I think I read on the last page that she has been charged.

I also understand what was meant by the “escape” comment on the last page as I had a lady to drive up into my yard yelling that I had killed her brother and stolen his home. Having never seen her before and feeling like something was wrong I called 911. Her family members showed up and explained that they cared for her at home and she had “escaped” them and took off in a relatives car. They also explained that her brother had in fact lived in the same home years before I rented it. I have 2 close relatives with this condition currently and it is very hard to deal with.

The misconduct charge and the failure to report use of force charge were both dismissed as part of the plea deal, according to court records. A sentencing hearing is set for Aug. 5 at 8:30 a.m.

Yes-- it is heartbreaking to family members.
My mom had Dementia /Alzheimer and would get easily confused on little, simple things.
Then she would get confused on where she lived and wonder whose house we were in, when it was her home.

These cops were ruthless

They had no compassion, no respect and they were brutal and harmful.

Maybe someday they will have to care for a family member like this.
Maybe someday they will be like this and need family to take care of them.
God forbid--Karma will get them.

I bothered to look up the CO statute and max penalty: statute 18-8-802, penalty 120 days jail and/or $750 fine, a class 2 misdemeanor. scroll down link to find "802" failure to intervene:


I guess the real penalty is the loss of her job and reputation. Maybe this conviction will wipe that smirk off her face.

We really should expect better. The point of my post above is that if some bozo Deadhead like me can recognize a medical issue thru aggressive behavior in an elderly person then it should be a no brained for a trained person.

This behavior by these officers was despicable. There is a certain segment of society that includes senior citizens that feel like you are just a throw away citizen. And these officers just reinforced that perception. My only gratification is that those videos are out there forever.

Both of them are out of law enforcement. That is the most important thing.

I'm glad that goon Hopps got 5 years. I cannot find him as an inmate of the Colorado Dept of Corrections. Does anyone know where he is serving his sentence?

$3 million settlement reached over Colorado police's violent arrest of Karen Garner, a 73-year-old with dementia

The lawsuit said former Loveland Officer Austin Hopp injured Garner during a 2020 arrest after she allegedly left a Walmart without paying for about $14 worth of items. In a video of the incident, she was put on the ground and pinned to the patrol car, which she said resulted in a dislocated shoulder, broken arm and bruises.

In an another clip released by Garner's lawyer, Sarah Schielke, some officers involved in the incident could be seen laughing at footage of the arrest, as Garner sat in a jail cell without medical care for about six hours.

Three of the officers involved, including Hopp, have resigned. Hopp and Daria Jalali, who also responded to the incident, face criminal charges stemming from the arrest. In May, Garner's daughter Allisa Swartz told "CBS Mornings" national correspondent David Begnaud that those officers "need to go to jail."

Garner's family filed a federal lawsuit against Loveland and its officers in April, accusing the police department of violating her civil rights. The city said once the settlement is finalized, it will end Garner's pending lawsuit. The city's manager Steve Adams said it will "help bring some closure to an unfortunate event."
3 Million will go a long way in securing excellent long term care as KG approaches the need for 24/7 supervision and daily living assistance. I am happy the officers were held accountable and are no longer in a position to treat another citizen that way. At least in this department. Unfortunately, that doesn't preclude them from being hired on in another department on some future date.

Hopp couldn't be hired as LE since he is a convicted felon now.

A former Colorado police officer was sentenced to 45days in jail and three years probation Friday for not intervening when a fellow officer arrested and injured a 73-year-old woman with dementia in June 2020.

The former officer, Daria Jalali, pleaded guilty in the abusive arrest of Karen Garner after an incident in Loveland, Colorado. In 2020, the state passed a police accountability bill under which law enforcement officers could be charged if they fail to intervene during police brutality.

Austin Hopp, the former officer who arrested Garner after she left a store without paying for about $14 worth of items, was sentenced in May to five years in prison for his rough treatment of Garner. The Loveland Police Department settled a lawsuit that paid Garner $3 million. Her family alleged her condition was exacerbated by the arrest.
