1. Search for GS
2. Investigation into the Disappearance of GS
Thank you! So I had to be "shook" back to this point LE has obviously stated they are investigating the disappearance of GS.

This (below) is from the Denver DA's webpage, but uncharged detention time would be legislated at the state level, right? So the info ought to apply in El Paso or Douglas County, too. The three day investigatory hold (bolded by me below) is, I think, what the question asker was referring to.

"
A person can be arrested for a misdemeanor or felony crime.

  • In misdemeanor cases, a police officer arrests the person and serves them with a “Summons and Complaint” listing the criminal charges.
  • In felony cases, the police can arrest a person on an “investigatory hold” and write a report summarizing the events leading up to the arrest, and send their report and investigation to the District Attorney’s Office for consideration of filing of charges. The District Attorney’s Office then decides whether to file criminal charges, and what those charges should be. Sometimes charges are filed before the defendant has been arrested. In these cases, the defendant is said to be “At Large” until he or she is arrested.
The District Attorney’s Office must generally file charges within three business days of the arrest when the defendant is in custody, although an extension of time can be granted by the court.

The charges filed by the District Attorney are listed in a written statement filed with the court, called a “Complaint and Information,” “Complaint,” or “Information.”"

Yes. But they’re still arresting them for a crime. A specific felony crime will be listed on the warrant. You can arrest someone for no reason. There has to be a crime alleged. And they can’t force someone to answer questions at any time.

It help avoids the whole rush to judgment accusation. It keeps the suspect disarmed to some degree. It makes it easier to use evidence gathered in an interview from a suspect who wasn’t Mirandized. It helps them avoid defamation lawsuits. This article about the term POI is super helpful in explaining why they typically avoid calling someone a suspect these days:

In a trap: What it means to be a 'person of interest' | In the Dark | APM Reports
I watch a lot of Investigation Discovery and this was mentioned by one of the law enforcement officers interviewed,. He said that naming a suspect or POI is being delayed more now by LE than in the past for all the reasons you just cited. He said that it use to be that LE would name a suspect and or POI fairly early in an investigation but LE has really gotten away from doing so and pretty much only names anyone when it’s time for an arrest. Since I can’t link it, it has to go down as part of my opinion. IMO, JMO

"One investigator just came out of the house to gather items from the crime lab, then walked back inside. @EPCSheriff tells me they are still not calling this a criminal investigation. #FindGannon #GannonStauch"

Why keep saying this?? Why not just go about their business, not mentioning whether it is or is not a criminal case? It is obvious they are handling it as such. What is the benefit in saying this over & over? Anyone?

Yes. And note to those who may be confused by statements by LE, METRO CRIME LABS vans don't roll up for runaways.
And ain't that the truth!! Wish we could get some from TS, so LE can bring Gannon home to his grieving, heartbroken family :(

They were probably asked that question directly. I imagine we’ll keep hearing that response for a while.

No. Nothing about the video is conclusive yet everyone is acting like it is which is what it was intended to do by design IMO. The statement by the neighbor is also not fact. His interpretation of fathers reaction and what he was told by LE is EXTREMELY SPECULATIVE. Yet this is treated as fact which IMO is wrong.

We do not know the day, time, whether it was even the same footage from the same day, who was in the footage and what happened before, during and after the footage we were shown.

In other words, we were provided this footage purposefully and the purpose was to distract. If you read between the lines (and bArely have to do that) that video was purposefully released with LE approval. IMO
Welcome. Good luck :)

Yes. We have a 100% right to remain silent at any time when it comes to possible criminal incrimination. And LE can’t haul anyone off the street and hold them unless they’re actually arresting them for a crime. 72 hour holds are for psych reasons and not an excuse for cops to interrogate someone.
Thanks sometime I will tell you a story about what I’ve learned from you and been able to use successfully ....

I don’t believe it’s LE reiterating that statement over and over again. I believe the media continues to ask “has this moved from a missing child to a criminal investigation?” They continue to press for a POI or confirmation that they suspect foul play, wanting a different answer than they have been given previously. I am so beyond proud of how this entire investigation is being handled. I don’t believe they have missed a single beat. IMO JMO MOO

I’m guessing the news reporters keep asking them as they come in and out of the house.

You just stopped my breathing...
Took the words right out of my head.
Wouldn’t it be wild if he parked in long term parking but someone came and got the truck and then put it back?

I’ve thought this from when he saw the neighbors video of her in the truck- it’s like he knew something he didn’t want to think ...his truck should not have been there and was it there upon his return ? Maybe that helped cause her leaving the home that day?

Hello everyone, long time listener, first time caller. I’m honored to officially become part of the Websleuths community.

I’ve been very hesitant to post by thoughts on Gannons case both out of the potentially sensitive nature of the investigation and the backlash that surely comes with anyone daring to suggest LS/TS/SM is anything less than a suspect in Gannons disappearance.

So let me begin by stating my disgust toward anyone assuming his death and assuming her guilt. This community is better than that. Other than the amount of time passed, there is literally nothing, NOTHING that suggests he is dead. This includes LE statements and actions. I will admit that I felt pessimistic about the direction/outcome of this case until I realized NONE of the FACTS tell us to feel that way. LE, despite what seems like common logic, isn’t even designating it a criminal investigation.

If anyone else felt like there were more questions than answers as the investigation moves forward, replace the assumption that LS harmed him with the assumption he’s alive. There are far fewer circumstances where this makes sense but an interesting thing begins to happen with this assumption...not only are there less questions, there’s hardly any questions at all and things begin to look crystal clear. JMHO.

IMO there are two scenarios we are dealing with and BOTH involve apologies to LS.

We’ve been given a lot of bones to ignore the steak.

Before I get toasted to oblivion from the pitchfork wielding mob against LS, do not forget we are not far removed from Shane Carey being all but convicted in the public eye and did a darn good job at making himself look that way, intended or not. LE is not dumb, they will misdirect intentionally to preserve the integrity of the investigation and they are most likely to do this when they think the victim is alive.

Whether you agree or not, I encourage everyone to at least pretend to have a little hope. 7,000+ investigative hours can’t be discounted just because we haven’t heard what we want to hear. IMO

Huh?

They were probably asked that question directly. I imagine we’ll keep hearing that response for a while.

Do you think they would lie, i.e if they have found a crime scene, would they continue to deny a criminal investigation? Not seeing a benefit...clearly this woman knows she is being side-eyed at the very, very least, so it would come as no surprise and they still would not be required to name a POI...they never have to do that, as far as I know, unless the person is an active threat with whereabouts unknown. Just confused as to why they would tell a fib, if that is the case (that they do have proof of physical harm i.e).

Here’s an article from a local Fox affiliate that interviewed Dog the Bounty Hunter. I don’t know his show or anything about him other than that he is eccentric looking and is very well known for his ability to track people down. His take is interesting. Food for thought. We need every tidbit we can get as our hearts ache for this family.

Duane “Dog” Chapman finds people for a living: What he says about missing Colorado Springs boy

I watched an episode or two long ago. He has a huge heart. I had no clue he had lost a child. My heart goes out to him. I am grateful he is using his platform to bring awareness to the search for Gannon.

My late father was one of those "How much does it cost and Who's going to pay for it" kind of men-- no matter the subject. He could have very well authored the ever-popular-- "follow- the- money" phrase.

In researching another Colorado case, I've just learned that there's a serious budget shortfall in Colorado to where the new Governor only weeks ago notified the heads to close a much-needed Level 3 prison located in El Paso County, effective March 7, 2020 -- for fiscal reasons. This is leaving the State DOC to scramble and find beds elsewhere for 650 male inmates!

That being said, the purpose of this post is to add that there are serious, financial advantages for EPSO to not publically and/or officially designate GS's case anything other than an endangered missing person case.

More important, please note that GS's case upgrade to endangered missing person not only brought the CBI and FBI into the investigation but also FBI's federal dollars. One would have to be blind not to have recognized that it was the FBI Evidence Response Team and their vehicles that have been parked along Colorado 105 and in the driveway leading to the gate of Sierra Pines-- about a half-mile north of the El Paso County line.

The federal partner, crossing county lines to lead the search for GS, is exactly what his case needs until this child is recovered (when FBI services terminate).

I can't end this post without a shout-out to the prosecutor's office led by one of the finest DA's in the region, Dan May. There should be no doubt that the EPSO has been receiving the finest guidance and support from his office. And if and when the time comes, we should trust that this prosecutor's office will leave no stone unturned to get justice for GS.

MOO

What would they be taking pictures of in the house at this point? Wouldn’t that have already been done?

It's too well worded, unless it was proofread by another. December would be about the right timeframe if someone wanted to start premeditating a "perfect" murder and go here for tips.

I was going to just sit back, munch the popcorn and watch the dust kick-up but I have to make this one comment, which is not directed at @Frig, but is directed to each and everyone of us:

Occam's Razor: Know it. Learn it. Live it.
