I have a question. Hypothetically speaking if someone should happen to die while awaiting trial, what would happen? Would all information that authorities have be released to the public? Or be kept locked away forever? Just a strange random thought I had.

An interesting question. I only just joined websleuths during the pandemic and am not a lawyer, so I have no idea. @OldCop @nyvictoria @Gardenista any idea? My hypothesis would be that officials would leak to journalists the evidence that they believe could have convicted should the suspect have lived.

IANAL either but I think it would depend on the LE agency and their policies. The one example I can think of is the Susan Powell case (West Valley City, Utah). Just about everything known by LE has been made public, either through investigative journalists, with the cooperation of the WVC lead investigator, or by her family.

As far as I know, here in the U.S, all criminal charges are dropped if a suspect awaiting trial dies. However, a civil lawsuit can still be filed and a family member of the suspect could be responsible for any damages awarded under certain circumstances. If there is a civil trial, a lot of information will be released. Even if there is no civil lawsuit, information will often come to light thru FOI requests filed by family members of the victim, journalists, authors, etc. How and when LE releases information varies case by case.
In 2006, 24 year old Jennifer Kesse disappeared from Orlando, FL. Her vehicle was found about a mile from her condominium complex. Jennifer has never been found. LE would not release any information to Jennifer’s parents until 2018 after the Kesses filed a lawsuit against the Orlando Police Dept. After reaching an agreement, Orlando PD turned over more than 16000 pages of documents relating to their investigation. In this case no one has been arrested. LE maintained that releasing documents could interfere with their investigation.
In the case where you have a deceased suspect under arrest/awaiting trial for a crime, LE must still abide by the “innocent until proven guilty” right of the defendant. When releasing the information on a case such as this, LE must tread carefully lest they open their department to lawsuits.

I’m ready to get this case going .. nothing new for almost a month ... not a normal thing for TS... they must have a tight reign on her ... or a muzzle...Gannon was alive last Christmas...he should be now
