Well the defense team got what they wanted from their use of words in their little press spin...everyone to debate the death penalty.

Casey was going to ask to be declared indigent as sure as the sun comes up in the morning......regardless. The witness list for the prosecution would still include the same people, TES volunteers numbers would still be huge, depositions in the state of Florida would still cost whatever they do, the experts expenses would still be astronomical.....no way in the world would two hundred grand have lasted for the years this murder case will take. Yes, having to prepare for the penalty phase in a death penalty case will be expensive beyond belief...but the fact remains......
the money she had, if the figure of 200K is correct...would not have sufficed, period. So....unless there was some mystery donor to step forward....this was inevitable. I am certain. Don't be fooled by the defense throwing out a few buzz words...their argument is .....as usual ..in the words of Mrs. Drane-Burdick.."A farce!!"
The reason for this request of Miss Anthony's has no more to do with the death penalty than her trial has in common with the Salem Witch Trials. This is one of Andrea's specialties..buzz words for the media..trust me.
(just my opinion)
I think the DP has a lot to do with it because it is more costly. This issue has everything to do with cost as the taxpayers are going to foot the bill.

\the death penalty debate is as old as the hills and is not going to go away any time soon LOL.

With the A's being so broke and the defense being so broke, What does KC get to spend from the canteen on food and clothes and makeup, paper, pencils colored and plain etc. What happend to the secret donor (?) from the east coast? I am wondering if they have backed out. Does the jail update the canteen account? If there is money there can they take it for KC defense? Guess KC will get thinner by the day.

I bet this will cause a speedier trial and less $$$$ spent on frivolous motions, which cause the county money either way. I guess there is good and bad in this scenario.
If they investigate where money has come from so far and given to defense will all that be public record??? So many questions!!!!!!!!!!!!!

Dear Taxpayers in the State of Florida,
I am sorry to hear about your having to pay both the PROSECUTION and THE DEFENSE for a sociopath.
Best,

I, for one, would much rather see that money go to JB and AL for KC's defense (or non-defense, however you want to look at it) than lining CA and GA's pockets.

The problem is that it is not an either/or situation.... unfortunately, BOTH can happen.... it isn't the State who are going to line the A's pockets..... but it WILL be the State paying for KC's defense.

Just my guess here:
$250,000 paid by tv network
- 83,333 (less 1/3 finder's fee (Jose's or ???))
$166,667 remaining for KC
- 55,556 (less 1/3 for income taxes (just guessing on tax amount))
$111,111 remaining for JB and AL (wow, pretty close :))

Best accounting I have seen to date. But, if JB got the finder's fee - is this not what the state argued would be a conflict of interest? Could this have anything to do with the delayed discovery the judge granted?

Can't they stay on and get the pay the state allows? Update:

Yes, with stipulations

(5) INDIGENT FOR COSTS. --A person who is eligible to be represented by a public defender under s. 27.51 but who is represented by private counsel not appointed by the court for a reasonable fee as approved by the court, on a pro bono basis, or who is proceeding pro se, may move the court for a determination that he or she is indigent for costs and eligible for the provision of due process services, as prescribed by ss. 29.006 and 29.007, funded by the state.

2. In the case of a person represented by counsel, an affidavit attesting to the estimated amount of attorney's fees and the source of payment for these fees.

1. Whether the applicant applied for a determination of indigent status under subsection (1) and the outcome of such application.

2. The extent to which the person's income equals or exceeds the income criteria prescribed in subsection (2).

3. The additional factors prescribed in subsection (4).

4. Whether the applicant is proceeding pro se.

5. When the applicant retained private counsel.

6. The amount of any attorney's fees and who is paying the fees.

Good question. I think the conflict of interest was if Baez had a part in selling Casey's "story" since his legal service could have an influence on the outcome of that "story." Selling pictures and home movies of Caylee wasn't part of the conflict, as far as I know.

I realized as I was huffing and sighing over this latest news and doing a lot of :banghead::banghead::banghead:, that I remained a little hopeful about something.

It took me a little while to realize what it was. Remember back fairly early on when JS was having discussions with JB about how he was getting paid, and there were questions about how legal it was.

So off record they went while the judge looked over JB's paperwork, and agreed it was acceptable. Baez claimed to have consulted an ethics lawyer, BUT was consideration given to a later claim of indigent status a year or so later? We know Baez at the best of times has only one oar in the water. My hope is JS will demand a full accounting and somewhere somehow, JS will find Baez has made a major "accounting" screwup. Resulting in some kind of official reprimand - at the very least. And best case scenario - forced to work at much lower PD fees.

If that happens, we all know JB will take Casey to the exit gate as quickly as he can - just to get it over with.

May be way out in left field on this statement - but...I seriously doubt one cent of the $250k was paid in taxes. Taxing would have to do with who the payment was made to and the reason for the expenditure. I seriously doubt the entire fee would have been taxed as "taxable income". For instance, if it was paid directly to JB as pymt for use of licensed products (pictures) - it would be taxed differently (if at all) wouldn't it?

I truly believe they had the entire $250k to work with (and probably more). They paid out a whole lot of money to various experts(?), attorneys, etc. Heck - just Jose & Co's traveling road show expenses to be on all the networks and do their spinning acts had to be very expensive.

I'll hush now - this quickly turned into a rant. Sorry about that!

Wow. Kathi tells Ms. Sheaffer that Brad, mom and pop tried to hire a different lawyer for Casey, told him they had no money, she had no money but they could pay him with portions of any would be media deal. She names the lawyer. He would not agree to this, she continues, negotiations fell apart because they were never able to get close enough to Casey! ( meaning out of Baez's earshot.) Gosh she is good!!!

Baez again blames someone else for KC's actions...Now it's the states fault because they are seeking the DP! Would the costs of this trial go down substantially if the state didn't seek a DP conviction? Did he not know this a year ago? Can they not sell anymore vids or photos? Have the media finally said enough, due to the actions of the grandparents, too many lies spread to sell their side, the media may want to distance themselves from the blame game of hell...:furious:

Blame, blame, blame, deny, deny, deny for the defense is at a loss on HOW to defend her. The go from the nanny did it, the soddit, ugly copeing, mental defect (tho' only for a moment) implicate any and all as long as it makes KC look like mommy of the year...Yuck..:innocent: They haven't met one of their deadlines yet but want the state to be santioned because he had no money to pu the documents. KC"s defense team is in a shambles, she may be better off with a public defender, DP qualified can be sought!
Why does it seem that the defense always wants to play "Let's Make a Deal" without actually coming out and saying it? What I read into that statement is...how much are you (the State) willing to pay to pursue this case through trial and countless appeals? Let's not forget...they'll now be footing the entire bill. The defense's statements are always purposeful IMO...and meant to inflame. I betcha they want the folks of Florida to voice their disapproval...loud and clear. And I'm thinking they're wishing for the State to come with a deal that will end it all.

ETA: ...and now that I made my way downstream, I see that my esteemed colleagues/posters have already addressed this...such smarties!!

Thank you for this post because, yeah I am confused...
When I read the statement I thought, "how was Casey ever going to pay for any of this? she went to jail broke?"

The deception keeps me from seeing what the point, or purpose is in this spin? What is JB hoping to accomplish with this statement? Getting us talking about the DP, like: "oh, my well let us take that DP off right away so Casey can afford her defense?"

TIA

Well, their spin didn't work for me. I pay my taxes here in Florida and I want law and order here where I live because it represents safety for me and my family. Caylee deserves justice and KC deserves to have the DP hanging over her head. We all pay this sort of thing all the time. Every defendant who has a public defender also gets their defense costs paid. Now, I won't be a happy camper if they ask for attorney's fees for JB because he took that case without knowing how he'd be paid... don't want to pay for his stupidity or his cockiness. We already have a whole office full of Public Defenders taking a salary that we pay. So far I've only heard that they are asking for defense costs though so I'll hang off until I can read the motion before I get angry. The whole reason they filed it at 5pm on a Friday is so that the media wouldn't be able to get a copy before we all started discussing this... spin spin spin... I refuse to fall for it. :snooty:

Lyon hasn't visited Casey since before the court hearing where Casey was convicted for criminal check/fraud. I suppose they could be talking by phone though. Anyone know if public records exist of a log of phone numbers that Casey calls from the jail?
