11-year-old charged with first-degree murder in death of 5-year-old brother: DA

CENTENNIAL, Colo. -- An 11-year-old Colorado boy has been charged with first-degree murder after allegedly killing his 5-year-old brother last week, prosecutors said.

The 11-year-old is also charged with an aggravated juvenile offender sentence enhancer, the 18th Judicial District Attorney's Office announced on Tuesday.

The boy was arrested after his 5-year-old brother died on March 10 at a home in Centennial, outside of Denver, according to the Arapahoe County Sheriff's Office.

I've avoided the headlines on this one thus far. Without knowing what went in to the decision to charge a child of 11 with premeditated murder it is hard to know how to feel about it.

Under Colorado law, Decker noted, the minimum age for a juvenile to be transferred to adult court is 12 years old — meaning the 11-year-old suspect cannot be prosecuted as an adult.

"In a situation like this where we have an 11-year-old, the prosecution’s options to transfer the case to adult court are not there," he said.

That means the case would remain in Colorado’s juvenile justice system, where sentencing options differ significantly from adult court proceedings.

And the same as the 10 year old boy who stabbed a 7 year old girl 3 times in Mtn. View, CA. last week at the elementary school my nephews used to go to when they were little!!
Scary - they are SO young!!
