other country that has that law. The law was considered in 2010, but was rejected.

In Canada, "... the court said on Friday that while suspects have a right to consult a lawyer and to be informed of that right, they don't have a right to legal counsel while they are being interrogated."

Not at all, considering I'm the one who posted it. I think you may be confused about "your" bottom line. No one knows what Jessica was "going to do" because it did not occur. All we know is that there was a court hearing that was to take place the following morning to determine whether Jessica's visitation with her son would be shifted to partial custody. Arguing that she was the primary caregiver would have been very difficult as she did not reside with any of her children. We also know, according to her family, that she did not have custody of any of her boys at the time and had not had custody for quite some time. So, using her older boys as leverage in court would have worked against her.

Hopefully KCR would have at least been given the opportunity to consult with a lawyer prior to police questioning, to be advised on whether he should answer any of their questions.
