So, there was a date set on Dec 18th? That would be 2 weeks from now. It is soooo silent out there on this case. I haven't and won't forget.

Gannon's family is in my thoughts right now. It has to be such a hard time as the first holidays without him begin. This needs to be finished for their sake. It will not bring Gannon back, but perhaps with justice served it can bring some peace.

Here is the link for the docs. The one requesting a continuance is at the bottom. The evaluation has not been done because the jail will not allow in-person visits due to COVID. This is not the fault of the defense IMO. What else could they do except request a continuance? Throw up their hands and say "never mind"?

I'm not surprised the docket hasn't been changed as there hasn't been a reply to the defense Dec 2 motion to extend yet. Or if there has been a decision made, it's not been posted yet. (There's not an end-of-the-week Register of Actions posted for last week and the defense motion wasn't posted until yesterday.)

I'm not an attorney but I'd be surprised if the judge denied the motion. And if he did, given the COVID rates in that part of the country, I'd be surprised if a jury trial was scheduled anytime soon.

The motion by the defense requesting a continuance (for the Dec 18 hearing) until sometime in January 2021 was filed on Dec 2, 2020.

Although there has not been a published response to this motion yet, I believe it will be unopposed given the circumstances.

The court-appointed evaluator is unable to see the inmate to conduct the exam.

The Colorado National Guard was also called in to assist the jail after the increased numbers of COVID cases reported for staff and inmates!
