Hey does anyone remember when he said she was on the bed, with no clothes and snoring?? I remember something like that.
He certainly said that is how he last saw her before he left for work in Broomfield. I think he mentioned something about wearing a white top. I am sure he used words similar to lightly snoring.

I think you are probably right.
I think when the prosecutor mentioned the circumstances during his arrest being used against him in court, I think part of that is him possessing a fake passport etc to flee the country..

A grand jury in the state’s Twelfth Judicial District returned an indictment last week charging Barry Morphew, 57, with the first-degree murder of his wife, Suzanne Morphew. This is the second time Barry Morphew has been charged in the death of his wife. Prosecutors dropped the charges in 2022 without prejudice, meaning they could be refiled.

“Federal, state and local law enforcement have never stopped working toward justice for Suzanne,” Twelfth Judicial District Attorney Anne Kelly said in a statement. “The Twelfth Judicial District Attorney’s Office stands in solidarity with Suzanne’s family and the citizens of Chaffee and Saguache counties in pursuing the grand jury’s indictment.”

I wondered the same but then would Arizona not charge him with something like having false documents?

I think having a fake passport would be a Federal crime.

You may be correct - I did not recall that the sheath fit the "darts"...I recall the opposite that it was not a sheath that fit the darts. But for sure, if prosecution brings up the sheath in the dryer we'll hear more than we heard in the preliminary.
Awhile back I posted a video showing how preparing/loading dart gun and firing it works, they’re easy to find online. Brief synopsis:
the needle sheath fits the top of the syringe filled with the chemicals (sheath is placed there so as to not leave the syringe’s needle exposed which is dangerous to walk or run around or do anything holding an unsheathed syringe until you are ready to use it for its intended purpose so as to not accidentally stab oneself or have the medicine or chemicals accidentally leak out). Sheath is removed and syringe is placed inside the dart gun, behind the dart. Once loaded/ready, gun is engaged/fired and there’s a mechanism which pushes the plunger of the syringe filled with the chemicals via air pressure and releases the chemicals from the syringe into the dart. Dart filled with the chemicals then flies out of the gun to hit the intended target.

Anywho, many case followers/sleuthers think he may not have shot her with a dart gun, and just manually jabbed/injected her with the syringe filled with the BAM chemicals after chasing her through the house and busting through the bedroom door.

By the way, just because BM/IE says he only had one tranq dart gun which was found at the house by LE and was inoperable, doesn’t mean he didn’t have another, working one, which he could have dumped in Broomfield on his trash dump odyssey. IMO BM is a proven liar so I don't believe a word that comes out of his mouth nor his former Attorney IE on many things imo that she misrepresented, deliberately omitted, etc.

At any rate, in either scenario SM shot with dart gun or manually jabbed/injected with the syringe, he’d have to have removed the sheath on top of the syringe covering the needle first, and likely placed it into pocket of his shorts after removing it, and then forgot to remove from his shorts pocket before laundering which is likely why the sheath was found in the dryer.

Lest anyone believe Iris Eytan has totally abandoned Morphew, she has been quoted in the Denver Post:

"Morphew's attorney in the first case, Iris Eytan, said she would support his new lawyers to 'sustain his rightful innocence.'

"I've handled thousands of cases, and I've never seen prosecutors mishandle a case so recklessly,' Eytan said Friday. 'This case was fumbled so terribly, three prosecutors were penalized. After Barry's case was rightfully dismissed, I dedicated the second half of my career to ensure what happened to Barry doesn't happen to another innocent person. This and this alone is the only reason I'm not representing Barry today.'"

So, let's see ...🤔

When speaking to Agent Grusing, I recall this was BM's alleged last vision of SM before he left for Broomfield on Mother's Day! But he added clothes --I think a white, stringy tank top. JMO

OOps. I should have written "she consumed something containing caffeine." Did not mean to imply she consumed some other substance with it.

Indictment by GJ does not impede a defendant's right to a speedy trial! Rule 16- Discovery is not abandoned.

Prosecutors must turn over such information within 21 days after your arraignment (though grand jury materials can be provided within 35 days after the indictment).

Rock paper scissors, jail beats prison

Be ready for the Defence to hurtle every delay they can, while simultaneously feigning that the State is to blame for them and that Barry's right to a speedy is being violated by the very delays they invited.

The Moore Lee can delay the trial, the longer the Hall Mary, looking for anything they can exploit, praying for sanctions.

Time, blessed time on this side of trial is Barry's only prayer for staying out of prison.

In the meantime, jail, no bail, enjoy your new dive bars, Barry Lee.

Nope. But following his arrest, he had an extradition hearing at about 11 PM on Friday night.

"CC" -> summoned for the Broomfield Wallibi by MG @ BM's direction and later reversed, never arrived at the site, nor stayed at the accommodations reserved for him nearby, presumably returning home.
Correct CC didn’t stay at the hotel Sunday evening with MG and JP, but iirc CC did show up at the jobsite the next day on Monday to help MG and JP work on the wall. However, since BM didn’t bring/leave the correct tools for his workers to be able to do the work, and also since the materials needed to do the work never arrived at the site (because they were never ordered),
BM’s workers’ ended up leaving the site and headed home after waiting around for awhile for materials that never arrived and not being able to perform any work with incorrect tools!


In any & all events, iirc, is not CC deceased?
I do believe CC is still among the living, it is JP who’s unfortunately deceased. (RIP)

Quoting my own post because I didn’t catch an error until too late to edit:

Add to that the missing telematics on his truck and the turning off of his phone for the beginning of that trip to Broomfield.

  • SM's phone ceases all activity at 4:23 am.
  • BM turns off his phone before leaving Puma Path residence at 4:32 am and it remains off until 5:37 am, when it is turned off near Johnson Village. (It takes 36 minutes to travel from Puma Path to Johnson Village, so 29 minutes are unaccounted for.)
  • No telematics registered on BM's truck from 3:49 am to 8:10 am even though he was at Johnson Village by 5:37 am (so must have been driving the truck to get there). It takes roughly 3 hours to drive from the Puma Path residence to the Holiday Inn Express, Broomfield.
  • Last telematics indicating truck activity before that was from 3:25 am to 3:49 am in the driveway of Puma Path residence.

SM's phone ceased all activity at 4:23 am (34 minutes after last truck activity in Puma Path driveway recorded by telematics and 9 minutes before BM turned his own phone off before leaving the Puma Path residence and heading toward Broomfield).

4:32 am to 5:37 am seems a very important time (much like the missing hours the night before, but a much more condensed time period so whatever happened during this time could be done quickly).
2nd bullet should have read “until 5:37 am when it was turned ON near Johnson Village” (not OFF).

Ugh.

Is it just me, but WITH does the one officer (I believe) simply grab the bike, by the handlebars, and begin to examine it. Without nitrile or other gloves? To preserve potential evidence? (It sounded like the one officer asked that he not touch it…. to no avail.) And then others allowed to examine or touch it too? SMH.

And how on earth did someone so readily happen to find that bike on such a steep embankment and down well off the roadside? MOO

The spot where the bike was found is very near the entrance to the neighborhood off the freeway, and if LE (reasonably IMO) initially assumed SM may have headed out on a ride directly from home, it would make sense for the roads throughout the entire neighborhood to be carefully searched. Also IIRC there was a known popular trail that just happened to coincide with that stretch of road, making it even more of a natural place to search.

Plus, of course, the bike having been staged, it was placed in such a way as to be easily found (IMO).

Fully agree with you re gloves and careless handling etc.
