17-year-old boy was shot in the face by a town of Mountain View council member on Tuesday in Jefferson County after a homeowner reported trespassers, according to the sheriff’s office.

Brent Metz, 38, was arrested on counts of first-degree assault and illegal discharge of a firearm and two counts each of felony menacing and reckless endangerment. Metz has been a town council member since at least 2021.

The trial date was set for January, but now has been delayed until some time after March.

Evidently, the latest defense is that..... the gun did it.

The pistol that the shooter used was a Sig Sauer P320 which can purportedly misfire under certain conditions.

This might be a difficult hill for the defense to climb as nobody has ever been able to duplicate the claimed misfires in Court using a pistol set to factory specifications.

For what its worth, there are numerous videos on You Tube by stated experts regarding the pistol. Some state that the pistol if perfectly safe and that the misfires occurred when human users "human" and inadvertently pulled the trigger, sometimes while holstering the weapon.

Others present a variety of theories claiming that the right combination of worn and accidently swapped out parts from different sub models etc. can cause the weapon to misfire, or.... that dirt can cause a key safety feature to fail.
