We're done for today. The court officially accepted Stauch's change of plea to "not guilty by reason of insanity". This delays her trial as she has to have a 45-day review of her mental condition. We haven't gotten a new trial date, but we'll be back in court on March 17th.

Letecia would be incredibly uncomfortable being judged by a jury, as opposed to a judge.

Let's just hope this does wind up being a jury trial.
She needs to be judged in a public trial for what she has done and what she is. Period.

A bench trial would be disappointing in this case. However, I see a bit of a silver lining, judges know when they are being lied to and manipulated. If we think of the evidence that will be presented that we are aware of, I have no doubt she will be found guilty. I think it is in her hands if she is tried by the bench rather than a jury.

It makes me angry that she continues to attempt to maintain control but in the end I doubt she will be found not guilty and will spend the rest of her life in prison. But, this is who she is---- she is being no different than she was with those kids and all she interacted with. I have faith she will get her just desserts.

Unbelievable, how it has come to this! She tricked LE with her stories of who, what and when. She knew what she was doing when she killed that beautiful boy. She had sense enough to text her daughter to go get cleaning materials.

I'm praying that she does have a jury trial, she's not insane, she's a monstrous piece of work.

I guess I'm missing something but I don't quite see why folks here would be bothered by a bench trial. It will be just as public as a jury trial as there won't be cameras either way, and personally I think the trial will move faster without a jury (for a bunch of reasons) A bench trial also removes the chance of a hung jury....and a jury could be hung by one person.

What puzzles me is her attorneys being willing to go for a bench trial.

I believe that the LE knew from early on that she was responsible. I don't think she tricked anyone--- they let her talk and, eventually, the lies started multiplying. Actually, the police work was pretty good overall, IMHO.

She has only tricked herself into believing that she will be able to control the outcome of this trial. I don't think she will be able to control the judge and the proceedings. Remember this is the same judge who told her that she would have to appear and now has made her appear in court.

She may have mental illness but I do believe that she knew what she was doing on the day. I have faith that her actions and attempted cover-ups and all her protesting will not change the verdict even if it is with a judge.

I get you. I feel stupid for hoping 100% for a jury trial now. If it's a Bench Trial the Judge won't be hoodwinked by her lies and as you say, no chance of a hung jury.
Which ever way it goes there's pros and cons though. We just have to wait and see.

How dare that witch play the publicity card, she is the one who was demanding interviews with reporters whilst she had Gannons body in the truck by the side of the road. She is the one who was all over fb with her crap. She is the one calling reporters from jail to give interviews.
How dare she try to pull the insanity defence after everything she did before,during and after she killed him.

I don't think I have ever hated someone so much in my life. I so wish she was in a state that would fry her a** when she was done :mad:

I think she just enjoys torturing his family even more, by dragging this process out as long as she can, delaying the inevitable justice that's to come. Vile.

Or is her evaluation of insanity only based on her current state and what she has to say about what happened? And most importantly, does she essentially have to admit that she killed him but didn't know that it was wrong when she was doing it?

I'm not an attorney nor am I an expert in mental health stuff in CO (but have a mental health background.)

I do know a NGRI defense is generally an "affirmative defense" meaning no legal doubt the person "did it" but the question is "legal guilt" because of his/her mental state. And I gather in CO it's not just "knowing right from wrong" but also specifically being able to form the needed intent. That second point is where LS falls IMO since she's charged with 1st degree murder.

With a NGRI the State does have the burden in CO (NOT everywhere) to prove her sane. And all evals for insanity are done after the crime, sometimes long after. That's not unusual.

This plea may slow things down a bit but it seems to me she is admitting she did the act...it's no longer a matter of what happened after GS was dead. That's a big deal, I think.
