4/26/23

Dr. Grimmett said she didn’t see any signs that Letecia Stauch was changing personalities. She said she considered dissociative identity disorder as a diagnosis. She also said she has never reviewed someone with dissociative identity disorder.

Dr. Grimmett said dissociative identity disorder affects up to 1% of people. She said it’s a very destructive behavioral disorder and can be very frightening because people don’t know what’s happening to them.

She added dissociative identity disorder can be strange, and people can’t hold down jobs or hold down relationships. She said when talking to Stauch, Stauch’s history didn’t support that.

Werner stated that there would be no testimony allowed regarding what was discussed during this visit. Prosecution just called its final witness for trial, Kevin Clark, a former CSPD analyst and current investigator with the the Judicial District.

Clark, who has testified a couple times in this trial previous to today, so far has spoken about evidence recovered showing Stauch coming and going from her home on Jan. 27 and 28th, and searches on Stauch's phone for a fake polygraph exam.

The last hour and a half Clark has reviewed a detailed timeline of Stauch’s whereabouts and actions with the prosecution starting on Jan. 26, 2020 - the day before Gannon was allegedly killed - referring to evidence and testimony discussed at previous points in the trial.

COURT LUNCH RECESS

Breaking for lunch, Clark is in the middle of reviewing Stauch’s actions in the early morning hours of Jan. 28, 2020. His testimony will continue after the lunch break with more reviewing of the timeline.

Back from lunch, we are resuming with Clark's testimony regarding the prosecution's alleged timeline.

Clark a few moments ago told the prosecution that he believes Gannon was in the trunk of Stauch's car at the Colorado Springs airport parking lot on Jan. 28, which is why Stauch opted to pick up Al Stauch in a rental car that morning.

The morning began with learning that the defense’s forensic psychologist met with Letecia Stauch at the jail for about three hours yesterday. One prosecutor said, “I’m at a loss,” because he doesn’t know what was discussed.

He said he wants to meet with the defense's forensic psychologist before she testifies so he has the ability to cross examine her.

The next witness to be called to the stand is Kevin Clark, who used to be an intelligence analyst with the Colorado Springs Police Department. He’s now the Director of Crime Strategies and Intelligence for the District Attorney’s Office.

Clark is now describing the neighbor's surveillance video just after 2 p.m. on January 27 of Letecia Stauch and Gannon Stauch returning home, and video just before 6:30 a.m. on January 28 of Letecia leaving for about ten minutes then returning home.

Clark testified saying it wasn’t typical for Letecia Stauch to back into the driveway or garage, but on the day Gannon disappeared and the day after, she was seen backing vehicles into the driveway.

Clark said Letecia Stauch used her phone frequently. He said her phone was not being used on the day Gannon disappeared from late morning to early afternoon, when her and Gannon were at Petco, and also when she returned home, the phone wasn’t being used for a period of time.

Clark is testifying about what he found on Letecia Stauch’s third phone which seized in South Carolina. In the notes section was a note from February 19 titled, “In the case of a missing child Gannon Stauch…”

A few other questions in the note include: Did you accidentally hurt him in a physical way? Did you murder your stepson? Do you know personally who was involved in your stepson’s disappearance?

Clark also described web history on Letecia Stauch’s phone from February 20. He said the user searched “fake polygraph test” using Google. Ten minutes later, a fake polygraph website was visited, and after that the payment screen to pay for a fake lie detecter test was visited.

After that, the user of the phone then Googled, “Can you get away with fake lie detector website?”

Clark said on the evening/night of January 28, Letecia Stauch’s iPhone was placed on airplane mode and off the network just after 7 p.m. Around 9 p.m., data from her Tiguan shows the vehicle was at the S curve near Palmer Lake, where the blood-stained board was found.

Clark said Stauch's phone didn't die or run out of battery, but it was off of the network around 9 p.m. The phone was locked and unlocked several times.

Clark is now reviewing a timeline of events on Sunday January 26, the day before Gannon disappeared. 6:55 a.m. - Al Stauch’s flight leaves DIA 2 p.m. - A trip to Garden of the Gods with Letecia, Gannon and Laina 3:15 p.m. - Harley clocks in at work at Massage Envy

3:41 p.m. - Selfie photo taken of Letecia, Gannon and Laina 4:46 p.m. - Letecia, Gannon and Laina return home, Harley is still at work 9:46 p.m. - Video taken from Stauch’s phone where you can hear Gannon say, “I’m just worried about my burns.”

Clark said there was no indication that Gannon was outside the home yelling that night. 9:57 p.m. to 10:15 p.m. - text messages between Letecia and Harley about the candle incident involving Gannon 11:30 p.m. - text message from Letecia to Al about the candle incident

On the morning of January 28: 2:48 a.m. - text message from Letecia to Al about how Gannon won’t be going to school and she’ll also be calling off work

Around 3 a.m. - Letecia sends a text message to Leslie Hicks, the assistant principal at the school she works at. Letecia said her stepfather passed away and she won’t be going to work.

5:03 a.m. - more texts from Letecia to Al saying she’s exhausted, and Gannon felt really bad about the burned carpet 5:49 a.m. text from Hicks asking Letecia if they should find a substitute for today

8:14 a.m. - photo taken of Gannon sleeping in his bed, Letecia sent this photo to Al 8:30 a.m. - Harley clocks in at work 8:43 a.m. to 8:50 a.m. - more text messages between Letecia and Al about Gannon asking about bath salts and hanging out with friends

9:27 a.m. - text messages between Letecia and Harley, where Letecia screen-shotted conversation about bath salts and sent it to Harley 9:54 to 9:59 A text message to Al from Gannon’s phone saying Letecia left her phone at home, and to call Gannon’s phone if needed

10:12 a.m. - Letecia and Gannon left home to go to Petco. There was a four-hour period with no activity on Letecia’s phone. The next phone activity on Letecia’s phone was around 2:30 p.m.

2:26 - 3:23 p.m. - no activity on Letecia Stauch’s phone 3:15 p.m. - Laina gets home from school 4:19 p.m. - Harley gets off of work 4:51 p.m. - Harley and Laina leave the Stauch home to go to the Dollar Tree to buy cleaning supplies and cleaning products

Clark testified saying he believes Gannon was killed prior to Laina getting home from school. 6:27 p.m. - text message from Letecia to Al saying Gannon wasn’t home yet 6:39 p.m. - text message from Letecia to Al saying she’s going to drive around and look for Gannon

6:54 - 6:58 p.m. - Letecia makes several phone calls to law enforcement to report Gannon is missing 7 - 8 p.m. - more text messages with Letecia, Harley and Al all texting and calling one another at some point. They’re all trying to find more information about where Gannon is.

8 p.m. 10 p.m. - more phone calls and text messages between Al and Letecia Stauch 10:03 p.m. - outgoing call from Gannon’s phone to Landon phone, who is Gannon’s mother. Clark testified saying it was Letecia using Gannon’s phone, and Gannon was not alive at that time

10:09 p.m. - El Paso County Sheriff’s deputies arrive to Stauch home 10:10 p.m. to 11:49 p.m. - More text messages and calls between Al and Letecia Stauch 11:49 p.m. - deputies leave Stauch residence

Clark testified saying other than the first drive with Laina in the afternoon, data and records indicate that Letecia never left the home after that. Clark said it appeared Letecia was on social media more, instead of looking for her stepson.

COURT LUNCH RECESS

Clark has resumed the witness stand and is reviewing a timeline of events on Tuesday, January 28, the day after Gannon disappeared. Clark said there was no evidence that Letecia Stauch went searching for Gannon that morning like she claimed in text messages to Al.

At 8:30 a.m., Letecia Stauch drove her Tiguan to the Colorado Springs Airport to pick up Al. Letecia left the Tiguan in the parking lot before renting a Kia Rio. Clark testified saying Gannon’s body was in the back of the Tiguan.

Letecia then texted Harley and asked her to move her vehicle into the garage. Clark testified saying there was blood on the wooden boards that the car would have parked over.

At 4:41 p.m., Letecia Stauch returns to the airport and doesn’t return the Kia Rio. Clark testified saying it seemed to be a quick check of the Tiguan still parked at the airport.

Between 6 p.m. and 6:50 p.m., Letecia Stauch’s phone data indicates she was at the Stauch home, then went back to the airport in the rented Kia Rio. Clark said Letecia did not return the car properly, and instead it was found the next day in short term parking.

Clark testified saying this is when Letecia got her Tiguan with Gannon’s remains, and left the airport.

Just before midnight on Tueday, January 28, Letecia left the Tiguan in the parking lot at the Holiday Inn, and got into Harley’s car. Clark testified saying Gannon’s body was no longer in the back of the Tiguan at this point.

On the morning of January 30, after Letecia and Harley spent the night at Janine Sanchez’ house, there is a chain of text messages between Harley Hunt’s phone and Al Stauch.

Whoever is using Harley’s phone said they want to go to the Stauch home and pick up their belongings without being bothered.

Clark testified saying he believes it was Letecia using Harley’s phone to text Al. Harley Hunt’s phone: “You set my mom up so you could be with your ex wife. I hate you.” Al: “Well I love you. I’m sorry that you feel that way.”

In the early afternoon of January 30, Letecia Stauch did an interview with KKTV. Clark testified saying that Letecia mentioned Gannon’s name about a dozen times during the interview. Clark then said Letecia mentioned “I, me, or my” more than 100 times.

On January 30, Letecia drove a rented Nissan Ultima with a GPS tracker on it. Clark testified saying that around 3:30 and 5:30 p.m. is when they believe Letecia drove to the S curve in Douglas County and picked up the suitcase that had Gannon’s body in it.

Previous testimony also indicated a blood-stained piece of wood was found in that area, and the blood matched Gannon Stauch's.

Clark goes on to testify that he believes in the evening of Jan. 28, Stauch drove to Douglas County to dump Gannon’s body, before picking it back up on the 30th and dumping his body again in Florida on Feb. 4. The timeline ended when Gannon’s body was found in Florida on March 17

Clark has made this timeline primarily by using evidence and testimony previously admitted over the past four weeks including phone records, text conversations, tracking data and more.

Clark is also reviewing google searches from Stauch found on her phone that was take upon her arrest in South Carolina, which include topics like: How to hide IP address Need a fake ID Face transplant/changing her appearance And updates regarding Gannon's disappearance

A few amused faces among the jury as Clark reviews these searches, a few other jurors appear to be struggling to stay awake.

Allen just made mention of the fact that Cook and Stauch have been looking at the exhibits on the computer and laughing over the last like 10 minutes or so. "I don't know what's so funny over here judge," Allen just said.

Some other searches from Stauch's phone include: "What do they do when they find a body in another state." "How do they identify bodies found in another state." "Spanish girl names” "How long before a body starts to decompose in a bag." "Address of drug cartels."

Clark's testimony just concluded, that should be the prosecution's final witness.

Allen said the prosecution will rest its case tomorrow morning. Defense's first witness will also testify tomorrow morning.

The defense is calling their first witness to the stand, Dr. Ronda Niederhauser, who is a clinical psychologist on Fort Carson. Dr. Niederhauser met with Stauch twice in December 2019.

Dr. Niederhauser testified saying Letecia Stauch came to her because of her anxiety symptoms, stress, and sleeping problems. Stauch told Dr. Niederhauser that most of her symptoms were work-related.

Dr. Niederhauser said Stauch told her that she felt like she was being harassed at work because she stood up for someone who has being harassed.

Dr. Niederhauser said Stauch wanted to quit her job and find another teaching job at another school district. Dr. Niederhauser said Stauch told her that the district she was working at wouldn’t allow her to quit because she was under contract.

Dr. Niederhauser said she provided a letter to Stauch to give to the school district, recommending she step down from the job. The doctor also recommended a medication and therapy to Stauch.

Cross examination for Dr. Niederhauser is underway. During cross examination, she testified saying Stauch didn't appear to be suffering from a severe mental health illness, her memory and judgement was not impaired, her speech was normal, her tone was appropriate, etc.

That was the end of testimony from Dr. Niederhauser, the clinical psychologist at Fort Carson. The defense will call their next witness to the stand at 1 p.m. The court is in recess until then.

First witness for the defense is Dr. Ronda Niederhauser

Niederhauser is testifying that she had met with Stauch on two occasions in 2019 and diagnosed her with anxiety, and prescribed her medicine to treat it.

On cross-examination Allen is confirming that moderate anxiety was the only thing Stauch was diagnosed and treated for by Niederhauser.

Niederhauser, the defense's own witness, just testified that she did not believe Stauch was suffering from any serious mental illness when she met with her in 2019. "If I had concerns about her... I would have placed her on a 72 hour hold," Niederhauser said.

Defense's second witness, who I assume is Dr. Dorothy Lewis, isn't going to be called until 1:00 p.m. today, so going to be a bit of a break. Think in the meantime attorneys will review jury instructions and things like that.

Judge Werner said the earliest that closing arguments will happen is on Friday, even if trial finishes early today. He said he wants the prosecutors and the defense to have time to prepare.

The murder trial for Letecia Stauch is resuming now. Dr. Dorothy Lewis, who conducted a sanity evaluation on Stauch, will be testifying. There's been about a 15-minute delay due to the witness being in transit.

Judge Werner is telling Dr. Lewis that she cannot testify about her 3-hour meeting with with Letecia Stauch and Josh Tolini on Sunday, and cannot testify about anything she learned during that meeting.

Dr. Lewis also cannot testify about a softball incident where Stauch said she got a concussion, because it’s not in her report that was submitted as evidence prior to the trial beginning.

Judge Werner is telling Dr. Lewis that she can only testify about what’s in her report, and cannot testify about anything outside of her report.

Dr. Lewis testified about her work in juvenile court, in psychiatric wards and hospital, at maximum security prisons and her work with dangerous people or people on death row.

Much of her work has also been working with people who have multiple personality disorder, now known as dissociative identity disorder.

According to research I’ve done, Dr. Lewis has examined notorious murderers like Ted Bundy, Arthur Shawcross, Mark David Chapman, and others. She has also testified as an expert witness for the defense in these high-profile criminal cases.

Dr. Lewis said she has worked with anywhere between 100 and 200 adults on death row, many of whom had multiple personality disorder or dissociative identity disorder.

“Over the years, as I was confronted with more obvious kinds of cases, and sometimes people had diagnosed something, I had became more aware of what this disorder was like," said Dr. Lewis.

Dr. Lewis said she is currently board certified in psychiatry. The defense asked to qualify her as an expert witness in psychiatry. Prosecutors then questioned her about not having a license to practice medicine in the state of Colorado.

After some questions from prosecutors, Dr. Lewis was qualified as a witness expert in psychiatry.

Dr. Lewis is now testifying about her 14-hour evaluation of Letecia Stauch. It took place in November 2022 at the El Paso County Jail. Josh Tolini, Stauch’s attorney, was also there during the interview.

Dr. Lewis testified saying she reviewed Letecia Stauch’s case including all the evaluations conducted by the forensic psychologists, incarceration records, jail documents, etc.

Tolini said jurors during deliberations will be able to observe the 14-hour interview between Dr. Lewis and Stauch.

Dr. Lewis is now describing dissociation and how it works, both minor and severe.

Dr. Lewis: “We do know what causes it. When young children are subjected to ongoing physical or sexual abuse, where it's intolerable, where you can’t cope with it anymore, the mind seems to self-hypnotize. It is as if it were not happening to you. It’s happening to someone else."

Dr. Lewis said, “It’s very common for that other aspect of that person to take on the characteristics of the abuser. This may be why it’s so astonishing.” She said some people may recognize what they're doing, while others do not. "It can cause disastrous effects."

AFTERNOON COURT RECESS

  • #650

Back in court where the defense's expert, Dr. Dorothy Lewis, is about to testify. Dr. Lewis I believe should be the final witness for trial, unless Stauch herself opts to testify.

Dr. Lewis is currently reviewing her background with Tolini, she is undeniably a very accomplished person. Her wiki article here is an interesting read for those curious:

Prosecution is taking issue with Lewis being qualified as an expert at all, Dave Young is talking about how she is not licensed to conduct sanity exams or practice psychology in the state of Colorado.

Lewis said that it should not be an issue because she is licensed in three separate states and doesn't maintain one because there should be reciprocity with the licenses she holds currently.

Despite the issue with the prosecution Judge Werner qualified Lewis as an expert in psychiatry

Lewis is talking about her sanity evaluation of Stauch, diving into the alleged significant trauma Stauch suffered as a child at the hands of the men her mother dated growing up. Lewis alleges that this trauma is the cause of Stauch suffering from dissociative identity disorder.

Lewis also stated that she believes she spoke with one of Stauch's alleged personalities "Maria," during one of her interviews.

Much has been made of the Maria personality, we heard testimony last week that Stauch told the forensic psychologist with the state hospital that Maria was the personality who killed Gannon.

"I don’t think she knows for sure what happened," Lewis just said regarding Stauch killing Gannon. Lewis is talking about how despite Stauch "not being a stupid girl" her making up "silly" stories that nobody could possibly believe points to her diagnosis of DID.

Lewis has also just made reference to alleged reports from the jail where guards saw Stauch "talking to people who weren't there."

How is the jury reacting to this witness? Are they engaged, bored, indifferent?

AFTERNOON COURT RECESS

  • #651
5/2/2023 -- TRIAL DAY 18

Dr. Lewis testified about Stauch’s upbringing, including what Stauch told her and what had been reported in her medical records. Dr. Lewis said it was hard for her to keep up with the numerous males Stauch's mom was seeing, who were aggressive.

Dr. Lewis testified saying Stauch referred to her step dad as “Jack*ss James.” Dr. Lewis said he was one of the people who sexually molested Stauch, to her knowledge. Dr. Lewis also said Stauch said she ran away from home and hid in the woods because she was terrified.

Dr. Lewis: “When I was interviewing her, suddenly it seemed to me like she was speaking Russian… It looked as though as if she had switched into a different entity. I do believe she thinks she was speaking some other language… That would be a coping mechanism."

Dr. Lewis: “The one that I remember particularly is she referred to somebody named Maria, and Maria apparently was a physically abusive entity, and when I heard her speak, she was harsh and angry and hurtful.”

Dr. Lewis: “In fact, it made me wonder when I first saw that, have I just met the aspect of her personality that killed Gannon? I don’t know. At the time, she’s the one that’s most closely alive with violence.”

Several times, Dr. Lewis said Stauch is not stupid, adding that she was a teacher. “She was an amazing woman in this way, she’s not stupid.” Dr. Lewis also said that Stauch told her about all the events leading up to Gannon’s death and the stories she told.

Dr. Lewis: “There were numerous descriptions, mindless descriptions of what might have happened to this child. What puzzled me is that when you talk with her, this is not a stupid girl. She is intelligent. She is in certain states, able to reason, speak logically, and clearly."

Dr. Lewis: "Yet she makes up the darnedest stories, that no person below the average intelligence would have believed. I don’t think she knows for sure what happened to Gannon.”

Dr. Lewis said several times Stauch would look around the room and talk to someone who was not there.

Dr. Lewis said after the candle incident, Stauch said that she had visions of her stepdad and seeing him alive, like driving in a car, and seeing him on the side of the road. Dr. Lewis said these are visual hallucinations.

Dr. Lewis said when Stauch texted the assistant principal at the school she was working at, that her step father died, “This is something about the way her mind is working that is distorted and is not in touch with reality.”

Dr. Lewis: “She has many of the signs, symptoms and behaviors of dissociative identity disorder… They are psychotic. They are incomprehensible by an ordinary human being.”

When asked about her opinion on Letecia Stauch’s sanity when Gannon was murdered, Dr. Lewis said, “She was psychotic at the time. She was not in touch with reality, and I don’t think she knew the difference between right or wrong. I don’t think she even knew what she was doing.”

Cross examination is underway for Dr. Lewis. Prosecutors are questioning her how she defines insanity in the state of Colorado, to which she could not give a definition for by Colorado law.

Prosecutors questioned that further, and why she would say Stauch was psychotic or insane when Gannon was killed, despite not having EEG or MRI exams that she had requested prior.

Prosecutors said the defense withdrew its request for an EEG and MRI on October 13, 2022. Dr. Lewis said this was news to her.

Dr. Lewis testified that Stauch’s lawyers did not put her in contact with Harley Hunt, or any other family members of Stauch as she was conducting her sanity evaluation.

Prosecutors questioned why Dr. Lewis testified today, even though she didn’t have the exams done that she wanted done, which included the MRI and EEG.

Dr. Lewis was also questioned why she wasn’t here at 9 a.m. this morning. She was also questioned why she gave her sanity evaluation report to prosecutors four days before jury selection began. Prosecutors: “Do you have a disregard for the rules here?”

Prosecutors: “When do you think her dissociative identity disorder started?” Dr. Lewis: “I don’t know with her.”

COURT IN RECESS UNTIL 5/3/2023 --DAY - 19

“She was psychotic at the time, not in touch with reality, and I don’t think she knew the difference between right and wrong. I don’t even know if she knew what she was doing,” Lewis said. Tolini just passed the witness to the prosecution for cross-examination.

Young is taking serious issue in cross with the fact that Lewis does not know the exact definition of the insanity plea in the state of Colorado. Lewis also just added that she believes Stauch murdered Gannon.

"I very much doubt with what I am saying to you will conflict with what you are saying," Lewis said.

This has been a rather heated cross-examination, where Young has implied that Lewis did not do a thorough job in her examination of Stauch, and thus shouldn't be testifying, and that she has a "disregard for court rules."

COURT IN RECESS UNTIL WEDS, 5/3/23

  • #653

Defense attorney’s filed a motion to drop all the charges against Letecia Stauch, but specifically first-degree murder premeditation. Her lawyer, Josh Tolini, said there’s been a lack of evidence that the murder was premeditated by Stauch.

District Attorney Michael Allen said there’s been more than enough evidence of premeditation, including the searches found on Stauch’s phone before Gannon's disappearance, like searching for a one bedroom/one bath apartment in Florida, and employment opportunities elsewhere.

Cross examination will continue for Dr. Dorothy Lewis, a psychiatrist who conducted a sanity evaluation on Letecia Stauch. Yesterday, cross examination from Prosecutor Dave Young got heated as he pressed Dr. Lewis about her credibility and evaluation on Stauch.

Young asked about dissociative identity disorder and the controversy around it. Dr. Lewis: “The essential controversy is whether people believe it exists or not.”

Young asked Dr. Lewis how she knows if someone is acting out their symptoms. Dr. Lewis: “What I do is be able to show that there were unmistakable signs of switches, changes, different states, and different abilities to function, long before I was ever asked to be in any case.”

Dr. Lewis said she remembered in her notes about Stauch, “someone had said when she was younger, she asked to be called Maria… That in and of itself is not a proof of anything, but it’s a confirmation if you have a lot of other things that go along with it.”

As Dr. Lewis is describing her notes about one of Stauch’s relatives saying she called herself Maria Sanchez, District Attorney Michael Allen is shaking is head no

Young told Dr. Lewis, “Your obligation as an expert is to turn over all information… Why was that not in your report?” Dr. Lewis: “This is an observation as you go through hundreds of pages of notes, so I’ll jot it down and think gee, that’s kind of interesting.”

Young asked Dr. Lewis if she considered that all of Stauch’s family members said they didn’t notice Stauch showing signs of dissociative identity disorder. Dr. Lewis: “I didn’t think about that specifically… it’s interesting that they did not notice this.”

Young: “Do you think anyone who commits murder has a brain injury?” Dr. Lewis: “No.”

When talking about Stauch calling Gannon’s school saying he would not be there:

Dr. Lewis: “It’s a puzzle why she called in saying that he could not go to school.”

Young: “So it had nothing to do with planning?”

Dr. Lewis: “I don’t know, it could’ve had to do with planning.”

Young asked about the fact that she used three separate instruments to kill Gannon asking, “Does that tell you she has the capacity to inform the intent to kill?” Dr. Lewis “I don’t know… I can’t be certain what was going on in her head.”

Dr. Lewis: “I don’t know why she had a gun in her hand or why she shot Gannon… It is not clear, that she simply wanted to kill. This is a child she loved. If we want to believe what other people said, she loved Gannon.”

Dr. Lewis: "This is simply psychotic… Did she kill that boy? Did she remember what had happened?”

When asked if Stauch knew right from wrong when she put Gannon’s body in the back of her car and drove it to the airport:

“I don’t feel qualified to conclude that. She certainly had the capacity to move it from one place to another… whether or not she felt this was right or wrong, I can’t speculate,” said Dr. Lewis.

“Any speculation is possible… If the body is in your car you may want to avoid going anywhere near that car,” said Dr. Lewis.

“She had the capacity to know that she needed to hide the body. I can’t move on to say, yes, she knew right from wrong,” said Dr. Lewis.

“I find crazy what you find logical… It’s crazy when you say Eduardo comes and rapes her and takes off with Gannon. The whole concept is crazy… The whole story of Eduardo is crazy,” said Dr. Lewis.
J
urors will be seeing clips of the sanity evaluation Dr. Lewis conducted on Stauch in November 2022. Young: “Going into this interview did you have any concerns that Mrs. Stauch may not be truthful with you?” Dr. Lewis:

“Of course.”

In the interview, Stauch said that she calls her lawyer Josh Tolini by his first name, Josh, but she said her alter-ego of Maria calls him a**hole in Spanish.

Stauch is describing her ego named Jasmine, saying she has a lot of risky behaviors, gets in trouble, drinks a lot and parties a lot. “I’m not a partier,” said Stauch.

Stauch: “I can be at work and be okay and then something really stressful happened, and then I’ll end up on a plane somewhere… My body goes through the motions.”

Dr. Lewis is testifying about when Stauch said she talked to a friend in Russian, and at one point, Stauch began speaking to Dr. Lewis in what sounds like Russian. “It ain’t Russian, it’s some kind of entity that sounds like Russian,” said Dr. Lewis.

Stauch: "I am all over the place... It was not my intention to hurt Gannon. No, absolutely not. I loved Gannon... It would not be to hurt a child. Absolutely not.”

Stauch: “I’m being projected as some monster, and you don’t know, that this is not me. I don’t do these things.”

Stauch: “I thought this was one big nightmare… Sometimes I don’t know what’s going on and what’s not really going on... But when bad things happen to good people, it’s hard. Especially because I’m sitting there lost.”

During the interview, Stauch said she was planning on leaving her husband. She said Gannon told her to leave, and Stauch said she should’ve just listened and went back to the east coast, and then everyone would have been safe.

Stauch said Gannon said he can go with her. Stauch: “He knew I was leaving to go back home to the east coast. I said ‘son, I can’t do that. It’s kidnapping.’ If I would’ve just did that, everyone would’ve just been fine."

Cross examination continues on Dr. Dorothy Lewis, who conducted a sanity evaluation on Letecia Stauch in November 2022. Jurors are seeing more clips of that evaluation.

Stauch: “I’m not a violent person. I’m not violent at all… I don’t do this to people. If someone is trying to hurt people, I’m going to make sure they’re okay because that’s what I do each and every time.”

Dr. Lewis: “Who am I talking to?” Stauch: “Taylor.” Stauch began apologizing because she said she doesn’t remember what the two were just talking about a minute ago.

Dr. Lewis said during her testimony, “This is a technique, the way in which we learned about, how do you get to talk to alternate senses of self?... We ask them, how would we get to talk to this person?... By and large, they have a special place that they go. It is known.”

Young: “How do you know she’s not fooling you?” Dr. Lewis: “Watch, listen, see what she’s consistent with.”

Before court resumed, Young went on the record saying he does not want Dr. Lewis to testify or talk about documents including signatures of Letecia Stauch, and a confession in latin. The council agreed that those would not be testified about, because Dr. Lewis “lost them.”

During testimony, Dr. Lewis began talking about documents, and said she has them in her lap. Young is showing frustration because, “this is exactly what I predicted. This was going to happen.”

The judge then asked Young and Tolini to look over the documents during a 15-minute recess.

The judge is reminding people in the gallery that, “There is a child who lost his life and a woman who may be facing a life sentence.” The judge said no one who is testifying is an actor, and everyone who’s testifying has a connection to the case.

Young asked Dr. Lewis if she knew the importance of turning over notes during a homicide investigation? Dr. Lewis: “Whatever she signed there, whatever I had was turned over to Mr. Tolini to be copied and shared with you.”

Young is asking Dr. Lewis about why she sent an email to Tolini saying, “I have been reading more on Letecia, and I think we should drop the EEG request.” Young asked why she told the jury yesterday that she never requested to withdraw the EEG.

Dr. Lewis: “I’m saying there’s other things that need to be addressed… I did not consider this withdrawing it permanently. I did not wish to fight with the court, of are you getting this or are you not?"

Stauch is discussing her different personalities, and she said right now she is Taylor.

Dr. Lewis: “How honest are you with me?”

Stauch: “I am honest with you.”

Stauch: “On January 27, 2020, I had reported Gannon missing because he was… I was calm first, because I didn’t think anything was wrong. I thought he was just playing a hiding challenge and he would be okay. I thought he would eventually come out of his hiding spot.”

Dr.Lewis: “I need to talk to Maria.” Prior to this, Letecia wrote down on a piece of paper, “Maria said she will come on her terms, but don’t think she answers to anyone… Letecia can only talk to her. Not me (not Taylor)."

Stauch: “He was missing and then I called 911, I started to panic after a couple of minutes. That’s when I started to get worried because I realized that it started to rain and get cold outside.”

Stauch (as Taylor) said Gannon wasn’t supposed to die, as she’s shaking her head. “I did try to bring him back, I started praying over him, and trying to bring him back to life. He didn’t come back to life."

Dr. Lewis: "Where was he lying?"

Stauch: "In my arms."

Stauch: “I am not a monster. I’m not a monster… People thinking I’m just a mass murderer and I just killed someone. Under no circumstances, did I know it was Gannon… I never knew it was him.”

Stauch then begins talking in what sounds like a Russian accent saying there was someone in the home who was trying to hurt them. “You don’t understand, I had to protect the people that were in the house… I had to protect them and that’s all I did," said Stauch.

“I’m trying to kill. That’s what I do… That’s what I do for a living… I took the gun and fired the gun at someone who had a cape on — a dangerous man,” said Stauch, who is now identifying as Maria.

Dr. Lewis asked where she got the accent. Stauch said, “this is how I talk.” She continued to say, “That’s what I do, I killed the man. I will protect that people that I love. That’s what I always do. I did what I was supposed to do. I killed a threat,” said Stauch.

Dr. Lewis then acknowledges that it’s nice to meet Maria, and she goes to shake her hand, and Stauch fist bumps her.

At the end of this clip and this part of the interview, a man walks out of the room following Tolini. Dr. Lewis was asked to identify that individual, and she says she cannot see. Young asked about that being her son. Young asked, “What is your son doing in the interview room?”

Young questioned Dr. Lewis why her son was in the room during an evaluation in a first-degree murder case. Dr. Lewis said her son was running and operating one of the two cameras in the room.

Jurors are now watching part of the evaluation from the afternoon of November 17, 2022. This clip is an hour and 30 minutes long. This clip begins with Dr. Lewis reading the confession in latin, written by “Maria.”

Stauch said she gets flashbacks from the day Gannon was killed. “Blood, cape… I remember seeing someone in a cape… I remember a baby crying and then seeing someone in a cape,” said Stauch.

Stauch is identifying herself as Maria. Dr. Lewis: “Why did she get rid of Gannon’s body?” Stauch: “She did not do that… I know a lot of people.”

When asked about shooting the man in a cape, Dr. Lewis asked “Did it turn out to be Gannon?” Stauch: “Not until later… Later on it was Gannon, but it wasn’t supposed to be… I had to call some friends to help me out… to help get the body.”

Stauch: “What would you do if a man was in your home?” Dr. Lewis: “Probably run like hell.” Stauch: “I do different things… I have a special training in my past life.”

When asked about shooting Gannon, Stauch claiming she’s her personality of Maria, said “I don’t care that I hurt people because it’s for the good… I don’t shoot crappy shots… My first thought was to get rid of the body.”
3:10 PM · May 3, 2023 PDT

Dr. Lewis asked, “How do you feel about Harley?” Stauch: “That has nothing to do with me ma’am… I protect Letecia.”

Tolini: “How did Gannon get all the cuts on him?” Stauch: “There was no cuts. I don’t know anything about cuts… I did not know this, I did not cut anyone.”

Young asked about Tolini being in the room during the evaluation, implying that he tried to convince Stauch that it was her stepdad who was shot. “That

helps the theory of the defense, right?”
3:47 PM · May 3, 2023 PDT

To everyone who has reached out to ask me what the jury questions are, unfortunately I do not know. I had to step outside of the courthouse to give a live report at 5 p.m. The courthouse is now locked, so I cannot get back inside.

According to a Colorado Springs Gazette reporter who is still in the courtroom, Stauch will not be testifying in the murder trial. The defense will rest their case on Friday morning. The judge also said they will begin closing arguments after that.

COURT IN RECESS UNTIL FRIDAY - 5/5/23

  • #654

Lewis is here and cross-examination is now underway.

Lewis is saying she took a note that as a child Stauch liked to be called Maria, but, she can't seem to find where she learned that in her notes currently.

Lewis found the note, but she doesn't know where she found that information. Young is unhappy that these notes weren't turned into the prosecution.

Also, Lewis said she only found these notes last night and "forgot" to mention it yesterday.

Young keeps asking Lewis if Stauch had the capacity to understand right from wrong in certain situations leading up to and following Gannon's death. Every time Young asks if Stauch knew right from wrong in each situation Lewis continues to say she isn't sure, or doesn't know.

I think Young is trying to do two things with this cross-examination tactic: One, I think he is trying to show that Lewis has a lack of knowledge/familiarity with the case and two, that there was a lack of thoroughness in Lewis' sanity evaluation.

Young keeps walking Lewis through Stauch's actions before and after killing Gannon, and asking if she remembers that, and if she thinks Stauch knew right from wrong while performing said actions. Lewis' response to most of the questions has been "I don't know."

Young is also trying to demonstrate how much thought Stauch put into attempting to cover up her crime, and asking if Lewis if she thinks that still points to signs of "knowing right from wrong."

Prosecution just played a short clip from one of the interviews Lewis conducted with Stauch. In the interview Stauch claims her personalities, specifically Jasmine, would take over and she would "just end up on a plane sometimes."

Stauch also references the much discussed "Maria" personality in the clip, and says that Maria is fluent in Spanish, but she herself is not.

Second video clip shows Lewis suggesting that Stauch may not remember killing Gannon, something Lewis testified yesterday that she believed. "I've said that from the beginning," Stauch told Lewis.

One last thought from me while we are on lunch break. When I talked to Max Wachtel - a forensic psychologist out of Denver unassociated with this case - earlier this week he told me that oftentimes sanity cases "comes down to a credibility contest."

You are very clearly seeing this with the prosecution's cross-examination of Lewis. Regardless of if your thoughts on the case, Young has spent ~5 hours now, with likely an hour or two more to come, with the main goal being to damage Lewis' credibility in the eyes of the jury.

Back from lunch, the third video clip of Lewis' sanity examination played by the prosecution shows Stauch turning into the personality "Taylor" and referring to herself as such over the course of the video.

Before the jury was called in, Young informed the court that he wanted to confirm on the record that a piece of paper signed by Stauch during the interview being played in court was lost, and that Lewis would not pull it out mid-testimony.

Tolini and Lewis confirmed that the document was lost, until about 5 minutes ago when Lewis stated she did have those documents with her. Once she said that, Judge Werner dismissed the jury to discuss the issue further with the attorneys.

It’s unclear currently if she actually has this document or not, but we are taking a 15 minute break for the attorneys to sort this out and then the attorneys will discuss next steps.

To be clear there is a lot of confusion about if she actually has this document or not, she certainly has some notes that the prosecution didn't have but not sure if it's this specific document that Young had brought up before the afternoon session started.

We are back from break, the remedy that has been agreed upon by all parties is that Lewis can no longer refer to her notes for the remainder of her testimony.

Young just asked Lewis "yes or no" do you have the notes from the interview that was just played. Lewis said "yes" but Tolini and Lewis both confirmed that the documents signed by Stauch in question was not in the notes that Lewis had on her lap prior to all of this.

Young, who is getting very visibly frustrated with Lewis here, just admitted into evidence an email from Lewis to Stauch’s attorneys that acknowledged the withdrawal of the EEG/MRI despite yesterday saying she didn’t know the attorneys had withdrawn the request for the EEG.

Lewis allegedly wrote in the email: “I think we should drop the EEG request.”

In the fourth video clip Stauch, alleging she was Taylor at the time, can be heard describing that she didn’t mean to kill Gannon and “it wasn’t supposed to be him,” before she breaks into a Russian(?) accent and starts talking about how she had to protect the people in her home.

“You don’t understand I had to protect the people in the home," Stauch said to Lewis as her Maria personality. “I’m trained to kill," Stauch said at least five times with the accent.

Stauch can then be seen handing over a note to Lewis that she had signed that allegedly read "Maria Sanchez." I think this is one of the notes that Lewis said she didn't have anymore.

The last clip, which was about 1.5 hours long, showed Stauch in her alleged Maria personality talking to Lewis and describing that she killed Gannon, and that Letecia had now knowledge of it and no knowledge of how Maria disposed of Gannon’s body.

Seeing all your comments about the court losing audio, I'll try my best to summarize the jury questions/and answers a bit later!

I'll do this in a separate thread in a few hours!

Stauch just informed the court that she will not be testifying on Friday

Tolini informed the court that the defense will rest on Friday morning, Werner is saying that after that we will jump into closing statements.

Prosecution said they aren’t planning on any rebuttal witnesses

Week 5 Day 17

5/1/2023

Jury is coming in for #LeteciaStauchTrial now

Prosecution is calling up Kevin Clark with the District Attorney's office

Clark is an expert witness in cell phone data analysis and crime analysis

Clark is looking at a number that says maybe "Nicole" on a phone log. Clark says Siri guessed the name, not Letecia

Clark is reviewing neighbor surveillance when at 2:20 pm on Monday, the day of Gannon's reported disappearance

Clark says at this time, just Letecia and Gannon were at the home on Jan 27th, 2020.

Next videos are from early morning hours the following day. Letecia's Tiguan is in the garage, red truck pulls in to the driveway. Then, a minute later, Tiguan pulls out.

Clark says in the next videos the Tiguan is going to leave at 6:22 am for 10 minutes. Cell phone data shows the car leaves, goes to Bradley Rd., and then comes back to the house.

Clark is now pointing on "movement" in the garage. Someone moving from garage to the Tiguan. The Tiguan then backs into the garage.

Clark says it was not typical for Letecia to back her Tiguan into the garage, but it started happening Monday and Tuesday, the day of Gannon's reported disappearance and the day following.

When talking about Letecia's cell phone use Clark said she would use it all day and night. But on Monday the 27th, late morning to early afternoon, there was a four hour period of no activity.

In Letecia's cell phone, Clark said he could see all of her searches made, websites visited and the notes section of the phone. This is from her "third" phone, the phone they seized from her in South Carolina.

In the notes section of the phone on Feb 19th, 2020, There is a note titled "In the case involving missing child Gannon Stauch do you intend on…”.

Under the summary of this note it says "telling the truth?"

More questions typed out on notes: In the case involving your stepson Gannon, did you inflict harm on him any way? Did you accidentally hurt him in any way? Did you murder your stepson? Do you know personally who is involved in your stepson’s disappearance?

Phone data shows her searching fake polygraph test on Google

Phone data shows another google search "can you get away with fake lie detector website"

When Letecia picked up Al in rental car, her Tiguan was in the short term parking lot at the Colorado Springs airport

Morning break until 10:30 am. Then Clark is going to review timelines compiled based on evidence data points.

Break is over and Clark is going over timelines.

Timeline showing the day before Gannon's disappearance and alleged murder, the selfie picture Letecia took with Gannon and Laina.

Timelines are mainly made up of details from phone downloads. Letecia, Harley and Al's phones were mainly used for Jan 26th, day before the disappearance with the candle spill.

Clark is pointing gaps of time where Letecia is not active on her phone on day of disappearance. He calls this unusual for her typical phone behavior

Clark says investigation shows him that the likely time Gannon was murdered was prior to Liana coming home from school.

On Jan 27th at 4:52 pm a text from Letecia to Harley asks for her to get two things of carpet powder, baking soda and trash bags.

At 5:34pm, Al is asking to FaceTime with the kids. Almost an hour later, Letecia responds saying Gannon is at a friend's house.

Letecia called the front desk of El Paso County Sheriff's Office at first, not 911. The office of the front desk was closed.

We are going through every text and call between Letecia, Al and Harley on night of disappearance/murder.

We see on night of disappearance, Letecia talks on phone with Gannon's biological mom after he's reported missing. Letecia texts Al about how Gannon's mom was crying on the call.

On night of reported disappearance Letecia texts Al "I feel like I'm having a heart attack.”

Next timeline is of Jan 28th, the day after reported disappearance. Letecia is texting Al in the 2am hour "I always give it my all and try to give it my best at everything I do.”

Letecia texts Al: "No one is ever supportive to step parents”.

Letecia texts Al around 5 am on day after disappearance: "I'm sorry that you feel the need to ignore me when I am checking in”.

Letecia is texting Gannon's biological mom a picture of Gannon's thing and said "left every toy”.

Lunch break until 1:20 pm

Jury just returned to the courtroom
We hear a text from Landen, Gannon's biological mom, to Letecia saying "find my baby please”

Letecia left her car at the Colorado Springs airport until 7:02 pm on day after Gannon's reported disappearance. Clark says Gannon was in the trunk of her car during that time.

Clark said Liana did a forensic interview

The first reference to Gannon being hurt is brought up by Letecia in a text to the detective. She brings up that Gannon may have gotten cut by the candle that fell on the floor and that there was blood on both of them.

She apologizes to the detective for not telling that part of the story earlier. When doing so, she says "I am a victim too”.

Letecia is transported from police interview to the hospital because she was complaining of chest pains when telling police that she was raped.

Afternoon recess until 3:25 pm.

Clark is now going through the GPS data showing Letecia traveling from Colorado to Texas to Pensacola, Florida.

Sometime between 12 am and 5:15 am, Clark says the car was moved in Pensacola. He says the car was pinged less than two miles from where Gannon was found.

Clark says Letecia's web searches looked for jobs in Florida

Letecia search "how can I make my phone's IP address hidden”

Another search "I need a fake ID that's legit”

Another search looking up if fake polygraphs work

She searched "I need to change my look to hide," "face disguise," "full face change," "full face transplant”

Letecia searched "shock from seeing someone get shot"

On Feb 24th, she searched a GoFundMe for Tecia and Harley support and how long does it take to get DNA from crime (multiple variations of this second one)

She searched on Feb 25th "I need a new social security number to hide"

On February 26th, #LeteciaStauch phone shows searches: "Do they check in ditches under bridges," "Can I get a plea with no jail time" and "criminally negligent homicide in Colorado”

DA Allen said "I'm not sure what's so funny" referring to distractions from Letecia and her attorney's table in the courtroom

Stauch and her attorney Cook have been huddled and talking. Looks like there's been some giggles.

Another search is "add someone's voice in a video”

Feb 27th a search "how do police tell whose body has been found”

Feb 27th searches "Find people who want to go to jail," "Spanish names" and "find an immigrant who would admit to a crime”

On Feb 28th searches are "How long does a body decompose in a bag" and "What does a dead body look like after a month”

Searches on Feb 29th include "Casey Anthony”

Allen just wrapped up with Clark.

Clark does not recall if Tiguan was tested for DNA or if Gannon's DNA was found in it

They are taking evening break

Week 5 Day 19

5/3/2023

Note: Nicole did not tweet about Dr. Lewis’ 1st day of testimony (Day 18)

Good morning, back on the #LeteciaStauchTrial today.

Dr. Lewis is not in the courtroom yet. Court is in recess for potentially the next 5-10 minutes until she gets there.

Dr. Lewis is here. Jury is coming in.

Cross examination resumes. When asked about controversy surrounding Dissociative identity disorder (DID), Dr. Lewis says "The essential controversy is whether people believe it exists or not.”

Dr. Lewis says she's aware there are movies where people act and pretend they have DID

Dr. Lewis said she's assisted Robert De Niro in a movie, that had to do with him being a "very dangerous guy." She gave him access to tapes of people with different disorders. Among them, there were some people that had DID.

She's being asked how to tell if people are faking DID. She looked at her notes from Letecia. She said when she was younger, she was asked to be called Maria.

Prosecution is asking her to find this in her notes, to see who told Dr. Lewis that. She's looking through her notes now but isn't finding it. "That in it in itself is not proof of anything, but it's confirmation if you have a lot of things that go with it.”

She found something in her notes. Prosecution doesn't have the notes that Dr. Lewis has in front of her. She's going to summarize what she wrote shortly.

These are notes she labeled "Letecia notes from relatives" and she notes someone telling her "Letecia called herself Maria Sanchez as a young child." The doctor had noted retrospective malingering when she heard that.

Young says Dr. Lewis should have submitted this note, wasn't in her report Dr.: "I have no memory of seeing it before until I looked through and found it in the past 12 hrs." Young: "It wasn't until you realized you had nothing to cooperate your report." Dr.: "No it was not sir"

Young: You had Ms. Stauch perform the clock test and she did horrible on it? Dr.: She did something I have seen before, with older patients who have been actually demented. Dr. asked her to do it again and she did a "much better job with it" using her other hand.

Young: Did the thought ever cross your mind she could be faking it? Dr. Lewis: No it did not occur to me that that was faking something because afterwards when I asked her to repeat this, she did a better job on it. This is still a puzzle to me.

Dr. Lewis said she wasn't aware that Stauch had done this test already before.

"It is a puzzle to me and I don't pretend to be an expert in interpreting this." Dr. Lewis referencing to the clock tests she had Letecia do. She says she did one badly and the other much better using different hands.

Young showed her a previous clock test Letecia had done with other mental evaluations before Dr. Lewis' testing.

Young: You know she was examined two days after the crime for head injuries correct? Dr. Lewis says it could be, she needs to be refreshed.

Young: Any sign of psychosis is important in a sanity evaluation? Dr. Lewis agrees

Dr. Lewis: "Insanity is many, many things"

Young: The night before this murder on Jan 26th, 2020. The defendant had a video recording of her and Gannon talking about the fire. Did you see that? Dr. Lewis: No

She says she doesn't recall looking at exactly that but she can't be certain.

They are talking about Letecia calling out of work the day of Gannon's murder saying her dad was killed.

"This man was dead for 8 years and to call in and say...she clearly was not thinking clearly...it was one of these ridiculous kinds of excuses that a person of her intellect would not be expected to share. You would say a stupidity but she isn't stupid.”

She calls Letecia calling Gannon's school to get him out of school that day with a different excuse than her father dying "a puzzle”

Young: At the time she leaves the house to go to PetCo, does she have the capacity to know right from wrong? Dr. Lewis: I don't know

Young: The autopsy report tells you that there was at least 18 cut wounds and stab wounds and a lot of those we're defense wounds....Is there indication that whoever did that had the capacity to form the intent to kill? Dr. Lewis: I don't know I would think so.

Dr. Lewis: "When I spoke with #leteciastauch the memory was I could see a gun in my hand and I don't know what was going through her head and why she shot this.”

Dr. Lewis: "I don't know it was even he that she wished to kill, clearly she did kill him but we don't know at the time if she saw #Gannon and meant to kill Gannon.”

Dr. Lewis: "She certainly believes that other people would believe she has done something horrendous and something had happened.”

Young; She takes the body out of the storage room, takes it upstairs, puts it in the Tiguan and takes it to the airport...does she know the capacity of right from wrong? Dr.: I don't know because what she says to some people is she thought she could bring the body back to life…

(continued) Dr Lewis:...She gets a hamburger and ice cream this is insane. Young: No, that's what she's saying. What happened is she drove right to the airport...what she's saying is psychotic because she wants you to think that's psychotic.

Morning recess until 10:45 am

Recess is over #LeteciaStauchTrial resumes with cross examination of Dr. Lewis.

The fact that Letecia knows to go to an isolated spot to hide the body, Dr. Lewis says that maybe shows that she knows right from wrong or maybe it shows psychosis.

The fact that #leteciastauch thought to leave her car with Gannon's body at the airport, Dr. Lewis says it shows "the capacity to know what will be regarded as incriminating and not in her best interest. Right from wrong is abstract.”

Dr. Lewis; "You are thinking more logically that I think we can give her credit for much of this. I find crazy much of what you think is logical.”

Young: You have interviewed hundreds of people on death row, have you ever come across one of those who may have lied to you. Dr. Lewis: oh yes, absolutely.

Dr. Lewis says she's aware that Letecia searched "I don't like my stepson.”

Young: If that suitcase was never found, do you think we'd be here today on an insanity case? Dr. Lewis: I can't answer that, I don't know

Young: During the interview, do you have any concerns #leteciastauch may not be truthful with you? Dr. Lewis: Of course

We are watching a video of an interview with Dr. Lewis and Letecia from November 15th 2022.

#leteciastauch is talking about a Maria in this interview.

Letecia talked about Maria having a jail call and speaking Russian. Dr. Lewis does not recall seeing or hearing a recording of a call where Letecia was speaking Russian.

In the video Letecia says she's been to Dubai and Jasmine is a princess.

Dr. Lewis says she could have been making it up or it was a fantasy.

In this clip, #leteciastauch tells Dr. Lewis she changes persona when she is stressed out. Dr. Lewis says "a triggering event" is consistent with DID.

Second video of #leteciastauch interviewing with Dr. Lewis.

Letecia says in video interview: "I was not intention to hurt Gannon, absolutely not. I love Gannon.”

Letecia says in video interview: "These people in here do this stuff I don't" ( Letecia referring to the jail and hurting people). You don't take people out, buy people stuff...I don't understand this, that's just not how it works.”

Letecia in recorded video is referring to Landen, Gannon's mom.

Letecia in recorded interview "one minute something could happen then it is switched personality." She says she hears another voice but then is quick to say she's not schizophrenic. She says she goes and forth.

Letecia in recorded interview is wiping her eyes and appears to be crying.

Letecia in recorded interview with Dr. "I didn't come up with any idea of Gannon dying”

Letecia in recorded interview with Dr. "I should have just took him with me and started his school across the country.”

Dr. Lewis answering questions on this video: "I found the entire thing incredibly confusing.”

Dr. Lewis: "There was something incredibly puzzling about who wanted to be with whom, who loved who, I found it incredibly confusing.”

Young: Do you think that's a stressor the fact that an 11-year-old boy tells his stepmother I want to be with my mother and not you? Dr. Lewis says it could be, could not be

Several times during the interview Dr. Lewis looks to the right at Stauch's attorney. She says she was trying to see if her attorney understood better what she was saying.

During these recorded interviews, she had perviously been deemed sane by the state hospital and had already had been through this process.

In this latest video, Dr. Lewis asks if Letecia thinks she was in a peculiar state when she talks bout certain events. Young is questioning if that is too leading.

Next clip is 7 minutes long. We will hear it after lunch. Recess until 1:20 pm.

We are back but the court has the camera off for the witness stand so we can't see the video of the feed, just audio for this next video.

Video is back. Letecia is saying "I am not violent at all”

In this third recorded video with Dr. Lewis, Letecia says: "My protector is Maria.....you want to talk to Maria right now? Sometimes she will talk, sometimes she will not.”

Young: How do you know she's not fooling you? Dr. Lewis: Watch, listen.

Judge is asking the jury to go into the hallway.

Judge telling Dr. Lewis and prosecutors to take 15 minutes to go through the notes that she is bringing up in court that prosecution does not believe they were provided with.

Court in recess until 2 pm.

We are back with another video from the sanity evaluation with Dr. Lewis

Letecia is telling Dr. she was trying to get him back to life and he didn't come back to life.

Letecia saying "It wasn't supposed to be.”

Letecia saying: "I'm trained to kill, that's what I do, I'm trained to kill that's what I do for a living.”

Can't tell if the audio is weird or if Letecia is speaking in and out of an accent or different language in this recorded part of the evaluation

She keeps saying "Letecia's family”

She's writing something down in the footage from the evaluation

Young is freezing the video because there's a man in the back of the footage. "What is your son doing in the interview room?”

Young to Dr. Lewis: "Is that recognized in the field to do forensic interviews with people for first degree murder and bring your son along?”

Young: Did she tell you that she mistaken identity, didn't know it was Gannon, fired a gun once, did what she had to do Dr. Lewis: Early on... Young: You know that isn't how Gannon died, only one gun shot, why didn't you question her on that?

Was hard to hear her response but it sounded like she said her son was there to help run the camera.

Going to the last clip it's an hour and twenty minutes

She's reading a letter in the footage from the interview. It's not in english and the doctor is trying to figure out what language.

Dr. Lewis is reading what she's sounding out as rest in peace Gannon on this note.

Dr. Lewis to Letecia in video: "Do you believe that's a confession from Maria”

Dr. Lewis: Maria did it? Letecia: Well, I didn’t

Recess until 3:30 pm

Court may go a little later than 5 today to wrap up with Dr. Lewis. Judge says they need to see if jury can work with that.

They are looking at the note in this video again. The word self defense came up.

When asked on the recorded sanity evaluation, how Gannon got all of those cuts, Letecia says she doesn't know about cuts. It's really hard to hear what is being said. Sometimes it sounds like an accent.

Letecia says something, naming Letecia and then says "if she's upset, i'm upset.”

Letecia is speaking with a new accent in the recording telling the Dr. "do you think this is a joke?”

Redirect of Dr. Lewis now

Dr. Lewis: What you call it is so much less important than what you understand about it. What you understand about it is that this individual has been living a psychotic life

Dr. Lewis: The person is living a psychotic life

They haven't returned the audio to the feed for these jury questions

Still no audio….

Week 5 Day 19

Stauch jury question thread: PLEASE NOTE: I am going to be heavily paraphrasing the jury questions and (especially) the answers from Dr. Lewis, so not a lot of direct quotes. There were seven total questions from the jury, let’s get into it.

Juror question 1: In what way would Stauch giving Gannon enemas impact her relationship with him?

Answer: Lewis said that enemas, especially performed regularly on a child, can be a form of child molestation and sexual assault. However, Lewis cautioned that this claim from Stauch may not be true.

Juror question 2: Did the number of cases drop at Bellevue (the hospital Lewis used to work at) after Lewis’ dissociative identity disorder clinic opened?

Answer: Lewis said there was no actual research conducted on this, as far as she knows, but she “would bet money” that the answer is yes.

Juror question 3: How do you determine if someone is faking or exaggerating their mental illness or not?

Answer: Lewis gave a very long-winded answer to this, but essentially said what she had said a couple times in trial about this, that you have to look how someone acts in an interview, and look at evidence of it existing outside the interview in things like past writings.

Juror question 4: Did you perform any tests to help determine if Stauch was faking or exaggerating DID?

Answer: “Yes.” (that was actually all she said)

Juror question 5: Earlier, you said people with DID are more susceptible to believe what people say to them, then why do you openly talk about potential theories and explanations in front of the defendant during the interview.

Answer: Another long-winded answer from Lewis (and one I didn't fully understand) that I think can best be described as: (1/2)

It’s often good to run theories and questions by defendants to see their responses, even if their answers can’t necessarily be trusted, as the response can still inform on sanity.

Juror question 6: If the EEG and MRI weren’t provided how can you issue a final sanity report?

Answer: Lewis said that basically she can still conduct the sanity exam with interviews and background research and be confident in her findings, but that the EEG and MRI would have just (potentially) helped prove her findings.

And I'm very sorry to disappoint, but I missed the last juror question, it was around then that I started getting hundreds of twitter notifications from y'all and got a bit distracted, my fault on that one! Hopefully someone else can fill in the blank there.

And I believe before the mic was turned back on Stauch informed the court that she would not be testifying, the defense informed Werner they would be resting on Friday and the prosecution informed Werner they would "most likely" have no rebuttal witnesses. Closings coming Friday.

Anyway, this week has been very, very surreal and overwhelming, in the past two hours almost 1,000 people have followed me. I want to thank y'all for following my reporting the past couple days, It honestly means a lot!

I'll be back in court on Friday for what could be the last day of Stauch's trial. In the meantime, I'm gonna go have a beer lol.

Also one last thing, y’all should give @AshleyPorteeyo a follow too. She’s covered nearly every day of this trial too, and she was unlucky to have left a few minutes before juror questions.

One of the few points agreed upon by both sets of experts is that dissociative identity disorder, previously known as multiple personality disorder, is an extremely controversial diagnosis. Wachtel, who said he has diagnosed people with dissociative identity disorder in the past, stated that the reason for that is twofold: There are numerous people who dispute that dissociative identity disorder is even a real mental health condition; and defendants often lie about having it in criminal cases.

"Dissociative identity disorder is one of the most faked mental illnesses when it comes to sanity evaluations," Watchel said. "If somebody is going to fake it, they typically either claim a fake psychosis or multiple personalities."
