This thread has ran pretty smooth and calm for a court trial thread until this last phase of the trial. I wonder if the jury is going to start have as many varied and different opinions as we websleuthers seem to be having during the mitigation phase? :pillowfight2: JMO

We may disagree on issues, but we have always done so nicely and if we misunderstand someone we, say we are sorry and rephrase what we meant. That is until today.

I think most of us can continue to agree and disagree without an issue. Sorry this is happening to all of us.

@larryryckman: Judge says that in the end, it is JH's decision whether to testify, even if his attorneys advise against it.

@pstenser: #TheaterShooting gunman again says “I choose not to testify” in his own case.

@larryryckman: Victims are asking the court for 2 hours notice once a verdict is reached in Phase 2. Judge OKs 2-hour notice. #theatershooting

I posted earlier today my personal thoughts. If I was automatically discounted on the jury during deliberations ...I might tend to dig in further until i felt i was truly being HEARD..and moreso identifying with defendant :moo:

Good luck with trying to promote that excuse for the shooter! Seems the jury isn't buying it either.

OMG I Didn't say that. He is mentally ill but not insane. That's why laws are in place for people psychotic with homicidal or suicidal ideation/ delusions/ intrusive thoughts. A psychiatrist can, has authority to commit patient against the patients will if homicidal or suicidal. If she would have called the police dept to standby or hospital to put on involuntary 5150 hold he would have been evaluated and stabilized put on anti-psychotic meds. Being he was homicidal there was a good chance his apt would have been searched by police and he would be arrested in the hospital. All that bomb stuff would have been removed.

If Fenton would have done that the turn of this event could have had a different outcome. She made a very poor decision.

As long as the jury continues to focus on James Holmes and his victims and does introduce their own grudges, prejudices, and personal agendas into their deliberations, they will be fine. IMO, of course.

Homicidal thoughts. That's meets the criteria. She was worried enough to consult with other Drs. and school security. She didn't take the next step. I believe she said she thought about it. I can't remember but she down played it. Some of the victims families have filed suit.

So here's an age old question- Why do killers, who have no respect for other lives; why do they ALL want to avoid the death penalty? They want to kill but they don't want to be killed?
Ego? Fear of death? Why do they fear death but have no problem committing it?
This is not a DP debate question.

I just heard on the news channel this is a very odd case because in most mass murder cases the shooter kills himself or is shot. They don't live to have a trial. This case is not the norm that's for sure.

As an aside, many victims and their families have filed suit against the movie theater.

Movie theater really couldn't have done anything. Dr Fenton could have. Most of you here do not have a very mentally ill adult son or daughter. Thank goodness so it's very hard for you to understand. I've been going through this with good and bad psychiatrist for many years including the legal system for all my Sons arrests and hospital commitments. I am in no way making excuses for the shooter. I have a very opened mind and unbiased. I don't like it when people are like a lynch mob. This trial needs to be over soon. This whole trial makes me so angry on both sides. I hope it's over soon I really need a break from it.

yes, we rarely have a mass murderer go to trial. But even people who kill one person, the killer doesn't want a DP. But the killer has no problem giving a DP to someone else. It's strange, if they don't care about life, they kill someone but boy, when it's their turn, they don't want a death sentence.

So the case is that the cinema should have foreseen there might be a mass shooting?

Would added security have stopped the shooter? Maybe..... If there was a guard inside the theatre he could have stopped the shooter going out the exit door to get his weapons/armour.

There are security guards in shopping malls, hospitals and even schools. Why not cinemas?

I know. I wonder that too. Maybe it's family who don't want it. I've never known a murderer so I don't know but here in Cali we have over 400 on death row so they might as well get rid of it. It cost less to house a prisoner for life then all the appeals for DP. Why have it if state never executes. Doesn't make sense to me.

((whiteorchids)) So sorry that i feel your pain . Many folks ...including myself at one time "thought " homicidal thoughts ...but Never had a plan ...just wanted others to die in my thoughts ..

That is all the doctor had ..how could she put him into detention with that . I'll agree to disagree ..
