Just some minor observations while watching this trial. First, this witness appears very tired and almost dis-interested. Court observers in chat have stated that he might need a red bull. Very short yes or no answers, with a slow methodical monotone voice.

Also, I am now taking a "sip" each time the defense says " safe to say..". Sigh

I actually feel bad for him. When he got on the stand it was stated that he has a huge hearing loss, but turned his hearing aides all the way up. I’ve heard that people who have them say the background noise is awful. Now imagine Moran talking into that mic…

I don't understand why Defense is trying to impeach the witness over a beer can? What importance is the beer can? Unless they know it's Mark's?

Defense: Safe to say, you didn't measure the distance between the sock, the shoe and the tibia and fibula, the ear buds and the trailhead, or Middle Mountain Road?

Witness: Yes.

Defense: Yes, meaning "No" you did not measure distance?

Witness: Yes.

Defense: Yes, you did not measure.

Defense: [Same for GPS Coordinates of the sock! Didn't measure.] (Thinks to self) Therefore, the evidence doesn't exist. (Yes!!! Another win for us!)

Safe to say . . . very weak defense.

Wish I had something to sip, but tomorrow I'll thank myself.

It has something to do with GPS coordinates. Not sure why it's important to the defense.

All of this attempt to impeach this poor old geezer over his lack of memory about a Miller Lite Beer can is NOT going to go well with the jurors, I am sure. The judge is loosing patience, and the jury must be aware of that as we are.
