anyone think Spengler & Higgs, not only look alike but their voices also sound alike - even, in their speaking & umms & hesitations & sputtering? MOO

I posted what I thought was a text or email alert that Denver Channel 7 was promoting. I thought it was the 'verdict watch' texts that came out before previous trials. When looking, it is the App for their channel! :( I don't want that because that will be all news items. Sorry.
If anyone knows of a text alert for the trial, please post.

WHAT???? You made a mistake....shameful :blushing:---think we all have done that one! I don't blame you for posting it-think we all are looking for something to cue us in....Like I keep suggesting--I want a quickie

Listening to their recorded arguments. Judge said, he can be found guilty on some counts & also not guilty of some-BUT, they cannot find him guilty of some counts & not guilty by insanity on others.
So, they can have mixed but not mixed with NGRI.
Is that what you guys understand?

Today, around the hearing and afterward, we'll have chances to update our timeline and highlights of the trial. If you have suggestions, tweet me @pstenser or let me know here PS. I've checked the document library and there is not a public copy of this draft.. only a notice of how it is being labeled in the court Phil Tenser

Now discussing when/where in the instructions to define culpable mental state Next is the sanity instruction Samour says 7 minutes ago

"prosecution must disprove beyond a reasonable doubt both of the above..." That references in the insanity prongs of culpable mental state or knowing right from wrong The basis for these instructions that are being discussed is here: www.courts.state.co.us Teams of attorneys will be in the courtroom for months, trying to prove their points about James Holmes 2 minutes ago

Judge makes a record that defense is asking for instruction about commitment procedures. Last time we discussed this, they were asking for a much longer version. Judge says the reason this is allowed is to explain what happens in the event of an NGRI finding Phil Tenser

Rhetorical question from the judge: How much detail is appropriate? Judge says the goal is a "brief description" and he's only making minor changes to language few seconds ago

Judge says this language is the test for release if the defendant is committed due to an NGRI finding: "The defendant has no abnormal mental condition that would likely cause him to be dangerous to himself or others or the community in the foreseeable future..." Phil Tenser

I've always had a dream that the defense would be neighbors with the clients that they defend--they always want to release them and I certainly do not want them living in my neck of the woods....

This release criteria bothers me. If JH takes his medication correctly he will likely behave in a 'normal' manner. If he was released and decided to stop taking his meds he might become dangerous again. Who will monitor him once he leaves hospital if he gets NGRI?

That is correct. CMHIP is the most likely place he'd go... but that isn't guaranteed. The state would have the option to send him to another hospital if they think it would be better, but CHMIP is a very big and well-prepared institution That is correct. It appears to have both hospital buildings and others that look more like a jail with fences and security and such. It is a very huge campus Phil Tenser
