I know that I count on this site to keep up with what’s going on .. I am here where LH is and the other sibling are but I do not have social media of no kind ... I have read this site for so long that’s how I know LS was being arrested... please don’t let Gannon memory res til that crazy individual is convicted forever ... I don’t see anything from imstillagrandma much or massguy was he booted?

I am new and hope to not make any mistakes in posting but this case I have followed from the beginning ... all of you in here have so many great ideas and I have read them all . And yes I am from the south same county LS was apprehended... which brings me to this is was nice to see that she is now back at her original residence El Paso County Jail.

I have no idea. I would think they’d keep her for treatment if she was found incompetent. But this is the first case I’ve ever followed so intently. If nothing else, we’ll find out Friday. That’s the next court date I believe.

I thought she was sent there to be evaluated. Or was there another reason? I haven't checked in for awhile. I did read that she was planning an escape!

She planned an escape before she was sent for evaluation.. either way I believe she is totally competent to stand trial no matter what ... she is just trying to play all her cards to get out of her charges

Yes, I didn't mean that she planned to escape from the facility where they did the mental health evaluation. I thought she was sent there temporarily, so it makes sense that she would be sent back.

I found the following information regarding competency. Hopefully puts our minds at ease a little!

When Is Someone Incompetent To Stand Trial?

A finding that someone is incompetent to stand trial does not mean that the defendant will no longer be prosecuted for the crime for which they are charged. Being found incompetent to stand trial means something very different than being found not to be criminally responsible due to insanity. A defendant who has been found incompetent to stand trial will be administered treatment for up to 15 months in order to attempt to make them competent to stand trial. After a defendant is restored to competency, they will return to the court system to enter a plea, have a trial, or in some manner adjudicate their case.

There are at least two reasons the court sends inmates to Colorado State Hospital - Pueblo. One is if a defendant pleads guilty to their charges by reason of insanity. The exam for determining a person sane or insane cannot be completed in a couple of weeks. That inmate is usually hospitalized for months.

The second reason the court will send an inmate to CSHP is if something arises causing the defense or prosecution to question an inmate's competence. The court will say they have insufficient information to make the determination. (The court wants assurance that the defendant is competent to assist their attorneys with their defense-- and be present both in mind and body at the trial). They don't want to have to repeat this trial!

The court order for LS's evaluation provides that if LS was deemed incompetent, the prosecution already OBJECTED on the record for LS to began rehab, and demanded 24 hours to review the report/findings.

She was sent to the hospital on 7/20 & per your posts above sent back to jail on 8/5. She did have a review hearing set for 8/7, but I just now looked at the court site & it is no longer posted on there. The next hearing I have for her is 9/8. But there was nothing from court site - it brought up "No results found".

Ive been quiet here lately enjoying the morning donuts with my cofffee while I wait for justice for Gannon . She’s back from eval good maybe the delays will stop but I doubt it . Doesn’t matter though she’s not getting out .shes not insane she’s just not so smart. Mental health issues aren’t a get out of jail free card. The delays just twist the knife a lil more into Landon’s and al’s heart but also makes them stronger bonding them together in seeing justice done ls may drag on the case but there will be justice . Jmoo

The 9/8 date still shows on the inmate search but not the court dockets. The same thing happened with the 7/17 court date. But yes, the 8/7 appearance isn’t showing in either place now.

This may be why we are not seeing T's case on the docket? We may have a better idea of the scheduling after Aug. 14th.
