It may be, but I don't see ANYONE protecting this poor child's rights.

I've thought about this too. Another thing I can't seem to get past is the lack of an Amber Alert in this case. I know this has been somewhat discussed but I can't understand why this hasn't happened. Anyone with any idea?

a) She is missing at the hands of her Mother, there is no known Father, argue the fact she is found?? The state automatically has "custody" and could protect her and act in her best interests.
b)protect her rights to any trusts, earnings for story, etc..
c) I respectfully disagree there is no custody issue until she is found alive, her Mom is in jail on neglect felony and her GP's would not stand up to a CYS interview right now based on this bs. If she were found, she would go back to them, which I do not believe would be in her best interests.
d) Force the paternity issue potentially.

Im speaking from a legal perspective above, from a personal one-
The only reason I could think of is to keep this whackjob family from profiting or taking donations or setting up trusts and using them for you know who.. Sorrowfully, I do not think this will be at issue

I think its totally premature. If the baby is found ALIVE then the state can file an emergency order to put the girl in foster care and then petition for a guardian. Honestly, to me this would be at this point in the case a huge waste of the taxpayer's money to establish legal guardianship over a child that is missing when there are no interim issues relating to evidence or money that legal guardianship would be a benefit for.

This morning Wendy Murphy was on Fox with Meghan Kelly and she brought up the fact that she felt that if they arrested "some of the family" for obstruction of justice Casey might come across with some info, she said that in her opinion there is enough evidence to do that. Of course, at the end of the conversation, she mentioned that if Casey did murder or sell her own child she might not have compassion on her own mother either.
Any thoughts??

As far as property papers and mortgages and whatnot, isn't this something that varies from state to state? My husband's name is not on any of our house stuff. We didn't live together until we got married, and I bought the house on my own about four months before we got hitched.

The only time the video was discussed or there was mention of going to the nursing home was at the initial bond hearing. Cindy says it was the police that told her the video was done on June 15th based on the card or whatever.

The police testified they couldn't get Cindy to give them information on what nursing home her father was in so they can check the guest book.

I also found it disturbing that someone suggested that Casey slept with her attorney. What is this based on? Nothing that I have seen.

I agree with that!!! He is a defense attorney. As snarky and smirky as he is, and some may not like his attitude, he is doing his job. (Keeping my opinion to myself. lol)..

I wouldn't think he would risk his career with being connected with Casey prior to this case. He would have nothing to gain from it and everything to lose if that were the case and it was found out.

But can the court assign someone to protect the rights of someone who is MISSING or dead?????

Casey is saying SHE KNOWS where her child is, she is already charged with neglect, barring any evidence of her presumed death or other, it would be a simple ex parte emergency order

Hubby and I printed it out and studied it. We think that it's either someone on the Cindy and George team..trying to take us in a different direction

OR

Someone who has a reason to WANT someone in this to get what's coming to them.
I'm glad that you mentioned that. It could very well be.

Probably because they have no real description of who has Caylee- i.e. what person looks like, car last seen in, etc.

You bought your house before you were married and you had the option at that time to add your fiance to your deed, should you chose to. I am not sure what the legal term is for that, but there is one.

I was not married and bought a house with my BF. We decided to be on the deed together. I owned half, he owned half. When he got into financial trouble and filed bankrupcy, I thought I would have a problem because of the house.

BUT, when we sold the house, right after he filed, I got my percentage of the profits and his went to the bankruptcy attorney.

That happens a lot I bet. When I recently married my husband we moved into his house. The loan was in his name but he added me to the deed. We then ending up moving into another home a couple of months ago.

I don't find that odd at all. Though it's all interesting. I sometimes think, God forbid, that all of our "private" details would be scrutinized closely like that if we were in the same boat.

Well I think its kind of obvious that this family is not "financially" stable. Plus Patty - if someone is ON a mortgage doc and NOT on the deed - if that mortgage goes into default what happens then? Person on mortgage is not on deed.

Plus looking at our timeline - 7/07 george (only) has a judgment for $12K entered against him. This now creates tension in the home. With our economy the way it is - even just last year at this time it was already getting bad. And now we still have Casey - and child - to support. Casey won't work - just sponge. Has to have been a bone of contention.

I find it funny that the Citibank judgment was only in George's name - usually married couples - married for a long time - have their cc's in both names. If there is a cc in only one name is usually for work purposes - to be reimbursed by work company and not show receipts of wife/hubby that are personal. Plus with george not being on the deed this cc judgment can't be used to put a lien on the property.

Now - in the past few months - Casey has run yet ANOTHER cc up to its limit and
thrown more financial stress into this household.

No wonder they coudln't afford an attorney or the bail

Wet blanket here.. I think determining paternity or assumed paternity by juxtaposing photos in comparison of an almost 3 year old is crossing the line of speculation. In that theory I am apparetntly the kidnapper of my own two children who look like their Dad..

As much as I despise defense attorneys, they do have a job they are required to do. If they don't, they could be sued for malpractice.

Yup, it would be. The police said on stand that they called Lee to explain to him the importance of getting this information from his mother. Don't know what happened after that as no one has discussed June 15th and verified the visit, sign-in in, did Casey go with Cindy and Caylee, what car did they use, how long did they stay etc., etc.

I totally agree. Judgment is such an interesting thing, when we judge someone for judging we are still judging. LOL
