This is from a news article:

In a flat, emotionless voice, 27-year-old Holmes told psychiatrist Dr William Reid he collected one 'value unit' for each person who died.

Holmes also told Reid he tried to limit the number of children killed by carrying out the attack at a late showing of a PG-13 movie.

On the videotape, Holmes said he was remorseful and sad when he learned she was killed.

'I tried to minimize child fatalities by choosing a midnight PG-13' movie, he said.

But he says he would have gone through with the attack even if he had known a child would die.

'I think I still would have carried it out,' he said.

Holmes referred to the wounded as 'collateral damage' and said he regretted they were hurt, but 'I didn't figure the collateral damage had anything to do with me after the crime.'

Reid has already testified that Holmes told him he regretted the attack and sometimes cried at night about it. He has also testified that he concluded Holmes was sane at the time of the shooting.

I think Mr. Orman explained why he intended to kill a child under 12 well..He said 1) He knew the theatre was full of kids ranging in age months thru to 12 before he even left to get dressed up in his gear 2) His intention to kill everyone in that theatre given his ammunition and weapons he carried. which indicates he intended to kill all including the children under 12.

Pros. does not have to prove he targeted Veronica specifically. He could have killed far more children had his gun not jammed!!!!

I definitely agree with this 100% but I knew that wording would stump the jury that's why judge asked it they wanted to change it. Especially when in the Reid interview he did not want to kill kids. It just confused the jury which is not good.

According to the courts definition of "intended", feeling regret makes no difference at all. What does make a difference and is the key is that the gunman intended to kill everyone in the theater and new that would include children.

"Minimize" doesn't mean prevent. All it takes is one to be an aggregating factor.

I know but I think they are hung up on that one because for some reason they believe it's not a correct aggravator. :(

I'm worried that jury will think DT lied about this and therefore disregard all the other aggravators. The judge specifically asked if they wanted to change the wording of "intent" both teams said no and moved on to the next aggravator. I thought that was really a stupid decision on the part of DA.

I don't understand - the defense team lied about what?
Would you please explain? thanks

We don't believe they did but possibly the jurors do. That's why they can't get passed it. We should have already been on phase two by now. We are privy to more info questions and answers since we have been on this case since day one. They don't understand like we do.

JH clearly stated to Reid he didn't want to kill kids and he felt remorse that he did. This is the part in the interview jury want to review.

IMO, he deserves the DP and should get it. If he did get it, I doubt CO would actually carry out the sentence.

As for the Jury, I have felt he would not get DP as someone on the jury would feel his mental state would come into play and give him LWOP.

With that being said, even if he is a 'protected' inmate with LWOP, he will be around more inmates who will not like what he did and inmates will take care of him.

I also do not wonder if he would start to refuse to take his meds so he could 'go to the hospital' for treatment(s) and hope to stay there for the rest of his life.

A different twist and turn then CA or JA, but still twists and turns. The Judge is really trying hard to be fair and keep things moving.

If it wasn't his intent to take children's lives or leave children parentless why didn't he just leave the theatre when he saw so many families in there?

Holmes aimed at people. Victims saw the laser site on themselves as they were getting shot. He aimed at people trying to run to the exits. He hit Veronica 4 times. He knew what he was doing. Only after he realized how much hatred he would get for killing a child did he try and act like he didn't mean to kill a child.
