Ms. Stauch has appeared in person today. She's present with defense attorney Josh Tolini. District attorney Michael Allen and prosecutors Dave Young and Angelina Gratiano walked into the courtroom about five minutes ago.

Judge Gregory Werner just entered the courtroom and called Ms. Stauch's case. Defense attorney Will Cook also just walked in. Judge Werner's asking prosecutors about a letter received from the state hospital.

First motion on the docket: a motion to suppress an Apple cell phone filed by the defense. Tolini said there hasn't been a response from the People yet. Gratiano said the court should find probable cause in the search warrant, and that it isn't overly broad. Tolini disagrees.

1:30pm motions hearing for #LeteciaStauch is set to begin in just a few minutes in Colorado Springs.

Letecia Stauch is present, in-person, in the courtroom.

Gannon’s father, Al Stauch, is also here. Today marks two years since Gannon’s death.

Tolini said the affidavit would allow prosecutors to search other devices, and that it doesn't include a date range. Said it's a clear violation of case law.


Judge Werner's reading some of the facts set forth in the affidavit, including calls Ms. Stauch made the day Gannon is believed to have been killed. He doesn't think the warrant is overly broad, and said he won't suppress the contents of the cell phone. Motion denied.

Next, motion to suppress wiretap. Two wiretaps requested - Feb 7th 2020 and Feb 10th 2020.

Next up: a motion to suppress wiretap evidence. There are two different numbers on the affidavit. One was obtained by Ms. Stauch at a Walmart after the sheriffs office seized her phone. The warrant asked to wiretap any conversations — verbal, text, multimedia, GPS data, etc.

It was signed by Chief Judge William Bain in February. Judge Werner said it seems there was probable cause. Authorities were trying to keep track of Ms. Stauch's movements, and at that time believed there had been a homicide. They therefore submitted the PC affidavit.

Now the judge is talking about the motion to suppress the wiretap... on two different phone numbers. Phone #1 - phone was obtained by #LeteciaStauch from Walmart after her original phone was seized by @EPCSheriff Judge says there's probable cause for the wiretap to be issued.

This phone was obtained at or around the time #LeteciaStauch was leaving the state. "Based on the conduct of the defendant there was certainly some reason to search literally everything that was on the phone," Judge Werner said.

Phone #2 - This phone was obtained approximately a week after the first one. The wiretaps on both phones were limited for 30 days. #LeteciaStauch had stopped using phone 1 when she was using phone 2. Same phone number just different physical phone.

The second phone, Judge Werner's saying, was obtained a week later. Authorities found out Ms. Stauch was using this phone instead. They intercepted only around 14 messages on the other phone. Judge Bain signed the warrant Feb. 10, and Judge Werner says there is probable cause.

I hope the judge allows the ADT info in. We need that to show what was going on during her evil deeds.
