Judge to decide what questions will be allowed of witness re: Christina's cooperation and what witness investigated re: Christina.

I'm not believing this testimony is being allowed. Christina is NOT there to rebutt/testify.

Since she's not the one on trial, they don't have to worry about that. Besides, even though CL can stop her from testifying about any marital communications, she still could have taken the stand and testitfied about other things she saw, or events surrounding the timeframe in question.

Witness continuing under cross-exam talking about investigation into Maria's death. Being questioned re: Christmas party on 12/14/07. Large party with spouses and children invited; interviewed everyone who may have known if Cesar or Maria had been to the party. Question about how many people saw Maria there objected to and sustained. Investigation continues; no charges filed against Christina.

Defense re-direct re: Christina being represented by attorneys. Asking about Article 32 and a signed charge sheet re: sexual assault. No signed sheet.

Witness excused.

Next witness. Detective Cavanah, lead investigator OCSO (originally a state witness). Being asked about number of detectives involved in initial investigation: 46 LE officers involved, all agencies. Obtained several s/w throughout investigation....

Anyone else's connection bad? is it WRAL.com or just me?
Also why bring Christina up so many times when she was never charged?? They are throwing her under the bus and bashing maria.....I think Christina needs to go ahead and be charged they are makeing it obvious she had something to do with it.

Because the defense is allowed to present alternate theories of the crime that explain the evidence the state presents, and the burden of proof lies on the the prosecution.

Grrr... so was Maria at the Christmas party or not? If they only found the one person who says they saw her, then I have my doubts, but if there was more than one... Well that changes the entire timeline. I've always believed he did it because it looked like she confronted him at his house, while he home alone. If that not the case then... man, I just don't know anymore.

Ya I understand all that, anything to get their client off, So why didnt the defence subpeona (spelling) Christina to testify for Cesar, she could do that right???

She could, but it's better for the defense if she doesn't. By leaving all these questions hanging in the air, they're creating reasonable doubt in the jury's mind. If Christina is indeed innocent, then her testimony would only benefit the prosecution, and if she isn't, her lawyers did a very smart thing indeed by advising her to envoke her spousal privlege.

What I'm confused about is the objection that was sustained and the witness didn't get to answer the question. Does that mean there is only Ortega who saw Maria there or what? If Ortega is correct and Maria was there, was she "at the party" or looking for Cesar, then not seeing him, went to his house? I just can't see why she would attend the party after leaving the note for Durham that she was through with the Marines. MOO

It's lunchtime now and they usually come back at 2:00pm. As for what the defense did after the live feed cut out I have no clue!

I agree that it would be very strange for Maria to go to the party. Add that to fact that even if she was there at 6:30pm and left immediately after for the Laurean house, at best she could have gotten there by 6:50-6:55... Supposedly Christina was home from the same party by 7pm

I've read and heard that Christina was supposedly home by 7pm as well. This is just another one of those - yeah WE know this but does the JURY know this - questions I'm having. Has anyone heard that testified to by any of the witnesses? I think in large part, not being sure how much the jury knows about Christina is what is driving me mad right now AARRRGGHH
