As we get closer to Christmas, I can’t help but think of Gannon’s family. I’m sure this holiday season is an especially sad time for everyone who loved Gannon. I hope his family and friends can take some comfort in knowing that Gannon’s bright spirit touched the hearts of so many. I wish them peace in the new year.

That's not all "new news" so the tweet from Colette Bordelon at KOAA is a little misleading IMO. A defense motion asking for 30 hours was approved by the judge 3 months ago on Oct 1. Colorado Judicial Branch

On Dec 24, a motion was filed requesting an additional 5 hours for a total of 35. That motion hasn't been acted on yet by the judge. But regardless, there hasn't been a last-minute request to go from 10 to 35.

From a psychology perspective, 10 hours is an incredibly short time to do a full eval for competency to stand trial anyway. Unless the person is clearly suffering from something progressive and permanent like dementia (and sometimes that IS what's going on), I could see why more time would be needed. And in this case simply reading and processing all the discovery material would take several hours, I'd think. Then doing the full assessment, coming to a decision, writing a report...hard to see how 10 hours could work.

The stated reason for the additional 5 hours is that so much time has elapsed since the first eval. (I believe that one was done in July. Normally Eval #2 would follow shortly.) It's mostly not anyone's fault that didn't happen--- it's mostly COVID-related (except for the initial delay in Eval #2 caused by the state's request for taping, a request that was later denied.) But that big time gap means some things for the 2nd eval will have to be done differently and/or done over.

Now, a local news outlet has reported that Sherie Farstveet, a 54-year-old former paralegal in the city of Brighton, has admitted in court to releasing the document. She pleaded guilty on Dec. 10 to a count of attempted official misconduct. Her conviction would stay publicly unreported for nearly two weeks before the local outlet, The Gazette, broke the news.

Stauch’s prosecutor Michael Allen said a true crime website published it. Back in a May press conference, he did not name Farstveet, but she was quickly identified elsewhere. bbm

“I know that the person does not work for the court system per se, but does have a log-in to get into the court system,” he told reporters. “And was able to access the affidavit before the seal was lifted, and accessed it that way before leaking it. Those are the allegations.”

At the time, he voiced doubt that the release of the affidavit would affect the Stauch case, but added the leak deprived Gannon’s birth parents “of the right and respect that they deserve as victims in this case to really have chance to see it before. They are just confronted with it on the media or online.”

Farstveet, who had worked for the Brighton City Attorney’s Office as a paralegal, was reportedly ordered by the judge to pay $100 fine and $199.50 in court costs.

“Sherie Farstveet is no longer employed by the City of Brighton and we have no additional comment,” spokesman Zachary Reece told Law&Crime in an email Wednesday morning.

Adams County Judge Michael Andrew Cox ultimately ordered Farstveet to pay court costs for her indiscretion. She was initially facing first-degree official misconduct, but prosecutors charged her with a lesser crime of attempted official misconduct for a guilty plea.
