He has already been paid. He has done nothing up to this point. $90,000 should take him through the whole trial. Had he done what he was getting paid for the depos would be done and we would be looking at a trial this year. With all the monies KC is reported to have received the taxpayers of Florida have a right to know where the money went. jmo

ITA....that is what I keep thinking..granted we now have a few dates to go over this info--I'm thinking most of it should have been done...(of course I think they were fishing for whatever they could find but not work on...)imo

ITA and apparently so does JBPJr...for the budget hearing will be held in open court, not in camera as Baez suggested.

I still wonder though, Baez is arrogant enough to ask for his fees to be paid. What he's done with the $90,000 should be asked and answered at this budget hearing. Maybe JBPJr. will get to the bottom of it. I still believe, Baez will not take money from his pocket to defend Inmate Anthony, I just don't see him doing this free and so far, he hasn't..KWIM??? and that means touching any part of whatever money he may have left in his bank account that came from that 90 thousand...JMHO

Justice for Caylee

$200,000 from ABC, $5,000 unnamed donor, $70,000 Todd M, $70,000 AL = $345,000.00. JB has not worked and will not be working in the future for free. Just because JB started out as a unknown attorney with low fees does not mean he should inflat his per hour charges because he was responsible for getting the money to defend her. His rate should stay the same as the date she hired him. He could ask but it would probably get a big laugh. jmo

I found these statutes and it sounds to me like Baez and the other attorneys may qualify to collect through the state. I know it's a lot to read but I just want to get all the facts in.

http://www.flsenate.gov/Statutes/in...e&Search_String=pro+bono&URL=CH0027/Sec52.HTM

http://www.flsenate.gov/Statutes/in...e&Search_String=pro bono&URL=Ch0027/Sec40.HTM

http://www.flsenate.gov/Statutes/in...Search_String=pro bono&URL=Ch0027/Sec5304.HTM

These statutes only apply where there's a right to court-appointed counsel (for example, in a case for termination of parental rights). I seriously doubt there's any right to court-appointed counsel in Florida for a defendant in a civil defamation action.

These statutes are for both criminal and civil cases:

2. In the case of a person represented by counsel, an affidavit attesting to the estimated amount of attorney's fees and the source of payment for these fees.

5) The compensation for representation in a criminal proceeding shall not exceed the following:

This is just a small portion of what is said. She qualified for indigence according to the motion.

The statutes are for both criminal and civil cases, but only for cases where there is a right to court-appointed counsel as provided by some other statute. The only civil proceeding where I know there is a right to court-appointed counsel in Florida is termination of parental rights (e.g., for child abuse, abandonment, etc.). There is no right to court-appointed counsel to defend yourself in a defamation case.

here are the motions filed yesterday:

Motion to Seal All Justice Administration Commission Documents
http://www.docstoc.com/docs/37483721/20100504-Motion-to-Seal-All-JAC-Documents

Amended MOTION FOR JUSTICE ADMINISTRATION Commission
HEARING AND MOTION FOR APPROVAL OF OUT OF STATE MITIGATION
SPECIALIST AND EXPERT WITNESSES

http://www.docstoc.com/docs/3748456...te-Mitigation-Specialist-and-Expert-Witnesses

And here is the JAC Post-hearing Memo - A must read, IMO. They want a LIEN filed on Casey at case end, and if Baez comes up with any money between now and the end of the case, he HAS to notify the JAC

Thank you so much Muzikman!
That motion for out of state mitigation specialist is extremely interesting. Perhaps worthy of a thread itself.

Yeah it does.

And FAMILY MEMBERS must slowly build a relationship with the MS.

Wonder how that's going? :banghead:

Thanks Muzikman!

The JAC really wowed me....sounded very stern! I am so happy they are questioning how and here the money was spent instead of just rubber stamping it. Love the lien part too!

Surprised me though that it was dated in March and we are just now seeing it.

No Prob.

I've been busy and did not get the JAC memo until a couple weeks ago, and apparently the media never got it or put it up.

I seem to have been the first to get the 5/4 motions too. :)

I know that JB signed this but it doesn't look like he wrote it to me if you know what I mean.

Figures they'd want to fight for their out of state people. And of course they want the documents sealed. Can't have the public they've been trying to taint see how dirty and underhanded they really are.

And OOOOOOOH, that memo, I LOVE THAT MEMO!!!! It's very thorough, and just wow on the rules. I am smiling already. Also, I hope that part about the lien comes to pass. Oh how THAT would p*** off Baez and Casey. Can't make anymore blood money off of Caylee! And we all know the A's are not going to share their money with either of them.

I am going to be rooting for that to pass tomorrow! I cannot WAIT for this hearing!

LOL I was just thinking that also! The second particularly - talking about the mitigation specialist - that language has A. Lyon(s) written all over it.

I'd love to hear opinions on whether or not posters think JAC will give approval.
I sort of understand asking for the mitigation specialist - but for the Investigator, hand in your notes and move on would be my answer. (that would make my vote a "no" on him)

Was that written by JAC before Casey was approved by Judge S or after? Baez briefly gave Judge S a rundown of where all that money went which was to himself and Lyon. JAC wasn't even in the courtroom to hear anything.

I thought the JAC hearing coming up is just for Baez to tell them or show them how much money will be spent on different things. I was really shocked that Judge S let all of that money slide so easily. I really wish JAC would make Baez account for each penny of Caylee's blood money.

BBM

It looks like the JAC Memo was filed around 10:30 on 3/19/2010 (and emailed to Judge Strickland beforehand, not sure how long tho).

Judge Strickland made his decision later that same day, in the afternoon. It does not appear that he really "investigated", but rather relied on Baez's word (and whatever documents he had).

So, he relied on the word of an attorney that was chastised by the State Supreme Court for NOT being forthcoming about financial matters in the past, and was not even allowed to practice law for a number of years because of it.

Not saying people can't reform their ways, but if they have been "shady" in the past, they need to be investigated a little more closely, IMO.

Agreed. I have a pretty good idea of how the defense is going to handle this case. And why Casey has been publicly ignoring her parents. Her only acknowledgement allegedly is through JB. Through his cell phone texts and letters passed between them. But to the outside it looks as though Casey is showing them the cold shoulder but giving them what they want to hear outside the public eye. There's a reason for that.

Yep, no frivolous running around for those investigators anymore and finding whatever sticks to the bottom of their shoes to throw at people who don't deserve it. Only pertinent investigation to the case since dang they don't get paid for much time according this memo. Wow. Here's hoping they've been paid before now!

Would Andrea Lyon be considered a mitigation specialist? If so, I think if Andrea has to be let go because she's out of state, she's not going to all that upset about it in private, at least. I'm thinking she's hoping that she can get the heck away from this case if possible.

As a FL Taxpayer, if he's asking and getting public money, then he has to show where it's all going. If he didn't want that, he shouldn't have wasted money on flying 1st Class to NYC, going on boat trips with Geraldo, steak dinners at fancy restaurants and on and on and on.

The "endless speculation" will go on regardless of whether these docs are public or not. IMO, it will not affect her "right to a fair trial." What WILL affect her right to a fair trial is the Defense Team going on talk shows and discussing their case. :furious:

20.) These experts have worked numerous hours not only inspecting evidence, reviewing discovery (which totals 14,620 pages to date), additionally, the undersigned counsel has exhausted numerous resources traveling to 6 different States to meet with and consult with these experts.

My translation: Baez (he signed the motion) has spent up all of the money traveling about the country and chatting with experts, and now he feels the State should pay for these same "experts" to continue to chat with him (and they all want to also be paid for it now), and all associated expenses for that to happen. And, should Baez decide that they should actually write reports or testify, Florida needs to pay for all those travel/lodging/fees expenses also.

I Know this seems obvious....But if you are asking the public for money, shouldn't they get to know and hear where its going?????
This can't be logical.
