Actually, that is no longer true, as seen in the Rex Heuermann trial for the Gilgo Beach murders. The judge will rule in early September whether nuclear DNA evidence taken from hair found with the remains can be used. This is a new technique and only one lab in the country is apparently providing this type service. So far, it is completely new in the US's court systems, if I recall the testimony correctly from the New York case.

Is this meant to imply that cut hair contains nuclear DNA?
To my knowledge it is the hair follicle at the scalp that contains nuclear DNA but not the shaft.

Are you saying they have figured out how to produce a full DNA profile using DNA collected from he shaft? I’ll have to figure out how that could be done, I can’t see that it could.
The hair shaft does not contain cell nuclei, but it does contain mitochondria.
So it makes sense that hair shafts could contain mitochondrial DNA but not nuclear DNA.
Mitochondrial DNA comes from our mother, so it shouldn’t be useless.

Laws deciding what can be used would be limited by what can biologically be present.
But if a sample of hair is taken at a crime scene- it could be with or without follicles.
That seems like a defense attorney’s goldmine, if the DNA is not contained in a cell attached to a hair. Who is to say it didn’t come from some other source?

I get the biology but the details of the tech here are beyond me

What about insanity defense?
For insanity a defense attorney would have to show he does not know the difference between right and wrong.
The is evidence that he does
Conceal identity with clothing
His fleeing the scene of the crime
Asking for a haircut that covers his face

It is possible he is nuts, but I don’t think he would qualify for Criminally Insane.

I don’t think he qualifies for it either, but his attorney (when he gets one) might try it anyway.

Actually, I wonder if he went off drugs - perhaps he was on anti-psychotics and stopped taking them. I do not know if those types of prescription drugs would preclude someone from being hired. I would think so, but I am not certain. I don't even know if they test for those drugs in the panel. There are different drug testing panels, from very basic to very comprehensive.

Q: What was the motive? A: Part of the investigation, no reason to believe a known association, appears to be a random event.
What was cause of death? A: Weapon used was a knife, victims died by stab wounds.
Q: Parents have said he was their teacher, perhaps he was a predator of young girls. Are there connections that this was his first time, was he after those girls? A: We have no indication that the girls were his target
Q: Was he there the weekend before? A: Honestly would be pure speculation. Will look at timelines and find out why, how long had he planned this.
Q: Elaborate on injuries A: Yes he was injured and it there was blood loss and that allowed us to get a DNA profile and match to suspect.

Q: What did he say since arrest? A: No comment, not fair for investigation.

Q: What about DP? A: The state will not be waiving the DP.
Q: Will he plead guilty? A: I believe he will plead Not Guilty, do not believe there is a defense attorney that would allow a defendant to plead Guilty upon first appearance.
Q: State parks open? A: I do not know. They are as safe as they could be, as likely to get assaulted at a gas station. I would not hesitate to go to a park today.

Q: Did he say why he stayed so close to the scene? A: No indication that he was going to flee, he had a residence in Springdale, and he still had his car.

Q: About tips A: Initially there were issues with the phone system, we had a team filtering through tips and had a matrix to push them to the top. Video, photos, first hand accounts were priority.
Q: A random crime is difficult. A: Nothing about this crime is typical, especially how random it was. We talked last night, it is every agents worst nightmare. We use victimology to narrow suspect pool, we had no way to do that. The work of our agents was extraordinary.

Q; Moving forward anything A: Gov Sanders has been in contact with the family several times, expressed support from the state, anything that the family needs. They are a strong family with support in place, those girls will be well taken care of, if they have needs we can assist with we will do that.
Q: Thoughts on what to do better? A: Always think on what could do better. Hard to be critical on investigators, skill, and expertise, and heart and soul. Will always be things to fine tune.
Q: Confirm he did not know the family? A: I can confirm that we have no indication or reason to believe there was a connection between suspect and victims.

#NEW: We have obtained new intake video of Andrew James McGann, charged with brutally stabbing a couple on a hiking trail with their two daughters. He was arrested during a haircut after a 5 day manhunt. Police say they received hundreds of tips and his DNA matched evidence at the scene.

I posted this article yesterday. The defendant was not a "teacher" to educate. Let me be clear, he is a pedophile (attracted to children). And in my opinion the schools allowed him to move on, and most likely did not report him.




Sierra Marcum said three years ago, her son was a student in McGann's fourth grade classroom in Donald Elementary School in Flower Mound, Texas, and described him as the "most standoff teacher" she had ever met. Her son's yearbook includes a photo of McGann.

"Pretty cold. You could ask him a question and he would give you a one-word response," she said. "Overall just pretty disinterested in his students."

Marcum told CBS News that, over the course of the school year, her son reported inappropriate behavior by McGann toward the girls in his class. It included being "very touchy with the girls and having them on his lap and making comments to them and keeping them back from recess."

I find it very interesting that there's been no mention, word of reporter contact, or visible presence anywhere of McGann's own family. I have no intent to sleuth them - it's against Websleuths' policy anyway - but it's just odd that we haven't seen any member of his family doing the things that often happen in these cases: making a statement of sorrow for the victims, being present at court, or even being contacted by reporters but giving a "no comment" reply either in person or through a spokesperson.

If he does have family that are still involved in his life, they must be horrified.

Yes, you have to wonder why no parents and not a single family member has made any statement. Maybe they're too horrified. His admission of culpability precludes their being able to say that they know he couldn't have done it.

In the Fox 5 San Diego article below, the parent of a past pupil describes him as NOT very personable:

Bailey remembers McGann — known to friends as “Andy” — as a quiet but friendly team leader and athlete.

“He led by example. He wasn’t the loudest guy in the room, but he kept things light,” Bailey said. “We carpooled to rugby practice together all the time, cracked jokes. He seemed like a totally normal guy.”

I'm just going to say this. I have seen a massive discrepancy in images of this man from cocky to jovial to zoned to really angry. Also the video of his demeanor is so subdued and.... just odd. This is going to turn out to be really bizarre, IMO. Even more bizarre than it already is.
It sure sounds like something mental was going on with this guy.

Not only did he move around and go by different names it seems, he also was described in total opposite ways by various accounts I've seen. We've seen some photos of him smiling and others that look like he's about to blow.

Even taking out the inappropriate behavior with female students, it sounds like he was showing signs of something not related to that aspect. He seems to have extreme moods, either happy and high or quiet and angry.

Was he self-medicating somehow? Did he realize something was "wrong" and was he trying various things to compensate? The more recent photos remind me of someone on drugs. Some of the older ones just look someone that is angry at the world.

Oak Park is a nice neighborhood. The tuition for Fenwick is $18,750, which obviously wouldn't be the same as ten years ago, but we can get a sense of the cost. There is financial assistance available.

Fenwick has a rugby team as a club sport.

ETA: Oak Park is where his high school was, it's a suburb just west of Chicago. The perp didn't live in Oak Park that we know of. His residence as written in the article was on SW side of Chicago.

I can't find the exact post now but somebody here suggested (before LE even mentioned the make and model of the actual car used by the perp) that the car may not be a Mazda but rather a Kia Stinger. Whoever that was - impressive skills!
