Casey Anthony attorney: Judge Perry has 'clear bias'

CM seems to have a fairly large ego, and since this may well be the last big case of his career, he appears to be bound & determined to make his mark. I wonder just how bold and daring he will be in his efforts to 'win.'

Delaying the case may actually work against the DT, in that the public has already been outraged by the circumstances surrounding this case for nearly three years, and it only becomes more controversial as time goes by. IDK.
 
I believe Cheney Mason is looking for a way out of this case because he realizes that as long as Baez is there, he stands the chance of being terribly embarrassed everyday for 2 months.:floorlaugh::floorlaugh:

This is just his stepping stone to begin his quest to leave the team like Lyons did. Next thing will be a press conference saying he is leaving because he feels that ICA will not get a fair trial with this judge!:great::great:

He didn't like JS either. So maybe he is just a poor judge of character. No pun intended. CM leaving if he felt she could not get a fair trial would be like a captain saying "me, first" while getting off a sinking ship.
 
If they filed a motion to disqualify on 04/01/11 at 4:59 pm, IMO HHJP would deny it on 04/04/11 (Monday). I bet the Florida appellate courts could expedite a special action from that decision PDQ and get it done before the week on 04/18/11 when the remaining motions are to be addressed. :)

And OMG, I almost want them to try something just because they'd have to file it on April Fool's Day! The irony is RICH there! LOL
 
Could the possible motive for CM filing that motion yesterday be that he was trying to bully HHBP into a favorable ruling on the Frye hearing so as to not appear biased? The timing just seems so suspect, and CM comes off as a very big bully to me.

Bingo! It sure seems to have everything to do with bullying and underhanded tactics which Mason seems to be very experienced at ... Since he came on board, that's been his contribution ... he knew from the start that this was a case no one could win but he signed up anyway for the "fun" of it ...
Now we've all seen what Mason thinks is "fun" ... and it's despicable !! Walking out of court, hand in hand with his client who viciously murdered her two year old, Caylee, then threw her away !! Ruining however many lives and careers in the process is just a part of the "fun" !! Disgusting ... :maddening:

"The judge presiding over Casey Anthony's first-degree murder case on Friday denied an attempt by the defense to get a rehearing on a series of motions aimed at tossing key evidence from the trial.

In denying the motion, Orange-Osceola Chief Judge Belvin Perry did not address the defense's claims that he was biased and made errors in his earlier rulings.

He simply denied the order for a rehearing, adding that, "No other motions for rehearing shall be considered."

Perry's ruling came one day after attorney Cheney Mason filed a motion requesting a rehearing on the defense's earlier attempts to exclude certain evidence from the trial, including statements Anthony made to law enforcement."

I love the fact that he gave no explanation or detail. I'm sure it was very hard for him to contain himself. He is a riot!

His cardinal trait seems to be belligerence. He stood in front of the judge spewing nonsense and false information - was corrected, thoroughly, by LDB - then gets up and repeats the same nonsense. It was unbelievable. Then the threats about the "appeals court right across the street", etc. I don't understand why this is acceptable. He is clearly out of his place and out of his time.

I guess the "factual inaccuracies" he spouted from the podium are not the same as the ones he accuses the judge of in his motion? Mason's a big ole blowhard and not impressing anyone with his good ole boy routine and legal expertise ...
 
I am fully confident that HHBP has already made all the mental calculations as it pertains to the high jinks of KC's Defense Team. He's observed them long enough to know how they think, what maneuvers they'll make and how they'll strike. He's several steps ahead of them at all times. He most certainly knows what will come flying out of their collective 🤬🤬* in the guise of a lame-brained motion and cloaked as a threat.

I surmise that HHBP's brain functions at a higher plane when it comes to the law in Florida. So the Defense can roar and snarl and growl all they want but they are not going to rattle this judge. For crying out loud, he's been on the Bench for 22 years. He's seen every trick in the book. Hell he probably pulled a few of them himself in his day.

Bottom line, His Honor laid it out from day one. This trial will be played like a card game. Each side is entitled to see what the other is holding. Now play your best hand. The problem as I see it is that the State is playing a wicked hand of Five Card Stud No Wild Cards and the Defense wants to change the deck and play UNO.

Absolutely no one thought that Judge Perry would change his ruling. After 40 years of Florida lawyering, Mr Mason knew this too.

What if this whole circus....Mr Mason's claims of being old and confused, Mr Baez's courtroom antics, Mr Mason's motion accusing Judge Perry of bias...what if it was all a smoke screen? What if this was all slight of hand to draw attention away from the quiet, last minute insertion of these Dr and their 'state of mind' opinions into the guilt phase of the trial? Mr Baez's big Ah Ha moment is revealed while everyone was focused elsewhere.
 
I wonder the same thing about the timing. The air samples are going to be a controversial decision either way it goes. There is a good case to be made for each side. So if Judge Perry knows that he is up for recusal, is he going to feel
defensive and lean towards throwing out the air samples?

I haven't ever seen HHJP say or do anything in this entire trial to try to make anything one eensie bit easier for himself. I don't think he'll start now, threats or not. He has exercised patience, guidance and tolerance in trying to guide JB and I won't be surprised if it continues. HHJP has morals that JB and team can't even comprehend . . . That's why he's the judge [and they're not].

Accusations of clear bias and veiled threats of recusal won't influence his decision; he has already proven himself to be above that level of intimidation. Obviously, :cow:.

I so wish that the SA would play that clip at a hearing! I'm sure that HHJP is aware of its existance because he does his homework, and the A's have probably seen it as well. But, I doubt that Lil KC A has seen it. I wonder if she would be leaning over so close to CM to whisper and giggle if she new about this little diddy? Lol!

I don't think they are trying to rattle HHJP, beyond maybe pissing him off a little and trying to get him to show that in public. What Mason is attempting to do is lay a big stinking appelate egg out there and be so loud and obnoxious about it that he is hopping people pay attention. "See EVERYONE MY CLIENT COULD NOT GET A FAIR TRIAL AND WAS WRONGFULLY SENTANCED TO DEATH! HOLLYWOOD NITWITS WE'RE HERE! PLEASE COME CAMPAIGN FOR US! AND THE INJUSTICE"

Now my question is how the higher courts will react to such blatant attenpts to put not just the opposing council, but the court itself in an adversarial position? I can't see that they would want to do anything at all that would validate that sort of strategy? In fact one might think that if anything they would seek to smack it down hard. It's a level of creeping disrespect for the courts and the justice system that has been building for many many years. If you can't challenge the evidence than defame the witnesses. If you can't pull that off then accuse LE of misconduct. If that isn't a winner than bring accusations against the opposing council. Now finally CM has escalated it to a new level of challenging the bench itself. (and not just individual judges. This is his second shot at this. He is now attacking the trial court itself. Rather appalling). It will be amazing if any court is willing to go along with this?

I think this is going to somehow come down to an accidental pool drowning...although I'm not sure how they'll pull that off after all this time. But, under a story about a 3-year old who died in a pool drowning near Orlando this week is a comment that was an eye opener:

Thank you. I understand now. So, we can probably expect them to wait as long as possible to file a motion for recusal and hope that it's enough to delay the trial. Seems to me that they don't think they have much hope of winning based on SODDI and probably don't stand much chance of mistrial with HHJP on the bench so they are desperately seeking number 2 above... delay, delay, delay.

It's not gonna happen. HHJP said this trial will start in May, and it shall.
