Based on the bolded statement, it'd be cool if HHJBP was offering up the probation to the Defense as an option and, if it is denied on Appeal he then calls FCA back to jail to serve out her time. He is secretly holding the plan B option card.

Do the Probation or do the time. We can all dream can't we?

I hope so! He already said the DT can't have it both ways. Either she has served her probation and still owes jail time, or it was a jail sentence and she has yet to serve probation.

I hope JP will follow through. It would be the right thing to do.

I'm in!!! That would definitely be a W in the Caylee column...no matter how small, I'll take whatever triumphs fall her way! :woohoo:
Just praying the JB baffle 'em w/BS doesn't outweigh common sense and facts of exactly what transpired with time served calculations & probation!

The petitioner and her lawyers were well aware that her probationary placement was not to begin until her release from confinement. The petitioner may not , under these circumstances, take advantage of the administrative error of the Department of Corrections.

“The Constitution does not require that sentencing should be a game in which a wrong move by the Judge [or the Department] means immunity for the prisoner”.
