Considering the Judge said the trial wouldn't start until April 4th - after jury selection - then LS can still plead not guilty by reason of insanity per her defense attorney. They'll get the eval by March 31st - trial wouldn't start until 4 days later.

That's true. But I guess I was thinking a trial really starts with jury selection. And that's slated to begin earlier than the 31st.

But doesn't the defendant enter their plea at start of trial? or close to it - maybe they'll stick in another hearing before trial during jury selection? Who knows with this case! LOL! :)

Yes. that's probably true. (Since I'm not an attorney I don't know for sure when certain kinds of pleas are entered.)

But I do know questioning of potential jurors might proceed differently with knowledge of the report. (For both sides.) And if there's going to be a delay in the "trial" part of the trial after jury selection, that may not work scheduling-wise for jurors. They are allowed to have lives.

Plea was entered during a hearing last fall.

Yes - but per my notes from yesterday's hearing - I have this:

Defense attorneys state that, depending on the results of the mental health evaluation, an insanity plea could still be coming.

Maybe Judge Werner doesn’t want to lose their “ place in line “ so to speak? I have no idea if it works like that.
Perhaps he already assumes it will be pushed out because of this. JMO

You could be right. I don't know if it's a matter of a place in line exactly, but the judge has requested 6 weeks for the trial. That's a big chunk on the calendar. Maybe there are ways to "work around" the various problems although I'm not so sure about that 63-day requirement @Seattle1 brought up. (63 days from now is April 4 but the eval hasn't even been done yet.)

If the trial can't go forward at the end of March/beginning of April as planned, there's probably a backlog of shorter jury trials that could make use of the courtroom and the jury pool during at least part of those 6-weeks. But more than a few days notice would be needed, I'd think. And March 17 isn't far from March 28.

There would not have been cameras/recording in court last Thursday so any images would have been from prior advisement.

That's an old photo. It's from her first appearance in Colorado I'm pretty sure.

#LeteciaStauch has a motions hearing scheduled this Friday at 9 AM.

Not sure what motion(s) needs to be addressed… the last thing filed online is from late December.

I saw the court date listed on the EP county jail site last Friday. It wasn’t listed on the court docket site at that time, so I wasn’t sure what was going on.

I didn’t realize that the County jail site would show that! Do you have to be set up for alerts ?
