It reads like: we wanna see whatya got before we decide to represent him for more than a day.

I vigorously disagree. In hindsight Judge Lama did the state a favor. I do not think they would have gotten a unanimous verdict by a jury from the original case.
He very unintentionally did the prosecution a favor by levying all of those heavy sanctions against them. They couldn't even put on expert witnesses based on his orders, so of course that would have put them in an impossible situation with the jury, who would have been waiting to hear from experts in their fields, especially the digital/electronic experts.

The fact that Lama's and Stanley's combined level of incompetency at their jobs resulted in the first case being dismissed did indeed turn out to be incredibly providential, but let's not pretend that Lama was trying to do the state a favor when he gutted their case.

She dropped this absolute gem after Suzanne's autopsy results were revealed:"Barry Morphew is innocent and he could not have killed his wife," said Jane Fisher-Byrialsen, one of Barry's attorneys, at the time. "She got up the morning of Mother's Day, had her cup of coffee, that is now confirmed with the autopsy report. Also confirmed with the autopsy report is that she put on her bike clothes. She was on a bike ride and abducted."

"The tranquilizer that was found in her bones, allegedly, is a very common animal tranquilizer that could be used on farms or by hunters, which are people who are very prevalent in that area of Salida," Fisher-Byrialsen said.

An autopsy report cannot "confirm" she put on her bike clothes (we now know the bike clothes were likely added when Suzanne's body was moved).

Suzanne should have coffee in her system under the state theory of the crime (assuming this is even true).

And no, BAM is not "very common." Barry was the only private citizen in the area who had a prescription for it, and hunters don't shoot animals with tranquilizers.They shoot them with bullets.
 
How long will we have to wait to see discovery documents ?
Trial. There's no preliminary hearing or anything, so we've got what we've got (the grand jury indictment).

We'll get pieces via motions and hearings, but I'm not expecting much.

I'm still trying unsuccessfully to find where in the autopsy it says, "Examination of skeletal remains reveals that subject got up the morning of Mother's Day in 2020, drank a cup of coffee, and dressed herself in bike clothes."

I must be going blind, can someone please point me to that section of the ME's report?

We've never had any confirmation that she had one. I know it was discussed that there would be some difficulty considering her cancer history. I'd still be surprised if one didn't exist though, maybe even a couple.
There was a long cancer-free time period, during which she had two children. They are looking at 5+ years of survival as being “cancer-free”, and her case was a couple of decades. So she could have well had a life insurance.

If that is the best she can do ,then Barry might as well plead guilty now!
