Found Deceased CO - BARRY ARRESTED AGAIN - Suzanne Morphew, 49, Chaffee Co, 10 May 2020 *Case dismissed w/o prejudice* *found in 2023* #117

I wondered if they got their hands on the complete autopsy report. We the public didn't see the complete report I don't think but I recall thinking hmmmm when she mentioned the coffee because it was not in what was released to the media.
I suspect the coffee is the same as the biking clothes she also mentions Suz was wearing as confirmed by the autopsy …not so much.
Just a false narrative and D talking points to sow doubt 🤔
Eventually all will be revealed
So we’ll have to see what unfolds

Why did you think hmmmm ? There might have been traces of caffeine found in her bones but that could be from other sources ,not just from coffee..
I would be surprised if Suzanne would have left a half drunk cup of coffee out on the work top all morning. I would not be at all surprised if Barry staged it to show Suzanne had her morning coffee

The challenge is proving something did not happen like the coffee. So yes, there was a half drunk cup of coffee on the kitchen counter and yes she had caffeine. What it doesn't say is when she drank the coffee and what it doesn't say is that it was "staged" and the caffeine in her bones came from something else. This is somewhat why I think this prosecution will be smart and omit theories that could have an alternative theory. Call me shocked if this isn't a short concise prosecution...strongly fact based and tight without a huge line up of witnesses.

The reason we are discussing it is because of the theories his defence are still pursuing. So I am sure the prosecution will be debunking those theories.
I think the prosecution have a number of witnesses with significant evidence to give to the trial.

I hope the opening statement from DA Kelly includes an acknowledgment that prosecution bears the burden of proof in the case.

I hope she then goes on to add that fortunately, the defendant has helped to lighten that burden considerably by carrying it out in such a way that proves he's the only person in the entire state of Colorado who had the means (BAM), motive ($$$/affair) and opportunity (home alone with her Saturday night/Sunday morning) to murder Suzanne.

I also hope that the BAM expert is the final witness for the prosecution's case in chief.
It will be the proverbial final nail.
His coffin will be airtight after the jury hears that evidence.

Help me out folks- This quote of the lawyer Jane F-B about coffee.
Is it recent? Was it after the autopsy results came out?
Just trying to get on the same page lol.
Thanks!

From the linked article:

In spring 2024, after autopsy results were released, Morphew's defense attorney argued that the autopsy results showing Suzanne had BAM in her system did not incriminate him.

"Barry Morphew is innocent and he could not have killed his wife," said Jane Fisher-Byrialsen, one of Barry's attorneys, at the time. "She got up the morning of Mother's Day, had her cup of coffee, that is now confirmed with the autopsy report. Also confirmed with the autopsy report is that she put on her bike clothes. She was on a bike ride and abducted.

"The tranquilizer that was found in her bones, allegedly, is a very common animal tranquilizer that could be used on farms or by hunters, which are people who are very prevalent in that area of Salida," Fisher-Byrialsen said.

What's amazing is that literally every assertion Jane makes in that statement is part of Barry's false narrative.

I'm just surprised she didn't say the autopsy confirmed a mountain lion attacked Suzanne.

That statement does not inspire confidence in her abilities! Anyone who has followed the case can see how flawed her statement is.

The toxicology report was not part of the Autopsy report released to the public.

Not recent. Jane referenced toxicology info at the same time Iris cited additional bodies located in the "boneyard" during 2023.

I'm still trying unsuccessfully to find where in the autopsy it says, "Examination of skeletal remains reveals that subject got up the morning of Mother's Day in 2020, drank a cup of coffee, and dressed herself in bike clothes."

I must be going blind, can someone please point me to that section of the ME's report?

TIA!
No no no no @Magic8Ball 🧐
Begging your pardon, but you are missing the dance here.
This drivel was for media consumption only.
My take is that late-to-the-game JF-B learned this step from J-I, as in 'Jitterbugging-Iris'
👯‍♀️
Am anxious, tho', to see how the disco ball spins with a new 'DJ' !

It might be illegal but they absolutely do base their decisions on charges alone and not just convictions. But yes, I almost forgot that this is his only criminal conviction.
I'm just glad that this conviction hasn't been forgotten about. It should be allowed, as it shows his criminal mindset.

We probably won’t know until he’s booked into Alamosa County. Unless a reporter catches wind of the imminent arrival. JMO
LE won’t announce or publicize the details of transport in advance for safety reasons .
I’m hitting refresh on Twitter every 10 minutes!
Is there a state inmate locator website that someone can check? I know that Oregon and CA have them.

Jane annoys me as much as Iris.

She dropped this absolute gem after Suzanne's autopsy results were revealed:"Barry Morphew is innocent and he could not have killed his wife," said Jane Fisher-Byrialsen, one of Barry's attorneys, at the time. "She got up the morning of Mother's Day, had her cup of coffee, that is now confirmed with the autopsy report. Also confirmed with the autopsy report is that she put on her bike clothes. She was on a bike ride and abducted."

"The tranquilizer that was found in her bones, allegedly, is a very common animal tranquilizer that could be used on farms or by hunters, which are people who are very prevalent in that area of Salida," Fisher-Byrialsen said.

An autopsy report cannot "confirm" she put on her bike clothes (we now know the bike clothes were likely added when Suzanne's body was moved).

Suzanne should have coffee in her system under the state theory of the crime (assuming this is even true).

And no, BAM is not "very common." Barry was the only private citizen in the area who had a prescription for it, and hunters don't shoot animals with tranquilizers. They shoot them with bullets.
Um, if all they found were skeletal remains, how do they confirm that caffeine was in her system? And it doesn't confirm time of death. She could still have been killed after having her cup of coffee.

He's still listed as in custody in Maricopa county

From the Woolsack, GOBliaison J. ensconced:
"Errr....
Excuse me.
Where did you acquire the fantasy that BARD requires proving fictional negatives?? Negatives YOU create whole cloth.
What law school?
Accredited?
What State Bar?
You already know that such does not happen in this court.
Counselor, you have a few choices. Instanto:
(1) Leave us in peace until the next scheduled session - your speedy-whatever clock running;
(2) Retract your blather and move ahead.

And counselor: I urge in the strongest possible terms that you include in the penumbric fog wrapped about your notions of "due process", the constraint of "do" process in this trial.
FTHLogod, get on with it!

The Coffee is a red herring. Irrelevant.
