I believe the hearing tomorrow was originally scheduled for 1/13. The defense had already filed a request LS not be required to appear on 1/13. That request was filed on 1/5 and can be found here.

I'm fine with LS not attending a "review hearing." Her defense states the in-court appearance of a defendant for a review hearing is not necessary, and does not prejudice the prosecution in any way.
With many courts canceling trials because of the continuing pandemic, don't bother.

Thanks @NCWatcher -- I totally lost track that the hearing on 1/13 was in-fact canceled after the defense stated they didn't want the "review hearing" canceled, and how LS not being present for this review did not prejudice the prosecution in any way.

So I guess we will find out tomorrow if LS has had the evaluation or still waiting for it. JMO
If somehow it’s been completed, I still don’t expect her to be present. As @NCWatcher posted above, LS Defense did file the request back on January 5 to not appear.

I'm recalling per @LaurenScharfTV's recap last night on an unrelated case mention that she would be covering the 1/27 hearing and also responded to a viewer that she thought LS was either currently at Pueblo's Mental Hospital for evaluation or had recently returned from the hospital-- i.e., transported back to El Paso County Jail. I guess all will be confirmed on Thursday! MOO

*Motions Hearing (murder) & Review Hearing (Escape attempt) (@ 1:30pm MT) – CO – Gannon Stauch (11) (missing Jan. 27, 2020, Colorado Springs; found Mar. 17, 2020 in Pace, FL., Santa Rosa County) – *Letecia Lynn (or Leann) Stauch (36/now 38) aka Letecia “Tecia” Lynn Hardin (maiden name) & Letecia Lynn Hunt (1st married name) arrested (in Myrtle Beach, S.C. 3/2/20) & advised of charges (3/5/20) & formally charged & arraigned (3/11/20) with 1st degree murder of a child under 12, child abuse resulting in death, tampering with deceased human body & tampering with physical evidence. No plea entered. Held without bond. [see below for re-filed charges]
Charged (re-filed 3/20/20) & arraigned (11/4/21) with 2 counts of 1st degree felony murder (after intent & deliberation), 2nd degree felony child abuse resulting in death, 3rd degree felony tampering with deceased human body, 6th degree felony tampering with physical evidence & 8 counts of crime of violence (special enhancer: firearm, blunt instrument, knife or sharp instrument & causing the death of Gannon). Held without bond. Plead not guilty.
Charged (filed 5/20/20) & charged (6/5/20) with solicitation to commit escape. $2K bond. Plead not guilty.
Trial set to begin on 3/28/22. (will last 6 weeks).

12/2/21 Update: Review hearing for both cases is on 12/9/21. Motions hearing for murder charge on 1/6/22 & escape attempt charge has review with appearance of parties hearing also. The defense says they plan to introduce new evidence, asserting a mental health issue for Stauch AFTER the alleged murder of her stepson Gannon. She’ll need to be evaluated, if that evidence is to be introduced.
12/9/21 Update: Stauch appeared in court virtually on Thursday for a hearing about the mental health evaluation. Judge Gregory Werner asked why Stauch wasn't present in court & she said that she hadn't received medication while in jail & that's why she wasn't appearing. Judge Werner said he had been "pretty patient" with Stauch & told her that she needs to file a motion seven days in advance before not appearing, or a deputy will bring her to the courtroom. Motions filed by Stauch's defense team, says an insanity plea is NOT off the table. In court, it's been said the mental health evaluation she's undergoing is not related to competency or insanity, but if it proves insanity, could be introduced at trial as such. The defense will primarily use the new mental health evaluation evidence for - Counts 3 (Child abuse resulting in death) & 4 (Tampering with a deceased human body. Stauch's team says since the mental health evaluation is not in connection to Counts 1 & 2 (1st degree murder charges) - she should be allowed to remain silent about those. They argue it's the only way for the evaluation to be constitutional. The court has DENIED her request to keep her jail visitor logs confidential. Stauch will receive a mental health evaluation at the Colorado Mental Health Institute in Pueblo specific to her conduct after Gannon died. It's unclear how long it will take. If she refuses to appear for her next hearing (1/13/22 @ 1:30pm) & doesn't tell the court 7 days in advance, deputies will try to convince her to come, but then the extraction team will physically bring her to the courthouse likely in restraints. Judge Werner said he's open to suggestions on how to move this process along faster, but District Attorney Michael Allen said he doesn't believe there are any good solutions for that. Based on their conversation, it appears this could cause another trial delay. If the prosecution is planning to call an expert to testify about her mental health during the trial, he said that a written report (from a completed evaluation) must be disclosed 63 days before the trial-which I think would be January 24 as her trial is scheduled for March 28 now. The defense is claiming she suffers from Dissociative Identity Disorder. The judge is talking about the state hospital having a 352+ waitlist as of 2 weeks ago. Judge Werner: "There is slim hope of this getting done soon." They pushed her next appearance out by a week, it's now scheduled for 1/13/22 at 1:30pm. The judge believes they may have to push it even more if she's in Pueblo when this is scheduled to take place. If the evaluation is not done by Jan. 13, they will postpone motions.

Her attorneys filed Request to waive appearance of defendant at Review hearing (D-41) & site mental health & COVID as the reasons- but say they feel the case needs to begin moving forward & they do not want this hearing delayed.

1/13/22 Update: Motions hearing (Murder) & review hearing (escape attempt) have been moved to 1/27/22 as Stauch has entered a mental health evaluation.

I live in Fountain, CO, just 2 miles from the former Stauch residence. Just saw an Instagram post from the Chick-fil-A down the street. They said they’re leaving their blue lights on all day in Gannon’s memory.

This afternoon’s hearing falls on the two-year anniversary of Gannon Stauch’s death. The boy disappeared from his Colorado Springs home in 2020. Detectives believe his stepmother, Letecia Stauch, killed him in his bedroom while the two were home alone that afternoon.

I wish they wouldn't say biological Mom :(. Landen is his Mom,it doesnt need emphasising. Its very clear in all reports that LS was his stepmother.

EL PASO COUNTY, Colo. — Thursday marks two years since 11-year-old Gannon Stauch was reported missing by his stepmother, Letecia Stauch. Now, she is accused of his murder, along with a number of other charges.

Landen Hiott, Gannon's mother, said it does not feel like two years without her little boy.

“Today, I really want to be focusing attention on him, regardless of the evil being that is standing… that is going to be there… like, I don't even want to say her name, but I just want the focus to be totally on Gannon because he deserves this," Hiott said. "Maybe it's a coincidence that it's happening today. I don't know.”

I feel for Gannon's mom. Going through this must be agony. But today's motions hearing won't really be about GS. And most court sessions aren't focused on the victim-- they can't be. I think that's partly why trials are so difficult for the victim's friends and family.
