Still shows as a hearing for today - plus I can finally shorten this up a bit.

Friday, December 18th:
*Status Hearing (murder & escape charges) (@ 1:30pm MT) – CO – Gannon Stauch (11) (missing Jan. 27, 2020, Colorado Springs; found Mar. 17, 2020 in Pace, FL.) – *Letecia Lynn (or Leann) Stauch (36/now 37) aka Letecia “Tecia” Lynn Hardin & Letecia Lynn Hunt arrested (in Myrtle Beach, S.C. 3/2/20) & advised of charges (3/5/20) & formally charged & arraigned (3/11/20) with 1st degree murder of a child under 12, child abuse resulting in death, tampering with deceased human body & tampering with physical evidence. No plea entered. Held without bond. .
Charges re-filed (3/20/20) with 2 counts of 1st degree murder (after intent & deliberation), 2nd degree child abuse resulting in death, 3rd degree tampering with deceased human body, 6th degree tampering with physical evidence & 8 counts of crime of violence (firearm, blunt instrument, knife or sharp instrument & causing the death of Gannon). Held without bond.
New Charges filed (5/20/20) & charged (6/5/20) with solicitation to commit escape. $2K bond.

8/28/20: Official filed: 4 page letter dated 8/12/20 from LS to Judge Gregory Werner. 9/3/20 Update: Minute Order: USB received in sealed envelope from County office of Behavioral Health & placed in Div. 15 inbox on 9/3/20. Date for a Poof Evident Hearings. Will start at 8:30am or 9am on each of these dates: 10/12, 10/13, 11/9, 11/12, 11/13, 11/23, 11/24, 12/14, 12/15 & 12/18/20. Next status conference hearing on 9/8/20 & prosecutors expect to have the results of competency evaluation by then.
9/8/20 Update: Judge Gregory Warner in June order Stauch to undergo a competency exam at the request of her lawyers. State psychiatrists found Stauch mentally competent to stand trial. After learning the results, Stauch’s lawyers asked Warner for a second opinion, likely delaying proceedings in the case for several months. The first mental evaluation was conducted at the Colorado State Mental Health Institute in Pueblo. The second evaluation will be conducted by Dr. Jackie Grimmett of Colorado Springs. This eval will consider whether defendant has a "rational understanding" of case against her, and whether she can assist in her own defense. If the second exam done by a different doctor finds Stauch is not competent, Warner would hold a hearing to determine whether she will stand trial. Judge grants defenses’ request for 2nd competency evaluation for Stauch which is due in 63 days. Defense is claiming the first competency evaluation should not have been recorded, does not want the second one recorded. Judge says he will look into it. Both prosecution and defense have copies, but were ordered not to watch until a ruling. Her next court appearance for competency report is scheduled for Nov. 12. Autopsy reports have finally been completed/received from Florida & has been given to prosecution & defense.
9/11/20 filed: El Paso County Sheriff's Office 3rd-party Motion requesting clarification of Court's limiting Pretrial Publicity. El Paso County Sheriff's Office amended 3rd-part Motion re pretrial publicity.
9/17/20: Defense filed: Motion D#18 to appoint Dr. Jackie Grimmett to perform the 2nd competency evaluation & to approve payment for the evaluation. Register of Actions 9/5/20 to 9/11/20: County attorney objects to release of media document request; defense would like to know specific documents that are being requested & feels it falls under courts pre-publicity order. Discussed re-video recording of sanity/competency evaluations; defense requests release of video recording & court requests parties to brief the issue. Defense requests that next evaluation not be recorded; opening brief due 9/28/20; response brief due 10/16/20 & reply brief by 10/30/20.
9/19/20: Motion D#18 to appoint Dr. Jackie Grimmett-granted. Defense: Motion D-19: Brief regarding the use of video & audio recording during a competency evaluation (Defense objects to use of any video/audio recording). Exhibits A & B to pleading D-19. 9/24/20: Filed by defense Deputy State Public defenders Kathryn Strobel & C. Colette LeBeau: Motion (D019) to authorize 30 hours for the 2nd competency evaluation. Which are normally only 10 hours. Divorce: Status conferencing hearing on 3/29/21. And Permanent Orders hearing on 4/30/21 @ 8:45am.
10/6/20: Defense Motion 20: Motion requesting that Dr. Grimmett be permitted to review the video recording of the first competency evaluation. Certificate of Compliance of Collateral materials to Dr. Jackie Grimmett. Order: Re (D-20) Motion requesting that Dr. Grimmett be permitted to review first competency evaluation. Order: (D-19) Proposed Order: Motion to authorize 30 hours for the 2nd competency evaluation. 10/1/20: Order: D-20 Motion: Denied at this time. Defendant has since filed her D-19 Motion challenging whether the competency evaluation should have been videotaped & whether it should be disclosed to the prosecution. Court ordered video sealed & not viewed by prosecution. If the Court grants the D-19 Motion, the video will remain sealed & not be viewed by prosecution. But if Dr. Grimmett were to view the video of the competency evaluation, that video would be subject to release to the prosecution in the event competency became a contested issue or Dr. Grimmett were to testify on some matter. If the defendant wishes to withdraw her D-19 motion & agree that the prosecution may view the competency video, she may notify the Court. Otherwise, the Court will not permit the video to be sued for an purpose until the D-19 motion is resolved.
10/20/20: People's response (P-20) to Defense brief regarding the use of video & audio recording during a competency eval D-19. 10/30/20: D21 Response to People's Motion regarding the use of Video & Audio recording during a competency evaluation. D22 Motion to extend deadline to complete 2nd competency evaluation & to continue the review hearing on 11/12/20 due to COVID outbreak at the El Paso County jail. Dr. Grimmett was scheduled to am in-person competency eval of Stauch on 10/31/20, but on 10/29/20 Dr. Grimmett informed defense counsel that the jail has cancelled all in-person visitation until at least 11/30/20. Stauch is requesting an extension of time to complete 2nd competency eval. The defense requests that a review hearing be rescheduled after 12/14/20 to allow Dr. Grimmett adequate time to complete her eval.
11/6/20 Update: [D21] Order denying use of video or audio recording during competency evaluation. The Court read the motions & applied the law & there will be no recording of LS competency evaluation, and the prosecution may NOT watch the first recorded evaluation. Judge has reset the review hearing on competency report to 12/18/20 as a status hearing.
12/4/20: (D-23) Additional Motion to extend deadline for 2nd competency evaluation & to continue the Review hearing due to COVID outbreak at the El Paso County Jail. The defense requested that a review hearing be re-scheduled to January of 2021 to allow Dr. Grimmett adequate time to complete her evaluation, review her finds, write & submit her report.

If the previously-scheduled hearing really is happening today, I'm assuming there must be at least one "status issue" besides the 2nd competency eval delay to discuss, or maybe the (realistic) scheduling of that 2nd eval requires discussion? The COVID/ El Paso jail news seems to be mostly about the ACLU lawsuit against the sheriff because of the jail outbreak

So I can't gauge if doing the eval in late December is as realistic today (Dec 18) as it might have sounded when the delay motion was filed on Dec 4.

But given that CO law specifically provides for the right of any party (prosecution, defense, judge) to request a 2nd eval, I can't imagine the judge denying the motion for a delay and in effect saying a 2nd eval can't be completed. After all, it's COVID that has prevented any in-person jail visits. And I'm not sure how one could possibly do a valid and credible eval except in person.

I tend to stay away from this thread because every time I drop in my heart breaks all over again. Sadly, I've read a lot of horrible cases and details over the years, but Gannon always hits me hard. His sweet little face and beautiful smile get me and I think about how fun he would've been to have as one of my students. Of course I didn't know him, but his beautiful personality and spark of joy feel like they come right through the photos. I'm sure it will be a long time before I can handle checking back in. I'm always hopeful to hear the news we're all waiting for. Rest peacefully, beautiful Gannon.

Friday’s hearing was brief. Stauch didn’t speak but appeared through a video feed in a holding cell. Cameras captured her pacing back and forth throughout the entirety of the hearing.

The question remains as to whether Stauch is mentally competent enough to stand trail. A judge announced Friday that answer should come about a week before the one-year anniversary of Gannon’s reported disappearance.

The subject might want to save that energy to fend off angry inmates.

No one is buying the crazy act.
Justice will be swift in this case.

Good question. I may be wrong but I thought in CO status conferences weren't open to press cameras. If that's the case, I don't see how there could be a MSM video.

From the link, I believe the best we will get is "hearing" about LS pacing in her holding cell via news video at the link above.

Take note that Colorado Court sites using WebEx during COVID19 all include disclaimers that remind the public and media that cameras/streaming prohibited in Colorado.

Correct. Colorado criminal court is closed to cameras except for advisement and arraignment.

Court procedures adopted specifically for COVID19 and use of WebEx is no exception -- see the disclaimer for El Paso County Virtual Courtrooms..
