#Theatershooting jury must be unanimous in each DP phase in CO. Hung jury will mean life without parole. (Unlike mess in AZ #JodiArias)

You said it! I have never seen such! Because I live in NC, I will say what I know about how NC courts handle it: In a DP case, if the jury cannot agree 12--0 on DP or LWOP in the penalty phase, the penalty defaults to LWOP. The judge handles the declaration of the penalty which will be LWOP. Just like here in Colorado. I simply could not imagine why AZ handled it the way they did. To each his own...

And in NC, the penalty for the defendant, if guilty, on all cases, is pronounced at the end of the trial. The same day. There is never a delay as we see in many states. And the defendant is pronounced by the judge, "He/She is in your custody, Deputy," and he/she is cuffed and escorted out of the courtroom to be taken to prison. Done.

I hope those penny-ante arguments will bite them in the a$$ when this part starts rolling. I guess the defense group thought what they had to say was necessary -- certainly to get them on the record -- appeal, appeal, appeal. They are grasping at straws because that's all they've got. They have been on very thin ice throughout, and it's getting thinner by the minnit. Just like other weak-defense-from-the-get-go trials we have seen. It's the throw-it-against-the-wall method. They've got nuttin' honey, and they know it... smh

I'm OVER hearing about shooters constitutional rights---what about the victims rights to life. Defense is really annoying me today :gaah:
