Letecia Stauch pleads not guilty in death of stepson Gannon; trial expected to start in March 2022

UPDATE (1:40 p.m.): Letecia Stauch entered a not guilty plea following a short hearing Thursday afternoon.

Stauch’s trial is scheduled for March 28, 2022, though is subject to change.

PREVIOUS (11/4): Letecia Stauch will enter a guilty or not-guilty plea Thursday ahead of her looming trial for the death of her stepson Gannon.

Stauch -- who has declined to attend her last few court sessions, including September’s hearing to decide whether her case would go before a jury -- was told by the judge she would have to appear at Thursday’s plea hearing.

One, filed by #LeteciaStauch's defense team, says an insanity plea is NOT off the table. In court, it's been said the mental health evaluation she's undergoing is not related to competency or insanity, but if it proves insanity, could be introduced at trial as such:

Opening statements

Following the selection of the 19-person jury selection, 4th Judicial District Attorney Michael Allen began opening statements for the prosecution by telling the jury that the case will come down to insanity, and that by the end of the trial the prosecution will have proved Stauch was sane at the time of Gannon's killing.

"The evidence will show she could distinguish between right and wrong," Allen told the jury to begin his opening statement.

Allen walked the jury through the evidence that the prosecution plans to show, including how Stauch allegedly stabbed her stepson 18 times as he fought back before shooting him three times, and how she allegedly drove his body to Florida in the trunk of her car in a suitcase before throwing it over a bridge into a river below.

Allen alleges that all of this evidence, as well as testimony from experts at the state hospital in Pueblo, will prove that Stauch was sane at the time of Gannon's killing. Allen made the claims while acknowledging that the defense will have an expert witness testify that they found Stauch to be insane at the time of Gannon's death.

The defense's expert, Dr. Dorothy Lewis, is a former clinical professor of psychiatry at Yale University, the author of several books on the topic of the insanity plea and the subject of the documentary “Crazy, Not Insane.”

"The defendant took deliberate actions to hide those crimes from the world," Allen said.

Allen ended his opening statements by playing audio of Stauch's call to 911 to report her stepson as missing. When the dispatcher asks Stauch about the last person to have seen the boy alive, she responds: "I guess me?"

Defense attorney Will Cook opened with some theatrics, pointing to how most people already find his client "guilty" or "evil." Cook then pretended to walk out of the courtroom, acting defeated before returning to say he "can't just check out now" because it "wouldn't be fair to (Stauch)."

"We have lost in the court of public opinion and in the media, she is guilty," Cook told the jurors. "Do your job, listen to the evidence... That is all I'm asking of you, give us a fair shake."

Cook went on to display a selfie of Letecia Stauch and Gannon Stauch that Cook alleges was from the day before Gannon's death. Letecia Stauch could be heard quietly crying at the defense table when the selfie was shown.

"Behind those photos and smiles Ms. Stauch ... was dealing with trauma and abuse that had been going no since she was a toddler," Cook said, referencing that Stauch was allegedly assaulted and molested for years as a child.

Stauch's abuse as a child, according to Cook, led to her developing dissociative identity order and that their expert found Stauch to be insane at the time of the incident.

"You must, to be fair and impartial, you must believe it (insanity) is a valid defense," Cook said.

To finish his opening statements, Cook claimed that the lack of a motive presented by the prosecution will prove that Stauch was insane, and that she should be found not guilty by reason of insanity.

EL PASO COUNTY, Colo. — After flat-out denying that she killed her stepson, and then blaming his disappearance on an attack by a man named Quincy Brown, Letecia Stauch told Gannon's dad that the boy was injured in an accident and then taken by a man she was meeting up with through Craigslist to buy an exercise bike in Douglas County.

"He promised he was going to go back to his house to get some bandages and call 911," Letecia Stauch said through sobs about the man she met. She said the man never came back with Gannon and she just "didn't know what to do."
None of it was true, according to prosecutors who allege that Letecia Stauch stabbed 11-year-old Gannon Stauch numerous times in his bedroom before shooting at him three times on Jan. 27, 2020.

After the boy's death, his remains were placed in a suitcase from the Stauch home and then dumped under a bridge in Florida, where they were found in March 2020 – weeks after the boy went missing.
Two investigators from Florida are expected to testify later Wednesday after Al Stauch, Gannon's father, finishes up his testimony.

LETECIA STAUCH OPENING STATEMENTS: Just sat down in court room. Jury coming in any second now.

Prosecution is starting opening statements now.

"Paramount question you need to answer in this case is sanity."

“This case is about two people, the first is Gannon Jacob Stauch an 11-year-old boy who came into this world premature” - this line and Gannon's picture on the screen prompted Gannon's biological mother to run out of the room with emotion.

We are hearing a video that you can't see Gannon, but hear him crying with Letecia asking him questions about what "he did"

"She carried out actions to kill Gannon, to put his body in a suitcase and hide it....to discard Gannon in that suitcase off of a bridge like garbage" - Allen talking about Letecia Stauch

Letecia has her head down and hair is covering her face so we don't see any expression right now.

DA is talking about how Gannon's life was ended in his bedroom. He says Gannon suffered 18 stab wounds to his body. DA says he was then shot.

DA says Gannon was shoved in a suitcase and hidden in a storage unit in the basement. He says Letecia left blood behind in this storage unit but scrubbed walls in bedroom and carpet.

DA says Letecia's clothes were never found but her shoes were found in the washroom drying. DA says Gannon's DNA was found on Letecia's shoes.

DA says the weapon used to stab Gannon 18 times was never found.

GPS location data used to track Letecia's movements lead investigators to a location where they found a board with Gannon's blood on it. DA says board came from Stauch family garage.

48 days later, 1,300 miles from Gannon was killed, DA says his body was found in the suitcase.

DA says the same blankets and pillow that were captured in pictures Letecia took on Jan 27th were found with Gannon's body under that bridge 1,300 miles away.

ALLEN: "All of her actions we’re designed by her to distance herself from what she did/ throw off investigators..escape accountability." "All of her deliberate actions...she knew what she had done to Gannon was wrong...why hide it." "The evidence itself will prove her sanity.”

DA Allen says we will hear from people who can "vouch for her sanity" at the time of Gannon's murder. "People like Al Stauch, the man that was married to her. People like her brother…and most importantly her very own daughter Harley Hunt.”

Letecia's head still down with hair covering her face so we have not seen any emotion.

On Jan. 27th 2020, 6:55 pm the defendant herself called 911. She called 911 to report he was missing and had not come home.

We are hearing the 911 call. When asked who was the last person to see him. She said "Uh, I guess me"

'This is very tough case” Defense Atty. Cook said. Says there was a lot of strong opinions in the jury questionnaires forming an opinion about Letecia. Heard “she was evil” etc.

COOK: “I as the defense attorney have two big problems in the case. I represent Ms. Stauch who according to a lot of jury questionaries is “evil and guilty” and “us raising question of sanity is a bunch of BS”

COOK: “I have been working on this case for three years now. I’ve seen the pictures in this case…it’s a lot. What you have seen on the board this afternoon that’s the PG stuff you are going to see.”

“I get it, what happened to this little boy in 2020 is beyond description and the facts of the case…it’s awful. You know what it’s so bad, this is a lost cause, i’m not going to do this anymore…I can’t (he says while starting to walk out and now he’s walking back).

Cook: “Ladies and Gentleman, I can’t quit, I can’t leave this court room. I have to do my job in this case. After the photos we’ve seen, the pictures of Gannon.....I can't check out now and just sit down and ride this out.”

Cook: "I know people will say who gives a s*** about what’s fair for Ms. Stauch. The court systems do, the law does, the constitution, the bill of rights.”

Cook: “I get it, we’ve lost. Mr. Tolini we lost, Ms. Stauch we lost. We have lost in the court of public opinion and media. She’s guilty. I get that. But this court of law….”

Cook: "This isn't the media, this isn't Facebook. Wash all of that away. Don’t try to walk out of the court room before we start it."

COOK: "Do your jobs. Listen to the evidence. When the evidence is complete go back into the jury room and weigh the evidence. That’s all i’m asking of you, just give us a fair shake.”

Cook: "If you are partial and you still find her guilty, I’ll take that…so don’t quit on me”

Cook: "This is going to come down to insanity. Was this lady here insane when Gannon was killed. (she's not looking at the jury and is looking forward/down)

Cook is telling jury that can consider her sanity in the evidence, recorded statements, the phone call you heard Ms. Stauch talking in. "That’s good stuff." He is also talking about motive.

Cook: "Even though jury instruction is talking about sanity. Motive or lack of motive can be a sign of sanity or lack of sanity. It's not required but it matters because it's evidence and if you don't have a motive that shows a lack of evidence.”

Cook: "When you look at that it looks like everyone's doing pretty good, happy sunny day."

Cook says this picture is from the day before Gannon was killed. It's her with Gannon and Gannon's little sister. "That wasn't a photo of evil. That was a photo of someone who by all accounts was a loving stepmother.”

Cook: “You have a person who was living what would have seemed like the American dream... behind those photos, Ms. Stauch was hiding, I don’t even know if she knew she was hiding it. Stauch was dealing with trauma and abuse that had been going on since she was a toddler.”

Cook: Since she was 3 or 4 trauma and abuse in the hands of mother’s boyfriends. "First is was just physical, beatings, whoopings, emotional abuse, physical abuse and then it became sexual. When she was molested regularly from 5 or 6 on to when she was a teenager.”

Cook: "It was constant." says she used to have to sleep in her car to avoid the sexual abuse. Says she had an "absentee" mom who was gone all of the time and Letecia was then left in the care of these men, mom's boyfriends who abused her.

Looks like Letecia may be rubbing her eyes as Cook describes the physical and sexual abuse. Just saw her put tissue to her face.

Cook says her sexual and physical abuse from who were her "caretakers" as a child and teen (moms' boyfriends) prompted her to have a fragmented personality.

Cook says we are going to be in here for 8 weeks for this trial.

"You know what you probably won't hear doing all of that time, all of that evidence all of those witnesses...you are not going to hear about a motive. You are not going to be given a motive to why Ms. Stauch did what she did in January of 2020. Reason is, there is no motive."

COOK: “There is no reason, it doesn’t make sense. It’s insane. Smiling photo, the next day Gannon’s gone. There’s no reason for it.

“She broke on that day ladies and gentleman, she broke from all that was right and made sense.”

Cook: “The person she was killing that day, that wasn’t Gannon to her. She didn’t wake up that day and say i’m going to kill my stepson Gannon Stauch today. No she was killing the demons in her life in the dark depths of her childhood, in her life.”

Cook: "Some people have severe mental health issues but they don’t go out and kill people. They don’t go out and kill 11-year-old boys, they’re stepsons that they had nice hikes with the day before."

Cook: "They don’t stab the stepson dozens of times, they don’t shoot him….beat him, burn him…it’s wrong and it’s horrible and she was not sane. And she will be held accountable."

Cook says if she’s found not guilty by reason of insanity it doesn’t mean she walks out of here. She will go to the state mental hospital.

Cook: "Prejudging the case on what you heard in the media, it’s going to do no good. We know we have a tragedy here... but just listen to the evidence. Don't check out.”

Cook: "From the next 6-8 weeks when we are in this trial, you can't form an opinion. You are in an evidence gathering phase. You are gathering the facts...when you go back to the jury room after all the evidence is in. That's when you start putting the ingredients together.”

Defense is wrapping up now. Telling jury they will be here for 2 months. "You are the ones that make the sacrifice in this case"

STAUCH DAY TWO: Prosecution calling up first witness now. Al Stauch, Gannon's biological father.

Al asked his relationship to Gannon. "That's my boy, he says emotionally.

Gannon born premature. 1 pound, six ounces.

A month after he was born Al said he got to hold him since he was so premature. He then said the last time he got to hold him after he was killed, he was in a box too. You can hear the emotion in Al's voice saying this.

Al: "Famous quote Laina said after Gannon died was 'I'm going to miss getting on his nerves.'' He talks about how much Laina loved her big brother Gannon.

Al talking about him and Letecia getting together. Says it was Jan 2015 in Myrtle Beach. He's describing her right now wearing a blueish green jacket.

Al talking about leaving Gannon and Letecia for that final time. On Saturday night, Al said drove his mom to the airport and then stayed at the airport and slept on his bag since he was flying out the next day. When he left he said Letecia, Gannon and Laina were home.

Talking about the carpet cut out. He said Letecia said there was "an accident" and a candle spill. He believes it was Jan. 26th, 2020. That would have been the day before Gannon's reported disappearance.

Al was in Oklahoma, he was scheduled to be there two weeks. Just got out of class and back in his hotel room when he said him and Landen "started the conversation" about how Gannon hadn't come home in time for when the street lights when down.

"I was in Oklahoma so I was relying and trusting her. She said he hadn't been home yet from a friends.”

Al said Letecia told him on the 27th, Gannon did not go to school because he was having stomach issues and was sick. Which Al said was "weird" in his my mind. "I was like why is he going to a friends house if he was sick." Al said that seemed “out of the ordinary”

27th, as soon as Al decided Gannon was missing he said he called travel people and said he needed an emergency ticket home from Oklahoma. Got back the next morning.

Al says Letecia told him she called 911 about Gannon. Al said he had contacted numerous friends parents in the neighborhood. He said none of Gannon's friends parents had seen him. "That's when it became an issue.”

Al said Letecia had mentioned a new friend he hadn't heard of that Gannon was potentially hanging out with. "Things starting compounding and becoming more worrisome."

Al said Letecia picked him up from the airport when he came home after learning of Gannon missing. He said she typically drove a Volkswagen Tiguan but picked him up in a rental car. He thought that was unusual.

Al said Gannon's biological mom Landen flew to Colorado when hearing about her son's disappearance. Al said Letecia got mad at Al for having Landen in their house while Gannon was missing.

Al: "I didn't see a need for tension because there's a little boy missing and we all need to fight together at that point."

Al said within the first week of Landen arriving to search for her missing son, Letecia started taking some of her belongings out of their home. There was "tension" Al describes with Letecia stemming from having Landen there to search for Gannon.

Al says Letecia and her daughter Harley moved out of the Lorson Ranch home the week Gannon went missing.

Al says he, Letecia and Harley all their own cell phones. Gannon and Laina had a "kids" phone.

Law enforcement got access from Al to the "kids" phone during the investigation.

Al's car at the time was a red Nissan Frontier truck. Harley, Letecia's daughter, had a white Volkswagen. Letecia had a black Volkswagen Tiguan.

Al said Letecia told him her reasoning for picking him up from the airport in a rental car was that she had a lease and since they would be doing a lot of searching for Gannon, she didn't want to use up all of her miles.

Al: "In these moments when it's an emergency, things like miles on your car don't matter...in the moment i'm like whatever do what you want but it didn't make any sense.”

Al asked her how did she get to the airport if she has a rental car. She told him she parked it at French Elementary school where she worked and a coworker took her to the airport. Al said he went to French Elem. to look for her car and he did not see the car.

When asked about the relationship between Gannon and Letecia. Al said he would call it trusting. "I’m comfortable in saying he had trust for her in his heart." He said Gannon was a mama's boy and absolutely loved his mom. "I could see some of that love for Letecia too.”

Al commissioned to the National Guard in June 2016.

Letecia and Al bought a house in Myrtle Beach, SC

In 2019, Al was transferred to Colorado from Alaska. Al says he filed for custody in 2017, before he left for Alaska.

Al says Letecia and him got in an argument in 2017 over him taking a national guard job in Alaska. They lived together in SC at the time. On day he was supposed to leave for Colorado for training in 2017, she threw all of his stuff in the yard Al said.

Al calls that period in 2017 with Letecia "tough times"

Al and Landen were long distance during his time in Alaska. The first summer he was there, Letecia told him she enrolled Harley in school in Alaska. Harley and Letecia came to Alaska and stayed with Al but he says Letecia hated it.

DA Allen: Would the defendant use manipulation on you during the relationship? Al: Absolutely

Al said Letecia's manipulation lead him to leave Alaska.

COURT BACK


Al said there were sexual harassment claims that led Al and Letecia to move to Colorado from Alaska. Letecia raised sexual harassment claim based on a comment Al's captain made. Another sexual harassment claim based on a conversation a Colonial and Letecia had.

Al said Letecia informed the Alaska National Guard of a complaint with sexual harassment. Al said this caused issues within his unit and led to his eventual transfer from Alaska to Colorado.

Al said Letecia told him she was pregnant with twins while he was in Alaska. He said he's confident she never went to the doctor. She never had twins.

DA Allen: Did #LeteciaStauch tell you she was pregnant with twins Al: Yes sir DA Allen: Was that a form of manipulation? Al: Yes

Al said #LeteciaStauch filed two burglary claims in 2019. She pointed to a hammer hanging from a string in the garage. She referred to it as a squatter but Al said no one was ever found.

In one of the 2019 break-in allegations, Al said an ammo can was dumped over and their room was a little messed up and Letecia said this was a sign someone broke into their house.

Al said she fired a gun out of a window well in their home on another occasion. He didn't find a bullet casing.

Al said #LeteciaStauch admitted to Al she made up the burglary claims in 2019. "She finally admitted to making up the claims to the break-ins."

In Al's mind, he says the made up break-ins were attempts at Letecia trying to manipulate him.

Al said Letecia suggested Gannon get into counseling. She made a claim he was coming after, and counseling may help with that. Additionally, she brought up that he was a mommas' boy and counseling would help with the separation from his biological mom.

Al said Letecia was closer to Laina than she was to Gannon. Al said he "absolutely does not" think Gannon "had it out" for Letecia.

Al said Letecia had conflicts with Principal at French Elementary school where Letecia worked. Al says Letecia would tell him she felt she was more educated than the principal.

Al says Letecia claimed she got injured at French Elementary school. That a bookshelf fell and hit her head. He didn't see signs of injury and thought it was another manipulation tactic.

Late 2019-2020 Al said Letecia was pursuing employment with Spirit Airlines. He says she went to Orlando for Spirit Airlines training after Christmas 2019 and it was a short trip.

Al's mom was in town for a week right before Gannon's disappearance and murder. Al said his mom stayed at the house when she visited. Al and Letecia were not getting along well during the visit.

Last time Al saw Gannon alive was January 25th. "Me and Gannon were at the top of the stairs and I ran my hands through my hair and I told him I love you like I always did.

Al says he remembers his last words shared with his son in person like it was yesterday. "You are always going to be in my heart and I will always be in your heart," Al said to Gannon. "He said I love you Dad and I am going to watch Pokemon."

Al said Letecia told her Gannon had threatened or came out her with a life. "I never saw threats out of Gannon, knife or no knife." This was right before Al got Gannon into counseling in 2019 after Letecia suggested it.

Al said Letecia wanted to "be like Kim Kardashian." "A good way to sum it up was she always wanted to live above her means.”

Al is talking about an extra large green suitcase they had in their storage. He says it's the same one he recognized in the photos under a bridge.

While talking about the suitcase, I'm looking at #LeteciaStauch on the feed. She's resting her face on her fist and rubbing her face.

We're hearing Letecia and Gannon on video. Letecia recording herself asking Gannon "Are you sure you didn't do it on purpose?" Gannon is crying in this recording and you can hear he is upset.

Al refers to that recording with Gannon heard crying. "Those are the last words I ever heard Gannon speak”

Al said Letecia texted him pictures on Monday, Jan 27th, 2020. Al describing the pictures showing Gannon in his bed that morning.

"There were a couple of things I noticed that were different." Al said his bed was pulled away from the wall and that was abnormal. He doesn't remember one of the blankets captured on Gannon's bed normally being there.

Al said he heard there was a sighting of Gannon at a gas station. Al and Letecia went to that gas station and saw footage from gas station. It was not Gannon but another boy on the footage.

Al said he went around the French Elementary School parking lot three times to look if Letecia's car was there like she told him. He did not see that car.

"That was the key moment when I switched. She knows more than she's telling me." Al describing the moment he realized her car wasn't at French. He said he went to the Sheriff's office about it.

Al describing stories Leteica told him following Gannon's disappearance. Al said Letecia said she was raped and Gannon got burned by the rapist. Al said he asked Letecia "where is the bloody mess" and she said she cleaned it up because she got scared.

Al said he was directed to go to the FBI's office to give background history of his and Letecia's relationship. "From that it turned into pretext phone calls. I would get on a call with the defendant when I was in the FBI office and was given directions on what to say.”

On some of these recorded calls, Al said you can hear people whispering to him.

Some of the calls are long, DA Allen said ones' an hour and fifteen minutes. Judge says DA will admit them now and play some after lunch break.

Judge is sending jury on lunch break early. At 1:20 pm, he says that we will be hearing the recorded phone calls between #LeteciaStauch and Al, one after another.





STAUCH DAY TWO AFTER LUNCH: We're back from lunch. Prepared to hear recorded calls between Al Stauch and Letecia that the FBI guided Al through.

Going through texts between Letecia and Al. On, Jan 27th 2:48 am Letecia texts Al about Gannon having stomach issues and bleeding out of his butt. She brings up how he is upset about dropping a candle on the carpet.

Text from 8:10 am Jan 27th. Al talks about how text from Letecia says Gannon lit a candle to mask smell from his bowel movements. Al said he doesn't remember Gannon ever lighting a candle on his own accord and didn't usually do that.

Al said Letecia didn't like to deal with cleaning up after Gannon when he had accidents.

On January 28th, 2020 Al and Letecia went to Starbucks and met detectives. Al says Letecia told detectives that Gannon ran away, went to a friends and didn't come home.

On January 28th, Al went to the Sheriff's Office twice to talk to detectives. Letecia did not go with him.

Left first interview, went home to check on the girls. Then he went to go search around and went to French Elementary School to check on the car. When he didn't see the car at the school he called Sheriff's office and said he kind of "freaked out" and they told him to come back.

He said it was the first realization that "she lied" and then she thought that maybe Gannon was in that car.

Letecia texted Al to go talk to her. "I gave in to her request to talk and that's when she told me the first rape story." He said Letecia told him someone came in and raped her and beat up Gannon in Gannon's room. "That was the brunt of the first version of the story.”

Al said she seemed frantic and rushed in speaking but did not cry when telling him this "first rape story.”

Al said after hearing this story, he realized Gannon's room could be a crime scene. His mom and sister were staying in the room so he rushed in and told them to get out of there. He said he alerted authorities and gathered the weapons in his house.

Al said he felt he needed to lock up the firearms in the vehicle because "my first impression was that it was a bulls**** story" He said his military instinct was that if something was going on to make it safer for everyone, he wanted to lock up the guns in the truck.

Once Letecia moved her belongings on January 31st, Al said he doesn't believe he ever saw her in person again. From Jan 31 to the time where pretext phone calls started, they would text and talk on the phone. He said her stories would change during this time frame.

Al said Letecia brought up a story involving a man named Edguardo and said she had given him a code to get in the house to fix the carpet and that he raped her. Al said he didn't know anyone named Edguardo who was in the neighborhood.

We're listening to the first recorded phone call.

First recorded phone call is going to play out. Believe it could be over an hour and a half. It starts with Al asking Letecia "what's up." She talks about how she's hungry because "they took everything" and she doesn't have money to buy food.

She talks about how "they" took her passport and car. She said she called the evidence department several times asking to get her bag to get stuff back. Police asked her why she needed her passport. She said she needs it to do airline job and get on flight.

In first phone call, an automated voice comes on and Letecia's line hangs up. She calls back and says she has to use some random mans' phone because police have everything and is calling on wifi too.

Letecia saying she called CBI to see if they could get involved in the case because she thinks the sheriff's office case "is becoming a witch hunt for one person they are barking up the wrong tree and not following credible tips I told them."

Al asked Letecia specifically what credible things she told police. Letecia breaks up a little bit and goes on tangent about how she's having to use random people's phones to call him.

She said she had to get a paper notarized going through what happened from Saturday to Monday (the day he disappeared). Jan 25-27th 2020.

She said Gannon took out the trash. Starts listing off things. Then she says he went out in the garage barefoot and cut his foot on a plywood board and was bleeding in garage. Al starts to ask follow up questions, seems like he's subtly trying to poke holes.

On call she's saying she heard a pop or loud noise in the storage room Saturday. She "assumed it was a box" falling. She said Gannon said she couldn't come in that he was building something and she "didn't think anything of it.”

Now she's going into Sunday. Lots of random details. But she's wanting to think of "anything she could have said that could have triggered something.”

She tells Al she let Gannon in on a little secret and tells Al "you already know what that was." Something about loosing a baby that he could pray about?

After conversation about "secret," Letecia took Gannon on hike. "You already know from the pictures random creeps took." She said they went on hike and had a lot of talks and conversations about someone named Brian.

Now she's going into night on Sunday and his upset stomach. She said he took a bath with salts to help his stomach.

She said Sunday night in his room he told her he was playing with someone named Greyson. "I was thinking do kids at 11 still have imaginary friends? Or we he talking to them online because he wasn't supposed to be playing online.”

She said she had laid down and heard alarm going off for the house. She walks in living room and put the alarm code in. She said then it was going off yelling “fire"

She said no fire but the alarm was going off. She said she thought to call the security company because something was weird. She then said carbon monoxide alarm was going off. She said she grabbed Laina and gave her the keys and told her to run to the car.

Now she's saying on the call that the footage would maybe show them leaving the house running out after these alarms going off. Al asks for a time so maybe police can look it up on surveillance.

Now she may be speaking to the footage on their neighbor's surveillance showing what police believe is the last surveillance sighting of Gannon. She's referring to getting them into Al's truck and driving the kids around the block.

"I was in shock so I pulled back in the driveway." Al said this is when she realized bubbles on Gannon's arms. Referring to burn marks on his arms.

She said Gannon saw her coming and was on his Switch when he was grounded so something happened leading to a candle falling and starting a fire which burned him.

Lots of details and rambling but she's saying Gannon started fire because he was playing his Switch while he was grounded near a candle and he knocked it over when he saw Letecia coming.

She said the burn situation was Sunday. Now saying Gannon asked if he could stay home on Monday because he’s terrified of having an accident. She talks about his stomach issues, being constipated.

Al asking about the bubbles from burn marks on his arms. She tells him Gannon started to peel the bubbles on his arm on Monday.

"I swear to Jesus I told detectives this. He started to peel it....because he walk talking fine acting normal, I didn't see at that time he was in any type of pain."

She's saying police took her GPS and everything describing why she went to Douglas County to go buy a bike with Gannon.

She talks about how police have her email and "they can see the information in my email coming from craigslist.”

Another hour is left in this first recorded call. Judge is telling everyone to take the afternoon break and come back in 20 minutes.




Break is over. Call recording from February 13th 2020 is playing again. Should be another hour

Letecia saying she called the security company because the alarm was going off. She says there's a sensor on garage door. Al questions that. Now she's saying she was actually saying there was no sensor that she said it too fast.

Had to quickly leave the stream to work on 4pm story. I am back!

Letecia is talking on the recorded about a man having a gun. "I was in complete shock thinking Gannon was hiding."

Letecia on call is telling Al Gannon freely went with someone named Uncle Matt

Letecia getting upset on call saying she begged the sheriff's office to look into a car that was on the side of the house. "Nobody helps me."

Al tells her he's asked neighbors to look at their surveillance and no one has him leaving the house with someone named Uncle Matt.

Al tells her on call "all of this account is blowing my mind. We don't see him leaving, the gun isn't in the house, i'm just trying to figure this all out."


"I feel like they've barked up the wrong tree for two F***ing week Albert." She asks Al "Do you think I did this?" and he said "Tecia Stauch, I don't know.”
"You think I don't want my life back, you think I don't want my family back." Letecia on call to Al

"You have got me on trial for all of this" Letecia says to Al in recorded call when he's asking follow up questions about Gannon picking his fingers and scabs.

"This is where I get angry, people talk all this s*** and they don't even know him." Letecia upset in recorded call following her asking if she told police about a nosebleed Gannon had in his truck back when they lived in Alaska.

She's now crying on the recording call. Al says "Letecia, I don't believe you killed him but did something happen and he's no longer with us?" "I can help you get through this but we got to get the information to help Bubba....you were the last one to hear him speak.”

"You don't think for a second that someone came in the house and took Gannon," Letecia said to Al.

"Put yourself in my shoes. What would you do if this was Harley." Al says to Letecia. She replies "I would have my husband and children together on the phone and we'd be praying and I'd tell detectives I support my husband."

"I'm asking you to stay with your wife and your daughter" Letecia to Al on call

First call just finished. Al is now walking back up to stand to answer questions about it.

Al says at the time of this call, he did not know Letecia's location.

Al said during these calls, something would happen where the call would drop a lot.

Day two of this trial is going to end 20 minutes early because the second recorded call is 30 minutes long. Day three will start tomorrow with the next FBI recorded call at 9 a.m.

DAY THREE: Day three of the #LeteciaStauch trial will be starting any minute now. Al Stauch will continue to testify this morning. We will start with FBI recorded call 2.

Letecia present in court

Second call is underway. Letecia is crying on the recorded call talking about how Al is not there for her at the time. In the courtroom, Letecia has her head down looks like she's covering her ears.

In recorded call two, Letecia is telling Al about how expensive for her and Harley to live out of the house during the search for Gannon. She's telling Al that she used a random man's car to drive to the store.

Al tells Letecia: "You won't tell me where you are saying." she says "Because you are not on my side. You are talking c**** about me."

Al tells Letecia on call, 'I am not on anyone's side' that he is focused on Gannon.

"What are the options?" Letecia asked Al. Al replies "Options don't come into play until you tell me the truth." (recorded call two)

Heard this right before testimony resumed this morning. Judge said they can address it later and in the past he has been inclined to tell jurors to focus solely on the evidence.

A jury member sent a note to the judge saying she was talking to herself and mouthing words. She wanted to know if they should ignore it.

Letecia was upset in recorded call about Al taking her off of the car insurance.

Al: "Yesterday, thank you for talking so long and walking me through your timeline but even yesterday when we we're talking a lot wasn't adding up and it still isn't." (recorded call two)

Al telling Letecia in call that he's seeing red flags in her story and she needs to convince him of the truth.

"You think that I killed Gannon, that hurts." Letecia tells Al on this call that took place on Valentine's day. "If they give me immunity I will help.”

She has now brought up immunity multiple times saying they will be the only terms that she will testify to.

Letecia is asking Al if he's recording this Valentine's Day recorded phone call. "It's just you and me on this phone call?"

"I need immunity," she says crying to Al on recorded Valentine's Day 2020 call.

Al: "Your first thought is what they may do to you and Harley but something's already been done to Gannon, that should be the priority."

Letecia: "I'm not a criminal, I don't kill people." Following a number of asks for immunity. She's crying when saying this in recorded call.

Letecia is hysterically crying and screaming at this point in the Valentine's Day 2020 call. In court currently, her head is down.

You can barely hear Letecia in the recording at this point. Very painful call.

"They are going to try to incriminate me for this, I need immunity" Letecia is yelling and crying. She's going in and out in volume you can barely hear her at points. She's hysterically crying.

Al is trying to get information from Letecia and she's saying she won't say anything else until she gets immunity. He's asking about the storage room.

Letecia mentioned trying to get Al's gun to work. "What do you mean I thought you said that guy had my gun?”

Letecia is begging Al in call to call her back and fight for immunity for her.

Al: "I will fight for you and fight with you if you are not involved in this and tell me this guys' name." Al is asking for a name of someone who may have Gannon.

"You are not jerking me." Letecia yelling to Al while telling him she's not speaking until she gets immunity.

"Did this guy hurt Gannon or did he kill Gannon in the house or hurt him or not?" Letecia responds to this saying she wants immunity. "I will be back when you figure out how to get me immunity.”

She hung up on Al in the call.

Al is now going to go back to the witness stand to answer questions about this call.

DA confirms this call was recorded on Feb 14th, 2020.

Based on previous experience with Letecia, Al says he believes there were times where she was really crying in that call and other times where she was faking it.

Al tells DA he was with law enforcement at the time of this recorded call.

Al says Letecia's personality on this call was consistent to her normal personality. He doesn't believe she was switching personalities and changing voice, etc.

CALL THREE STARTING

Letecia: "Listen to me."
Al: "Let's start over let's get a new beginning here...you've told me 17 different stories here....who has Gannon that's what I care about, who?" Letecia: "Then I want immunity."

You can hear how frustrated Al is after Letecia asking for immunity countless time and telling her multiple different stories.

Al: "Prove me wrong Letecia, prove me wrong" he tells her if these stories are actually true about the rape, about men abducting Gannon, that he will get on his knees in front of the media and apologize to Letecia but he doesn't believe it and wants her to tell him the truth.

Al: "I think there's absolutely no guy there and I understand why that would be on your mind."

Al: "Screw the police right now this is me and you." "I am listening to you, I just need to know what happened.”

Al: "An accident happened here of some sort, you panicked and freaked out and I just need the rest of the story. I just need to know where Gannon is. Is he safe alive somewhere?"

Al: "My theory is this, an accident happened, you panicked now tell me the rest." Letecia: "This is why I want immunity." "I really truly thought that Gannon was going out every day probably talking to somebody...this dude trying to get a bike, he followed me.”

Al says Letecia never proved him wrong.


Al explains, in call three, he was trying to take initial blame off of her and confirm her story to give her freedom to let her feel like she can talk freely.

Call four will be 21 mins it's from Feb 14th, 2020 around 12pm

Letecia in call "Gannon was crying in the seat until her threw up because he was so scared." She's saying he was scared because a man was following Letecia and him while they were in the car.

Letecia now bringing up a name "Uncle Matt" saying she was freaking out because Gannon kept bringing up the name "Uncle Matt.”

Letecia: "My hands were tied that night, tied to the bedroom. Tied completely." She is saying her hands were physically tied and she couldn't do anything. "I was terrified all I could hear was Gannon screaming."

Al: "Letecia can I ask you something, why would you need immunity for that?" He's asking if this man tied her up and hurt Gannon, why would SHE need immunity. Letecia: "Because I didn't tell them." She is crying while saying this.

Al: "Let's stop for a second. This is even more BS than the last 17 stories." He says he's getting frustrated.

Al: "I'm all over the place here?" Letecia: "Yeah, because you're trying to make this out to be all me”

Al: "How can this all be true if you are telling me 7 different versions of the same thing?""You can smirk all you want, hit the steering wheel that doesn't change that you have the truth and I don't.”

Al: "These are the questions I need to know, who is he and who are they." Letecia brings up a name Quincy Brown

Al:"So Quincy brown is the one who has him?"
Letecia is just hysterically crying

Al is asking where Gannon and Quincy were when she heard him screaming. She won't give him an answer and he says "I am fed up, make your mind up”

Al: "Tecia, to me, this is all BS because none of this makes sense, none of the details add up. She’s screaming but you can't hear it clearly on the phone then goes into how she wants immunity again.

Letecia says Al is being a smart a**

Al points out that Letecia keeps referencing to Gannon like he's not her family. "You keep saying I just want my family and Gannon. He's not an and.”

Al: "This is just blowing my mind you are sitting here saying you want us to be a family and Gannon....but you keep lying to me. Five years of lies and now my son's gone. Where is Gannon?" Letecia: "With Quincy.”

Court is now breaking until 10:45 am




Court is back. Al taking the stand to talk about this latest call.

Al: "Where's Gannon. Where's Gannon teacher." Letecia: "I just told you." Al: "There's no Qunicy Brown. Where did you take Gannon. Where is Gannon?" Letecia: "What's wrong with you.”

Letecia: "You're not trying to talk to me. You are trying to put me six feet under that's what you are trying to do.”

Al asked Letecia to send him a picture of Quincy Brown

She tells him she just sent it. Al: "Are you freaking serious Letecia. That's Quincy Brown right here?”

Al asked Letecia to screen shot her Google search of Quincy Brown.

Al: "This is just getting better and better and better.”

Letecia: "I don't have Gannon you can curse me out all you want, F*** all the b****** you want……

Al tells Letecia she should go to jail for the video she took of Gannon that we heard yesterday. Where Gannon is crying on the recording.

AL: I know that you know where Gannon is and that’s the direction I am going in and I’m not changing so you better buckle in. Letecia: You’ll be waiting a long time because I don't know where Gannon is.

Al: You are not in Colorado Springs Tecia send me your location right now. Send it to me right now.

Al says don't contact him until she tells him where his son is and call ends.

Fifth call from same day again Feb 14 2020 - should be 16 minutes

Al tells Letecia this is her chance to talk. He will listen.
Letecia: "Do you love me?" Al: "Yes" Long pause

Letecia: "Alright, if you know it was an accident will you stand by me?" Al says yes Letecia: "I'm sorry about all of the stories I just didn't know what to do.” Crying

She's crying talking about a guy and a bike. Al: Tecia babe how bad did he get hurt? Tecia is crying and saying he was bleeding from his heads, his arms, etc.

Letecia's head is currently down in the courtroom. Head resting on her palms.

Really hard to understand her on the call because she's hysterically crying. She's saying she's sorry and it was an accident.

Letecia says there was an accident and she's hysterically crying saying she was trying to figure out where "he" took him.

Letecia says she was driving all over to try find "this dude”

Letecia: "Those weren't bad burns Albert, those will small burns from the fire.”

Letecia: "I didn't ask for immunity because I did some type of crimes.”

Letecia said "It was pretty bad" talking about Gannon bleeding and is crying.

Letecia hung up on him in call.

Al said this call was the first time Letecia ever told Al that Gannon had a head injury.

Al now on the stand looking at book of text messages between him and Letecia.

Al said he and Letecia started dating in 2014 so they were together roughly six years.

Al says throughout their relationship there were moments where he could see she definitely knew right and wrong. Referencing when she took the kids on a hike safely. Right and wrong example with disciplining Gannon with taking Switch away when Gannon got in trouble.

After the 27th (day Gannon went missing) Al notes how Letecia acknowledges right and wrong in telling him how he should be acting as her husband.

Al is getting emotional saying if if there was nothing going on in that house, why wouldn't she let Laina in the house after school.

Al said he did not notice any major crack in Letecia's mental health. He said he wouldn't have left for Oklahoma had he noticed any signs of a crack in her mental health condition.

Al said he tried to get a hold of Letecia on Jan 27th, day of disappearance. He said he tried to call and text at one point in the afternoon and she didn't answer.

Al: "I believe she is and was 100 percent absolutely sane based on what I witnessed and laid out. I have no indication of anything else...from the time I met her to today."

Prosecution ends their questioning of Al Stauch with him saying he believes she was sane the time of the murder. Now defense is preparing to cross examine Al

Court is going to take lunch and cross examination will start at 1pm.





BACK IN SESSION. Defense starting cross examination.

Defense is asking about custody of Gannon and Laina between Al and their biological mother Landen.

Tolini is asking Al to verify if something is written in Gannon's handwriting. Al says he can't because he hasn't seen his handwriting in three years.


Al said his mom is a nurse practitioner in the mental health field. He told defense that he has raised concerns about Letecia's mental health to his mom.
Al: I don't ever remember having the thought Landen was involved in any way. She loved her children.

Al reiterates to defense that his suspicions of Letecia started when he didn't find her car parked at the elementary school, where she told him it was.

Al: “My intent was to find my son...My intent was not to hold someone accountable I wanted to hold my son and wrap my arms around him and that's it."

Tolini: You become more and more frustrated with the cockamamy stories she tells you on Feb 14th.
Al: More calculated than frustrated.

Tolini: I mean none of these stuff, it’s ridiculous? Al: Is that what you're saying? Tolini: Would you agree with me? Al: Of course.

Tolini: She told you all of this is a blur. I got up and hoped it was a dream. Al: Ok.

Tolini brings up that, on the call on the 14th, Gannon refers to herself as Tecia when talking about not knowing where Gannon is. Al says he doesn't remember that.

Tolini says Al told detective being with Letecia was like being on a roller coaster.

Al tells Tolini that in the past, Letecia had mentioned one of her step fathers' allegedly sexually abusing her.

Al said he doesn't remember her explaining a pattern of abuse thinks it was an isolated event she told him about.

I know at some point she saw someone about anxiety and got a prescription for something.
Tolini: When you interviewed with detective the first time, were you having concerns about her involvement? Al: Yeah

Tolini: So you told the detective that Harley would say her mom is freaking nuts, crazy? Al: That's what I said

Allen: Did she have a severe mental health disease or defect back then? Al: No sir

Al says he believes Letecia has anxiety but carried herself and functioned normally.

Al is finished and second witness is called, Macon Ponder. He is from Panama City, Florida.

Macon is the senior underwater bridge inspector in Panama City.

Ponder talking about the bridge, Escambia River Bridge, near Pensacola.

He was inspecting bridge and noticed the suitcase.

They were lowering to the ground on the inspection. They remembered seeing the suitcase and then went back to it when they finished the inspection. Prosecutor: "Why did you go back to the suitcase?" Ponder: "Pure curiosity."

Ponder: "I remember saying I don't know what's in this but it's very heavy.”

Ponder said the odor was so strong he thought there was something dead inside of the suitcase. "The smell was so overpowering we took a step back and the first thing I remember seeing was two little feet." He remembers the little socks on the little feet.

Remembers a lot of bedding in the suitcase, a lot of bedding. Said body was in the fetal position partially wrapped up and he turned his head.

One of the bridge inspectors was a volunteer firefighter. They immediately called 911 and ended their inspection.

Going through pictures of the bridge with the inspector.

Ponder pointing to where they found the suitcase. He also just identified the suitcase.

He said where the suitcase was found, it looks like it was thrown right over the bridge and it looked like it fell at an odd angle.

Will Cook with defense is starting cross examination of bridge inspector now.

Bringing up how Ponder said the suitcase was really heavy and felt like it had been waterlogged.

Ponder's finished testifying. Now afternoon break until 3:10 pm.



Next witness Jason Yoder. He's a criminal investigator with Escambia County Sheriff's Office in Florida

Yoder describes the same socks the bridge inspector noted when finding the body. He says they were small socks with footballs on them.

They found the body March 17th. Called investigators here in Colorado saying they think it might be Gannon.

Yoder says there are much larger bridges with deeper water than the one where Gannon's body was found.

Detective Yoder doesn't think there would be a lot of cars driving by on the bridge at time,

Next witness. Major crimes detective with El Paso County Sheriff's office. They didn't have him spell his last name so I'm working to confirm it.

Detective recalls processing evidence from Gannon Stauch.

Detective putting on gloves and scissors. He's being asked to open up an evidence envelope but leave evidence inside just so he can identify it.

He said it's a toothbrush inside of a holder that was brought to them.

Next evidence item is a comb.

Next evidence is scrub brushes and scissors that detective says Al told him he found in the dishwasher. He said the brushes had some carpet fibers on them.

He called them a strand of carpet.

Empty vinegar bottle in trashcan another piece of evidence.

Back with another member of the El Paso County Sheriff's office. He was a patrol deputy back in January 2020. Didn't hear his name.

He had body worn camera from the call.

We are hearing the body camera of Letecia taking police through the house after reporting Gannon as a runaway. They tell her kids sometimes hide so they wanted to search the house and she complied.

She's telling them on body camera about how she had to cut the carpet because of the candle falling.

Body Camera video is being played from Deputy Parker's body camera.

You can hear Letecia telling Deputy that the neighbors have been "awesome" and doing a lot of the work to help search for Gannon. She's laughing while telling him about Gannon's switch.

Letecia telling deputy he was supposed to be home at six and was at a friends house and didn't come home.

Letecia on body camera: "I am almost positive he is with someone he knows because he searched on his phone can my parents find me if my phone is off”

Letecia saying he also search bath salts.

She said the only thing missing is Gannon's game to police.

She tells police he left his phone and wallet. She is bringing up that he searched info about parents finding before hand.

The next witness called to the stand is Dr. Leon Kelly, the El Paso County coroner, and chief medical examiner.

Dr. Kelly spoke about when he became involved in the criminal investigation of Gannon Stauch’s murder. He said the medical examiner’s office in Florida weren’t able to definitively identify Gannon, so Dr. Kelly's office helped, and were able to positively identify Gannon.

Currently, EPCSO detective Marissa Williams is testifying to Stauch's mental state at the time of their interview on Jan. 29, 2020. Williams described Stauch's demeanor as "evasive" and that Stauch was "upset, but not in the same way you would expect of a parent missing a child.”

The next witness called to the stand is Janine Sanchez. In January 2020, she was living in the Lorrison Ranch neighborhood. Sanchez also worked with Harley Hunt, Letecia Stauch’s daughter.

Sanchez said she and Harley picked up Letecia from the hospital on Wednesday, January 29. Sanchez said Letecia got in the car, “just jokingly, she (Letecia) was joking about saying basically, ‘hope you don’t think we’re a bunch of murderers.’”

Sanchez said that Letecia started using Harley’s phone, then Letecia sent a text to her from the back seat, asking if she could stay at Sanchez’s home. Sanchez said she found this weird and strange, because all three of them were in the car together.

Sanchez said, “Harley was just wanting to stay at my house because she didn’t really feel comfortable at her own house. I'm not sure why her mom wanted to stay at my house. With the texting thing, that was kind of odd. So I just let them both stay.”

Hearing testimony currently from Janine Sanchez a former co-worker of Letecia Stauch's daughter. Sanchez stated that on Jan. 29, 2020, that Stauch told her "I hope you don't think we're a bunch of murderers," when the three of them were in the car together.

Additionally, Sanchez stated that Stauch turned off her daughter's location services on her phone while they were in the car together.

Both Stauch and her daughter stayed at Sanchez's house the night of Jan. 29, which Sanchez said was "strange.”

To clarify, Sanchez thought it was strange that specifically Stauch asked to stay at her house. Not Stauch's daughter.

A neighbor of Letecia Stauch's just testified that in a text conversation with Stauch in late Feb. she asked for help finding a witness to say they saw someone leaving her house with a suitcase the night of Gannon's disappearance. "I need a witness," Stauch said in one text.

During these texts Stauch tells her neighbor the story that someone had broke into her home, assaulted her and took Gannon. Similar to the story she had tried to tell her husband, Al Stauch, in the past.

"What if you just said you remembered something suspicious seeing this picture? And explained the description and you didn't think it was relevant until now. Because the kid had the same cover,"

Stauch said after sending a photo of Gannon with the blankets his body was later found with. "I swear to you I dind't do this. I just need help with someone getting this out there so they can start posting in other states.”

No significant cross from the defense on this witness, now wrapping up for the weekend. We will be back in court on Monday where testimony is expected regarding Gannon's autopsy.

COLORADO SPRINGS — On Friday, jurors in the Letecia Stauch trial learned more about the evidence in the case, including the suitcase Gannon's body was found in, the 12-hour stay at a Florida hotel a week after her stepson disappeared, the local school she just got hired at, and suspicious text messages with her neighbor.

The trial will resume on Monday morning at 9 a.m. as more witnesses take the stand to testify. We’re expected to learn more about Gannon’s autopsy from Florida.

EL PASO COUNTY, Colo. (KRDO) -- During opening statements Monday afternoon in the murder trial for Letecia Stauch, the El Paso County woman accused of murdering her 11-year-old stepson, the defense admitted she did commit the crime - just that she had "no idea" what she was doing.

Gannon Stauch was first reported missing from his Lorson Ranch home on Jan. 27, 2020. His stepmother Stauch was arrested in early March 2020 for his death. Later that month, on March 17, 2020, his body was found stuffed in a suitcase under a bridge in Florida. According to the autopsy, he had been shot, stabbed, and he had a skull fracture.


Jury selection ended Monday morning and opening statements began at 1:30 p.m. with the prosecution.

Letecia Stauch murder trial Day 3 in El Paso County | KRDO

Grim testimony came in the afternoon from Macon Ponder, a Florida Department of Transportation bridge inspector who found Gannnon's body, and Jason Yoder, a major crimes detective with the Escambia County Sheriff's Office -- an agency that covers two counties of the same name at the Alabama-Florida state line.


Ponder said that he and a co-worker were conducting a regular inspection of the Escambia River Bridge, just north of Pensacola, Florida, when they found a suitcase near a pillar under the bridge.
