Stepmother accused in killing of Gannon Stauch to appear in court for closed-door hearing

Letecia Stauch, the woman accused of first-degree murder in the killing of her stepson, 11-year-old Gannon Stauch, heads into court Friday for what is likely to be a closed-door hearing about her request for new attorneys.

Stauch, 38, is to appear at 2:30 p.m. before 4th Judicial District Chief Judge Will Bain. If Stauch requests new attorneys, as expected, the judge will close the courtroom to everyone except the defendant and her lawyers, Bain's clerk said — a standard measure because the hearings tend to delve into privileged communications between defendants and their attorneys.

*Hearing (murder & escape charges) (@ 2:30pm MT) – CO – Gannon Stauch (11) (missing Jan. 27, 2020, Colorado Springs; found Mar. 17, 2020 in Pace, FL., Santa Rosa County) – *Letecia Lynn (or Leann) Stauch (36/now 37) aka Letecia “Tecia” Lynn Hardin & Letecia Lynn Hunt arrested (in Myrtle Beach, S.C. 3/2/20) & advised of charges (3/5/20) & formally charged & arraigned (3/11/20) with 1st degree murder of a child under 12, child abuse resulting in death, tampering with deceased human body & tampering with physical evidence. No plea entered. Held without bond.
Charged (re-filed 3/20/20) with 2 counts of 1st degree murder (after intent & deliberation), 2nd degree child abuse resulting in death, 3rd degree tampering with deceased human body, 6th degree tampering with physical evidence & 8 counts of crime of violence (firearm, blunt instrument, knife or sharp instrument & causing the death of Gannon). Held without bond.
New Charges (filed 5/20/20) & charged (6/5/20) with solicitation to commit escape. $2K bond.

12/21/20: [D-24]: Motion to authorize 5 additional hours for the 2nd competency evaluation filed by Megan Ring. (Counsel requests that Dr. Jackie Grimmett to use 5 additional hours, for a total of 35 hours, rather than the standard 10 hours to complete 2nd competency evaluation. A defense motion back on 10/1/20 asked for 30 hours which was approved by the Judge. This is just an additional 5 hours to make it 35 hours. Status hearing re competency report on 1/19/21. Divorce: Status conferencing hearing on 3/29/21 & permanent orders hearing on 4/30/21 @ 8:45am.
1/19/21 Update: Hearing (via video call) before 4th Judicial District Judge Gregory Werner. The judge is expected to reveal the results of her second competency evaluation, performed by a defense expert after state psychiatrists found in an earlier evaluation that she was mentally fit to be prosecuted. Stauch was found competent to stand trial. LS has asked to change attorney. Next preliminary hearing Mar. 11th & 12th, “for proof evident presumption, or initial steps for those criminal charges”. Judge says Stauch's request for a different attorney will be closed to the public. El Paso County Sheriff had issued a request for additional security after her second mental evaluation, judge simply says "I...I understand what you are saying." I'll be asking for some background on that. The judge will also decide in the March hearing whether Stauch is eligible for bond. 1/22/21: [O-11} Order finding defendant Stauch competent & setting matter for proof evident presumption great & preliminary hearing. 1/22/21: [O-12] Order regarding expanded media coverage-will be denied per Judge Gregory R. Werner. 2/17/21: “Closed Door” Hearing was added on 2/19/21 for murder & escape charges about her request for new attorneys before Judge Will Bain.

Conflict hearing officially requested for #LeteciaStauch. Judge says he’s about to close the meeting for now to talk about replacing her attorneys, it will just be the defense team, the judge, and Stauch on the call. We’ll get to come back in when they’re done.

All I know about this so far is that #LeteciaStauch is on the docket, and the rest is sealed. The hearing should be open to the public, at least at the beginning. I’ll be tuning in online, and will let you know what I hear.

#GannonStauch’s dad, Al Stauch, has joined the virtual hearing. Just waiting to get going - should be any minute now. #LeteciaStauch is accused of murdering her stepson, Gannon, in January of 2020. We can see her in an orange jumpsuit, in her video box on the screen.

Judge Bain asks the attorneys to all announce their presence. A mention that #LeteciaStauch is appearing via WebEx, in her jumpsuit and a mask. Now going into a private session for the conflict hearing, so I have to log off. When they’re ready to come back, I can log in again.

has reported he expects this hearing to be closed to the public right away to talk about getting new attorneys for Stauch, that’s standard procedure. I’ll keep you posted.

Judge says he is not making a finding either way on if there is a conflict or not between #LeteciaStauch and her current attorneys. He’s kicking it back to our OG judge for advisement. So...matter is still up in the air.

Judge Bain is referencing the Arguello case for his reasoning to give no decision with #LeteciaStauch’s request for new attorneys. Getting paperwork now on the case, I’m no legal expert but I’ll try and share what I learn.

Judge Bain was asked to address whether there is or is not a conflict in the case. He’s not going to make that decision, and will send the case back to Judge Werner. Judge Werner’s team will schedule another advisement, potentially next week. That’s it.

The next hearing for #LeteciaStauch will be an Arguello advisement. From what I’m reading about those, they are to ensure the defendant understands their rights before proceeding without an attorney into trial.

Check out the (faintly) underlined portions. #LeteciaStauch is headed for an Arguello advisement, meaning the court is considering taking away her court appointed attorneys if she keeps dragging her feet. Her other options would then be hire an attorney...or represent herself

Can she elect to have a Judge only trial? I’m hear you tell you that if the Jurors have to listen to her “word salad” for more than an hour they will vote to convict after 5 minutes in deliberation.

She is so stupid. I guess we are going to hear all about Eguardo again or maybe there is a new story.

Just got off a call with @4thJudicialDA Michael Allen. We talked all about Arguello advisements. The prosecution was also not involved in the closed-door conflict hearing this afternoon, and he says it’s not safe to speculate on if #LeteciaStauch has fired her defense team. @KOAA
